Learned advocate<br \/>\nMr. J.S.Yadav waives service of Rule on behalf of respondent No.1.<br \/>\nLearned advocate Mr. M.G.Nagarkar waives service of Rule on behalf of<br \/>\nrespondent No.2.\n<\/p>\n<p>2.\tThe present application<br \/>\nby way of Judges Summons, is preferred for extension of time for the<br \/>\npurpose of demolition\/dismantling\/removal of the assets purchased by<br \/>\nthe applicant of the property under liquidation. This Court on<br \/>\n                  28.2.2011 passed the following order:-\n<\/p>\n<p> 1.\tRULE. Learned Advocate<br \/>\nMr. J.S. Yadav waives service of RULE for respondent No.1-Official<br \/>\nLiquidator and learned Advocate Mr. M.G. Nagarkar waives for<br \/>\nrespondent No.2.\n<\/p>\n<p>2.\tThis is an application<br \/>\npraying for extension of time for completion of demolition \/<br \/>\ndismantling work   removal of the assets purchased by the<br \/>\napplicant. Vide order dated 16.04.2010 four months time was granted<br \/>\nfor the same on the condition that the applicant shall deposit \/ pay<br \/>\nan amount of Rs.20,000\/= per month for the delayed period.<br \/>\nThereafter, once again the applicant prayed for extension of time and<br \/>\nthe Court passed the following order on 27.12.2010.  The same is<br \/>\nreproduced as under :-\n<\/p>\n<p> 1. Without going into any<br \/>\ndetails of who is responsible for delay in removing superstructure,<br \/>\nmachinery and debris, petitioner is granted extension upto 28th<br \/>\nFebruary, 2011 to clear all the items purchased through Court<br \/>\nauction.  Petitioner shall continue to pay charges @ Rs.50,000\/- per<br \/>\nmonth as required by previous order passed by this Court.\n<\/p>\n<p>2. Learned Counsel for the<br \/>\nrespondents points out that more than sufficient opportunities have<br \/>\nalready been granted to the applicant.  I am prima-facie in agreement<br \/>\nwith such contention. This extension is, however, granted only in<br \/>\nlarger interest of justice and it is clarified that petitioner should<br \/>\nnot expect any further extension.\n<\/p>\n<p>3. Application is disposed<br \/>\nof accordingly.\n<\/p>\n<p>3.\tLearned Advocate Mr.<br \/>\nPranav G. Desai for the applicant submits that on account of genuine<br \/>\nreasons and other problems, the work could not be completed and<br \/>\ntherefore as a last opportunity, time may be extended by a further<br \/>\nperiod of four months.  There is no objection at the end of Mr.<br \/>\nNagarkar appearing for respondent No.2 except the fact that according<br \/>\nto him the period of four months is too long and the same may be<br \/>\nreduced to three months.  The same request has been reiterated by Mr.<br \/>\nYadav.\n<\/p>\n<p>4.\tI have heard Mr. Nagarkar<br \/>\nfor respondent No.2 and Mr. Yadav for the official Liquidator<br \/>\nrespondent No.1.\n<\/p>\n<p>5.\tIn the facts and<br \/>\ncircumstances of the case and having regard to what has been stated<br \/>\nin the application, I deem it just and proper to grant three months<br \/>\ntime period to the applicant for completion of demolition \/<br \/>\ndismantling and removal of the assets purchased by the applicant.<br \/>\nApplicant is granted extension upto 31ST<br \/>\nMAY, 2011 to clear all the items purchased through court auction.<br \/>\n The applicant shall continue to pay charges at the rate of<br \/>\nRs.20,000\/- per month as required by previous order passed by this<br \/>\nCourt.  It is clarified that this extension is for the last time in<br \/>\nthe peculiar facts and circumstances of the case.  There shall be no<br \/>\nfurther extension on any grounds.\n<\/p>\n<p>6\tWith the aforesaid<br \/>\ndirections, this Company Application is disposed of accordingly.<br \/>\nRule is made absolute.\n<\/p>\n<p>2.\tIt is very evident from<br \/>\nthe order dated 28.2.2011 that the extension was for the last time.<br \/>\nIn the peculiar facts and circumstances of the case, however, it<br \/>\nappears that even by 31.5.2011 the applicant failed to remove and<br \/>\ndismantle the entire structure which includes plant and machinery<br \/>\nstanding on the land and is now once again before the Court praying<br \/>\nfor further extension.\n<\/p>\n<p>3.\tThis application has been<br \/>\nvehemently opposed by Mr. Yadav appearing for the Official Liquidator<br \/>\nand Mr. Nagarkar appearing for the GIDC. Both the learned counsel<br \/>\nappearing for the Official Liquidator  and GIDC submitted that<br \/>\nbecause of negligence on the part of the applicant in not removing<br \/>\nand dismantling structure they are not able to use the land. Learned<br \/>\nadvocate Mr. Godiawala appearing for the applicant submits that in<br \/>\nspite of  the best of the efforts put in to see that the entire<br \/>\nstructure is removed and dismantled, still some portion of it remains<br \/>\nto be removed and they are trying their best to see that it is<br \/>\nremoved as early as possible so that the possession can be taken over<br \/>\nby the Official Liquidator.\n<\/p>\n<p>4.\tI have taken serious note<br \/>\nof the fact that in spite of clarifying in the last order that it<br \/>\nwould be the last extension, still the present application has been<br \/>\npreferred. In the peculiar facts and circumstances of the case, I am<br \/>\ninclined to give one another chance to the applicant but this time<br \/>\nsubject to certain terms and conditions, which are as under:-\n<\/p>\n<p>1)\tThe applicant shall file<br \/>\nan undertaking on oath before this Court within a period of 4 days<br \/>\nfrom today that he will remove\/dismantle the entire structure<br \/>\nstanding as on today on the land on or before 9.7. 2011 and shall<br \/>\nhand over the possession to the Official Liquidator on 10.7.2011.\n<\/p>\n<p>2)\tThe applicant should also<br \/>\nundertake that if he fails to remove the structure within the<br \/>\nstipulated period i.e. 9.7.2011, then he shall hand over the vacant<br \/>\npossession of the entire land to the Official Liquidator as it is in<br \/>\nthe same condition existing on that day without raising any dispute<br \/>\nof any nature.\n<\/p>\n<p>3)\tIt is also clarified that<br \/>\nit will also be open for the Official Liquidator and the GIDC<br \/>\ntogether to take over the possession of the land on 10.7.2011 from<br \/>\nthe applicant.\n<\/p>\n<p>5.\tIn the last order it was<br \/>\nobserved that the applicant shall continue to pay charges at the rate<br \/>\nof Rs.50,000\/- per month as required by previous order passed of this<br \/>\nCourt. For the present month, the applicant shall now pay<br \/>\nRs.1,00,000\/- per month to the Official Liquidator on the date when<br \/>\nthe possession is handed over to the applicant i.e. 9.7.2011. He will<br \/>\ndeposit Rs.1,39,000\/- with the Official Liquidator.\n<\/p>\n<p>6.\tWith the aforesaid<br \/>\nobservations, this Company Application is disposed of accordingly.<br \/>\nRule is made absolute accordingly.\n<\/p>\n<p>(J.\n<\/p>\n<p>\t\t\tB.
