SHAH\n\t\t\n\t\n\n \n\nDate\n: 01\/09\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\npetitioner Gujarat<br \/>\nState Land Development Corporation Limited has preferred Special<br \/>\nCivil Application No.7466\/2003 challenging the impugned judgment and<br \/>\naward passed by the learned Labour Court, Kalol dated 27.12.2002<br \/>\npassed in Reference LCK No.241\/1990, by which the learned Labour<br \/>\nCourt has partly allowed the said reference by directing the<br \/>\npetitioner to reinstate the respondents with 30% back wages.\n<\/p>\n<p>\tSpecial<br \/>\nCivil Application No.132\/2004 has been preferred by the workman<br \/>\nchallenging the aforesaid judgment and award passed by the learned<br \/>\nLabour Court, Kalol in denying 70% back wages.\n<\/p>\n<p>2.\tIt<br \/>\nis not in dispute that respondents of Special Civil Application<br \/>\nNo.7466\/2003 were admittedly appointed as daily wagers on stop gap<br \/>\narrangement till the regularly selected candidates are available.  In<br \/>\nthe appointment order itself, it has been specifically provided that<br \/>\nthe respective respondents shall be relieved on availability of the<br \/>\nregular selected candidates.  It is not in dispute that on<br \/>\navailability of the regularly selected candidates, respective<br \/>\nrespondents came to be relieved.  Being aggrieved and dissatisfied<br \/>\nwith the aforesaid, the respondents raised industrial dispute which<br \/>\nwas numbered as Reference LCK No.241\/1990 and the learned Labour<br \/>\nCourt by impugned judgment and award partly allowed the same<br \/>\ndirecting the petitioner to reinstate the respondents with 30% back<br \/>\nwages.\n<\/p>\n<p>3.\tShri<br \/>\nMunshaw, learned advocate appearing on behalf of the petitioner has<br \/>\nvehemently submitted that as such, as the appointment of the<br \/>\nrespective respondents were as daily wager on stop gap arrangement<br \/>\nand till regularly selected candidates are available, Section<br \/>\n2(oo)(bb) of the Industrial Disputes Act would be applicable and<br \/>\ntherefore, the learned Labour Court has materially erred in directing<br \/>\nthe petitioner to reinstate the respondents with 30% back wages.  It<br \/>\nis further submitted that as the post on which the respective<br \/>\nrespondents were working on stop gap arrangement, to be filled by<br \/>\nregularly selected candidates, no post was available and therefore,<br \/>\nthere cannot be any reinstatement on the post, which is not vacant.<br \/>\nIt is further submitted that as such in the appointment order itself,<br \/>\nit was provided that respective respondents shall<br \/>\nbe relieved as soon as the regularly selected candidates are<br \/>\navailable and therefore, as soon as the regularly selected candidates<br \/>\nare available and were appointed, the respective respondents were<br \/>\nrelieved.  Therefore, it is submitted that there was no retrenchment<br \/>\nand\/or termination at all.  Under the circumstances, it is requested<br \/>\nto allow the present Special Civil Application.\n<\/p>\n<p>4.\tShri<br \/>\nBipin Mehta, learned advocate appearing on behalf of the respective<br \/>\nrespondents has tried to support the impugned judgment and award<br \/>\npassed by the learned Labour Court by submitting that this is<br \/>\npetition under Article 227 of the Constitution of India and<br \/>\nconsidering the fact that when the learned Labour Court found that<br \/>\nthe termination of the respective respondents was in violation of the<br \/>\nprovisions of 25-F of the Industrial Disputes Act, learned Labour<br \/>\nCourt has not committed any error in directing the petitioner to<br \/>\nreinstate the respondents that too with 30% back wages.  It is<br \/>\nfurther submitted by him that in fact the Labour Court ought to have<br \/>\nawarded full back wages.  Therefore, it is requested to allow even<br \/>\nthe Special Civil Application No.132\/2004.\n<\/p>\n<p>5.\tHaving<br \/>\nheard learned advocates appearing on behalf of respective parties and<br \/>\nconsidering the aforesaid undisputed fact that when respective<br \/>\nrespondents were appointed, they were appointed as daily wager and as<br \/>\na stop gap arrangement till the regularly selected candidates are<br \/>\navailable and considering the fact that in the order of appointment<br \/>\nitself, it was specifically provided that as soon as the regularly<br \/>\nselected candidates are available and appointed, respective<br \/>\nrespondents shall be relieved, the Labour Court has materially erred<br \/>\nin partly allowing the said Reference by directing the petitioner to<br \/>\nreinstate the respondents.  As such there is no retrenchment and\/or<br \/>\ntermination at all.  It is also required to be noted that even when<br \/>\nthe respective respondents were appointed as daily wagers, no<br \/>\nselection procedure was followed.  As rightly submitted by Shri<br \/>\nMunshaw, learned advocate appearing on behalf of the petitioner, when<br \/>\nthere is no vacant post, there is no question of reinstatement on the<br \/>\npost which is not vacant.  Considering the aforesaid over all facts<br \/>\nand circumstances of the case, impugned judgment and award passed by<br \/>\nthe learned Labour Court directing the petitioner to reinstatement<br \/>\nthe respondents, deserves to be quashed and set aside and is,<br \/>\naccordingly, quashed and set aside.  At this stage, Shri Mehta,<br \/>\nlearned advocate appearing on behalf of the respondents has stated<br \/>\nthat there are two posts available at other places and therefore, as<br \/>\nand when the concerned respondents apply, their case may be<br \/>\nconsidered in accordance with law.\n<\/p>\n<p>6.\tIn<br \/>\nview of the above and for the reasons stated above, Special Civil<br \/>\nApplication No.7466\/2003 is allowed.  Impugned Judgment and award<br \/>\ndated 27.12.2002 passed by the learned Labour Court, Kalol in<br \/>\nReference LCK No.241\/1990 is hereby quashed and set aside.  Rule is<br \/>\nmade absolute to the aforesaid extent in Special Civil Application<br \/>\nNo.7466\/2003.  So far as Special Civil Application No.132\/2004 is<br \/>\nconcerned, the same is dismissed.  Rule is discharged.\n<\/p>\n<p>7.\tHowever,<br \/>\nit is observed that as and when the concerned respondents apply for<br \/>\nthe appointment on the vacant post, their case may be considered in<br \/>\naccordance with law for which this Court has not expressed any<br \/>\nopinion on merits.
