\n    This appeal is filed by the petitioner in O.P.<\/p>\n
(MV)No.2471\/04 on the file of the Motor Accidents<\/p>\n
Claims Tribunal, Kottayam, assailing the dismissal<\/p>\n
of the aforesaid original petition.<\/p>\n
    2.  According to the appellant\/petitioner, at<\/p>\n
about 8 p.m. on 29.3.2004 while he was riding his<\/p>\n
motor bike bearing Reg.No.KL-7\/AM 4232 from east to<\/p>\n
west  along   the  Mulanthuruthy-Arakkunnam   road,<\/p>\n
within the limits of Mulanthuruthy Police Station,<\/p>\n
a Maruti Car bearing Reg.No.KL-7\/6111, owned by the<\/p>\n
second  respondent   and   driven  by   the   first<\/p>\n
respondent in a rash and negligent manner, without<\/p>\n
dimming its headlights, came from the opposite<\/p>\n
direction and hit on his motor bike and thereby he<\/p>\n
was thrown down to the road and he sustained<\/p>\n
injuries to both his hands and right lower limb,<\/p>\n

contusion to the muscles of his right thigh and<\/p>\n
contusion    over  right forearm.  He  alleged  that<\/p>\n
immediately    he  was  taken  to  Varsha  Hospital,<\/p>\n
Mulanthuruthy where he was given first aid and he<\/p>\n
was later taken to the Lakeshore Hospital, Kochi,<\/p>\n
where he was admitted and treated for four days and<\/p>\n
thereafter    he continued OP treatment in the same<\/p>\n
hospital for some time.       According to him, he<\/p>\n
suffered much pain and agony and sustained partial<\/p>\n
disability on account of the injuries and has spent<\/p>\n
considerable amounts for treatment and that the<\/p>\n
accident    occurred solely  due  to  the  rash  and<\/p>\n
negligent    driving  of  the   car  by  the   first<\/p>\n
respondent. Second respondent is the registered<\/p>\n
owner   of   the  car  and  employer  of the   first<\/p>\n
respondent.     It stood validly insured with the<\/p>\n
third respondent Insurance Company at the time of<\/p>\n
the accident.      He claimed in all an amount of<\/p>\n
Rs.1,50,000\/-    by  way of  compensation  from  the<\/p>\n
respondents.\n<\/p>\n

    3.     Though  respondents   1  and  2   entered<\/p>\n
appearance,    they   did   not  file  any   written<\/p>\n
statement.    The   third   respondent insurer,  on<\/p>\n
permission having been obtained under Section 170<\/p>\n
of the M.V. Act, filed written statement and an<\/p>\n
additional     written   statement,   wherein,   the<\/p>\n
contentions, inter alia, were that the accident<\/p>\n
occurred not in the manner alleged, but that, at<\/p>\n
the time of the occurrence, the appellant was<\/p>\n
riding his motor bike in a rash and negligent<\/p>\n
manner at an exorbitant speed through the wrong<\/p>\n
side of the road and without lighting its headlight<\/p>\n
and that was how the car happened to hit on the<\/p>\n
motor bike and the accident occurred; that the<\/p>\n
police charge sheeted the appellant and he appeared<\/p>\n
before    the   Magistrate’s  Court,  Ernakulam and<\/p>\n
pleaded guilty and was convicted; that the original<\/p>\n
petition    was   filed  in   collusion with   other<\/p>\n
respondents; that, however, the injuries sustained<\/p>\n
by the appellant\/petitioner were very minor and<\/p>\n

that in any event, he is not entitled to any<\/p>\n
compensation and the original petition is liable to<\/p>\n
be dismissed.\n<\/p>\n
    4.    During trial, on the side of the appellant\/<\/p>\n
petitioner, PWs 1 and 2 were examined and Exhibits<\/p>\n
A1 to A10 were got marked and on the side of the<\/p>\n
respondents Exhibits B1 to B3 were got marked.    The<\/p>\n
Tribunal considered the case in the light of the<\/p>\n
above evidence, found that the accident occurred<\/p>\n
solely due to the negligence of the appellant and<\/p>\n
dismissed the original petition.\n<\/p>\n
    5.     It is contended before us by the learned<\/p>\n
counsel for the appellant that the Tribunal has not<\/p>\n
appreciated the case in the proper perspective and<\/p>\n
that evidence of PWs 1 and 2 should have been<\/p>\n
accepted to find that the accident occurred on<\/p>\n
account of the rash and negligent manner in which<\/p>\n
the first respondent drove the car, which hit<\/p>\n
against the motor bike of the appellant.   It is the<\/p>\n
case of the appellant that he was riding his motor<\/p>\n

bike from east to west along the Mulanthuruthy-<\/p>\n
Arakkunnam Road at about 8 p.m. on 29.3.2004 and<\/p>\n
the offending vehicle, namely, Maruti Car bearing<\/p>\n
Reg.No.KL-7\/6111,   which   was  coming  from   the<\/p>\n
opposite direction at an excessive speed without<\/p>\n
dimming its headlights, hit against his motor bike.<\/p>\n
    6. Exhibit B3 is the copy of the final report<\/p>\n
submitted by the Mulanthuruthy Police in Crime<\/p>\n
No.73\/04,    registered  in  connection  with   the<\/p>\n
occurrence involved in the case.  As per the final<\/p>\n
report, it is the appellant who was charge sheeted<\/p>\n
for  offences   under  Section 279  IPC  read  with<\/p>\n
Sections 360 and 177 of the M.V. Act.    He pleaded<\/p>\n
guilty to the charge and was convicted by the<\/p>\n
Magistrate. Exhibit B1 is the copy of the scene<\/p>\n
mahazar prepared by the police in the course of<\/p>\n
investigation. It shows the place of occurrence as<\/p>\n
the tarred portion of the road that lies east-west,<\/p>\n
precisely 137 cms. south from the northern end of<\/p>\n
the tarred road. The appellant was to keep his<\/p>\n

side, which is the southern side of the road, as he<\/p>\n
was  proceeding   to  west  along the  said   road.<\/p>\n
Obviously, when it is shown that the accident<\/p>\n
occurred at the northern most portion of the tarred<\/p>\n
road, namely, 137 cms. south from the northern most<\/p>\n
end of the road, it shows that the accident has<\/p>\n
taken   place  by  the motor  bike  ridden  by  the<\/p>\n
appellant proceeding to the wrong side of the road.<\/p>\n
The   charge    against  the  appellant   is   also<\/p>\n
substantiated by the above fact.  As per Exhibit B3<\/p>\n
final report, the motor bike was being ridden by<\/p>\n
the appellant without switching on its headlight,<\/p>\n
though the time was 8 p.m.   No acceptable evidence<\/p>\n
has been adduced by the appellant to prove his<\/p>\n
case.\n<\/p>\n
    7.     It is worthy to note that PWs 1 and 2,<\/p>\n
examined by the appellant to prove his case of<\/p>\n
negligence on the part of the driver of the car,<\/p>\n
are not witnesses in Exhibit B3 final report.<\/p>\n
Further, it is strange that the appellant has not<\/p>\n
MACA 2142\/08               7<\/span><\/p>\n
cared to enter the witness box to swear to his<\/p>\n
case.   The evidence tendered by PWs 1 and 2, in the<\/p>\n
circumstances, was being rightly rejected by the<\/p>\n
Tribunal.\n<\/p>\n
    8.      Exhibit A1 is the copy of the private<\/p>\n
complaint    filed  by   the  appellant  before   the<\/p>\n
Additional     Chief  Judicial  Magistrate’s   Court,<\/p>\n
Ernakulam against the first respondent alleging<\/p>\n
that the accident occurred due to the negligent<\/p>\n
driving of the car by the first respondent, which<\/p>\n
hit against his motor bike.       Exhibit B2 is the<\/p>\n
report submitted by the police on 1.4.2004 stating<\/p>\n
that investigation in the case is in progress<\/p>\n
against the appellant.    On submission of Exhibit B3<\/p>\n
final report against the appellant, Exhibit A2<\/p>\n
notice     dated  31.10.2004   was  served   on   the<\/p>\n
appellant.    However, the appellant did not file any<\/p>\n
protest complaint pursuant thereto.    The Tribunal,<\/p>\n
which considered the above evidence, found that the<\/p>\n
accident    occurred  on  account  of  the  appellant<\/p>\n

riding his motor bike to the wrong side of the road<\/p>\n
even without switching on its headlight and he was<\/p>\n
solely responsible for the accident taking place<\/p>\n
and that he is not entitled to any damages for the<\/p>\n
injuries sustained to him solely on account of his<\/p>\n
negligence and dismissed the original petition.<\/p>\n
There is absolutely no material for us to come to a<\/p>\n
different conclusion than that arrived at by the<\/p>\n
Tribunal.    Consequently,   concurring   with   the<\/p>\n
findings of the Tribunal, this appeal deserves only<\/p>\n
to be dismissed.\n<\/p>\n
     In the result, the appeal is dismissed.<\/p>\n
