THE STATE OF BIHAR\n   2. THE EXECUTIVE MAGISTRATE, ROHTAS (SASARAM)\n                               *********\n<\/pre>\n<p>2    07\/07\/2011             Heard Counsel for the petitioner and the A.P.P.<\/p>\n<p>                  appearing on behalf of the State.\n<\/p>\n<p>                            This application has been filed for quashing of<\/p>\n<p>                  the entire First Information Report of Sasaram (M) Police<\/p>\n<p>                  Station Case No. 538 of 2007 under Section 7 of the<\/p>\n<p>                  Essential Commodities Act.\n<\/p>\n<p>                            The allegation in the First Information Report is<\/p>\n<p>                  that the shop (Hotel) of the petitioner was raided. It was<\/p>\n<p>                  found that one tractor containing 32 bags of cement was<\/p>\n<p>                  standing in front of the shop of the petitioner. On<\/p>\n<p>                  interrogation, it was disclosed by the driver of the tractor<\/p>\n<p>                  that 18 bags of cement were unloaded to the shop of the<\/p>\n<p>                  petitioner. Thereafter, 405 bags of cement, 42 bags of<\/p>\n<p>                  D.A.P., 18 bags of Kribhico Urea and 5 bags of I.P.L.<\/p>\n<p>                  Phosphate fertilizers were recovered from the shop of the<\/p>\n<p>                  petitioner.\n<\/p>\n<p>                            Learned Counsel for the petitioner submits that<\/p>\n<p>                  there is no allegation that the petitioner had illegally kept<\/p>\n<p>                  the seized articles or that he was going to utilize the<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>        fertilizer for selling them in the black market. It is further<\/p>\n<p>        submitted that merely because the bags were lying on the<\/p>\n<p>        tractor, does not mean that the bags were to be sold in<\/p>\n<p>        the black market.\n<\/p>\n<p>                  This Court finds that the matter is still under<\/p>\n<p>        investigation and as such, I do not find any special<\/p>\n<p>        circumstances     for   quashing    of   the   entire    First<\/p>\n<p>        Information Report.\n<\/p>\n<p>                  This application is accordingly dismissed.<\/p>\n<pre>Anand                                         ( Sheema Ali Khan, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Suryabansh Singh vs The State Of Bihar &amp; Anr on 7 July, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA CR.MISC.
