{"id":106692,"date":"2011-09-16T00:00:00","date_gmt":"2011-09-15T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/kumari-payal-payl-kumari-vs-mukund-bihari-on-16-september-2011"},"modified":"2018-08-01T21:18:24","modified_gmt":"2018-08-01T15:48:24","slug":"kumari-payal-payl-kumari-vs-mukund-bihari-on-16-september-2011","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/kumari-payal-payl-kumari-vs-mukund-bihari-on-16-september-2011","title":{"rendered":"Kumari Payal @ Payl Kumari vs Mukund Bihari on 16 September, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Kumari Payal @ Payl Kumari vs Mukund Bihari on 16 September, 2011<\/div>\n<pre>                 IN THE HIGH COURT OF JUDICATURE AT PATNA\n                        Miscellaneous Jurisdiction Case No.3374 of 2010\n                                 Kumari Payal @ Payal Kumari\n                                               Versus\n                                         Mukund Bihari\n                                  ----------------------------------\n<\/pre>\n<p>3   16.09.2011            Heard learned counsel for the petitioner and the<\/p>\n<p>                 opposite party.\n<\/p>\n<p>                          This     is   an   application   for   transfer of   the<\/p>\n<p>                 Matrimonial (Divorce) Case No. 105 of 2009 pending before<\/p>\n<p>                 the Principal Judge, Family Court at Samatipur to the<\/p>\n<p>                 Court of Principal Judge, Family Court at Muzaffarpur.<\/p>\n<p>                          It is submitted on behalf of the petitioner that<\/p>\n<p>                 both the parties are residing at Muzaffarpur, and as such,<\/p>\n<p>                 it would be convenient for both parties to participate in the<\/p>\n<p>                 above proceeding at Muzaffarpur. Besides the above, it is<\/p>\n<p>                 submitted that the petitioner has filed two cases against<\/p>\n<p>                 the opposite party at Muzaffarpur ; one being Kazi<\/p>\n<p>                 Mohammadpur P.S. Case No. 179 of 2009 for the offence<\/p>\n<p>                 under section 498A and other sections of the Indian Penal<\/p>\n<p>                 Code and the other being Maintenance Case No. 110 of<\/p>\n<p>                 2009. It is further submitted that in both the cases the<\/p>\n<p>                 opposite party has appeared and participating in the<\/p>\n<p>                 proceeding.\n<\/p>\n<p>                          As regards the matrimonial case transfer of<\/p>\n<p>                 which has been sought for in this application, it is<\/p>\n<p>                 submitted that the opposite party has concluded the<\/p>\n<p>                 examination of its witnesses and now it&#8217;s the turn for<br \/>\n examination of witnesses on behalf of the petitioner and as<\/p>\n<p>such the balance of convenience lies in favour of the<\/p>\n<p>petitioner for transfer of the aforesaid matrimonial case to<\/p>\n<p>Muzaffarpur.\n<\/p>\n<p>          Learned counsel appearing for the opposite<\/p>\n<p>party, on the other hand, submits that the witnesses of the<\/p>\n<p>opposite party have been examined and discharged after<\/p>\n<p>their cross examination. It is further submitted that the<\/p>\n<p>petitioner is being paid litigation cost of Rs. 500\/- on each<\/p>\n<p>date, and as such, the case may not be transferred as<\/p>\n<p>prayed for.\n<\/p>\n<p>          Considering the submissions of the parties and<\/p>\n<p>their pleadings, the admitted facts are that the petitioner<\/p>\n<p>has filed criminal case and maintenance case against the<\/p>\n<p>opposite party at Muzaffarpur, as noticed above, in which<\/p>\n<p>the opposite party is appearing. The financial hardship is<\/p>\n<p>also not denied, however, submission on behalf of the<\/p>\n<p>opposite party is that the petitioner is being paid litigation<\/p>\n<p>cost of Rs. 500\/- on each date, and as such, financial<\/p>\n<p>hardship should not come into the way. In the matrimonial<\/p>\n<p>case the opposite party has examined its witnesses and<\/p>\n<p>now it is the turn for examination of the witnesses on<\/p>\n<p>behalf of the petitioner.\n<\/p>\n<p>          Considering the convenience and inconvenience<\/p>\n<p>of the parties, this Court is of the opinion that it would be<br \/>\n            convenient for both the parties to take part in the case at<\/p>\n<p>           Muzaffarpur where two other cases as aforesaid are<\/p>\n<p>           pending and being contested by the parties. Besides, the<\/p>\n<p>           opposite party has since already examined its witnesses,<\/p>\n<p>           they are only required to cross examine the witnesses of<\/p>\n<p>           the petitioner, if any, produced in the case.<\/p>\n<p>                     In the above circumstances, in the opinion of the<\/p>\n<p>           Court it is expedient in the interest of justice that the<\/p>\n<p>           aforesaid Matrimonial (Divorce) Case No. 105 of 2009<\/p>\n<p>           pending before the Principal Judge, Family Court at<\/p>\n<p>           Samastipur    be   transferred   to   the   Family   Court   at<\/p>\n<p>           Muzaffarpur. I order accordingly.
