No.335 of 2008\n             ------------------------------------------------\n               Dated this the 4th day of June, 2008\n\n                            JUDGMENT\n<\/pre>\n<p>    This R.S.A is posted to this day for<\/p>\n<p>admission hearing as a last chance as on<\/p>\n<p>26\/05\/08     when        the        matter            came    up for<\/p>\n<p>consideration also counsel for the appellants<\/p>\n<p>was absent and on that day time was prayed for<\/p>\n<p>on his behalf. All the same, today counsel for<\/p>\n<p>the appellants is absent and there is not even<\/p>\n<p>representation on his behalf. The judgment of<\/p>\n<p>the first appellate court in A.S.96\/05 is what<\/p>\n<p>is assailed in this Regular Second Appeal. The<\/p>\n<p>judgment of the first appellate court reads as<\/p>\n<p>follows:-\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;Application (I.A.1092\/05) for condoning<br \/>\n    the delay of 442 days in filing this appeal is<br \/>\n    dismissed. Hence the appeal is not admitted<br \/>\n    holding that it is barred by limitation and same is<br \/>\n    rejected.&#8221;\n<\/p><\/blockquote>\n<blockquote><p><span class=\"hidden_text\">R. S. A. No.335 of 2008           -2-<\/span><\/p>\n<\/blockquote>\n<blockquote><p>              2.      The order on   I.A.1092\/05 is  also<\/p>\n<p>      produced. It is seen that the reasons stated<\/p>\n<p>      for condonation of delay by the appellant was<\/p>\n<p>      that she was laid up with hypertension and<\/p>\n<p>      uterus bleeding and therefore, she could not<\/p>\n<p>      file the appeal in time. There are altogether<\/p>\n<p>      four appellants in A.S.96\/05. Any one of the<\/p>\n<p>      appellants could do the needful for filing the<\/p>\n<p>      appeal in time. The respondent was        vehemently<\/p>\n<p>      opposing the delay condonation application.<\/p>\n<p>      The appellant has tendered evidence as PW1 and<\/p>\n<p>      got marked Exts.A1 to A8. The court below has<\/p>\n<p>      observed         that  Ext.A1  medical   certificate<\/p>\n<p>      showed that one of the appellants therein<\/p>\n<p>      (name not seen mentioned) was advised to take<\/p>\n<p>      rest from 18\/09\/04 to 04\/10\/04 as she was<\/p>\n<p>      suffering from hypertension and that Ext.A2<\/p>\n<p>      showed that she was admitted in hospital on<\/p>\n<p>      06\/05\/05 to 08\/05\/05 in connection with uterus<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.335 of 2008          -3-<\/span><\/p>\n<p>      bleeding. Exts.A3 to A5 scan reports also<\/p>\n<p>      showed that she had uterus bleeding. Those<\/p>\n<p>      certificates         were quite  insufficient to<\/p>\n<p>      substantiate the case of the appellants that<\/p>\n<p>      delay of 442 days occurred for reason of the<\/p>\n<p>      illness. It was in the above circumstances<\/p>\n<p>      that the court below dismissed the application<\/p>\n<p>      for condonation of delay apart from the fact<\/p>\n<p>      that the certificate did cover only about 17<\/p>\n<p>      to 18 days and the delay was of 442 days in<\/p>\n<p>      filing the appeal. The fact also remains that<\/p>\n<p>      illness          of one of the appellants is not<\/p>\n<p>      sufficient to condone the delay when there are<\/p>\n<p>      altogether four appellants in the appeal. The<\/p>\n<p>      first appellate court rightly did not find any<\/p>\n<p>      just and sufficient cause to condone the delay<\/p>\n<p>      and it was consequent on dismissal of the<\/p>\n<p>      delay condonation petition that the appeal was<\/p>\n<p>      also dismissed as barred by limitation. I<\/p>\n<p><span class=\"hidden_text\">R. S. A. No.335 of 2008     -4-<\/span><\/p>\n<p>      cannot but confirm the said finding. There is<\/p>\n<p>      absolutely no substantial question of law for<\/p>\n<p>      consideration in this appeal.
