RADHAKRISHNAN, J.\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n     W.P.(C).Nos.31234\/2008-R &amp; 22799\/2009-T\n\n  = = = = = = = = = = = = = = = = = = = = = = = =\n\n      Dated this the 12th day of August, 2009.\n\n\n\n                     JUDGMENT\n<\/pre>\n<p>1.The latter among the captioned matters has come<\/p>\n<p> up for admission. The former is filed alleging<\/p>\n<p> that the petitioner in the latter matter is<\/p>\n<p> unauthorizedly using a parcel of land as a burial<\/p>\n<p> ground, which piece is a paddy field.<\/p>\n<p>2.Going through the documents exhibited in WP(C).<\/p>\n<p> 31234\/2008, it may be that the land is marshy,<\/p>\n<p> though, not necessarily a piece of paddy field.<\/p>\n<p> The petitioner in WP(C).22799\/2009 also disputes<\/p>\n<p> the veracity of the photographs placed on record<\/p>\n<p> in WP(C).31234\/2008.\n<\/p>\n<\/p>\n<p>3.On 23.10.2008, the following interim order was<\/p>\n<p><span class=\"hidden_text\">WP(C)31234\/08 &amp;22799\/09     -: 2 :-<\/span><\/p>\n<p> issued in WP(C).31234\/2008:\n<\/p>\n<\/p>\n<blockquote><p>          &#8220;Admit. Issue notice by speed post.\n<\/p><\/blockquote>\n<pre>          R1    to    R5  shall    ensure  that  the\n          property     comprised     in  Sy.No.222\/6,\n<\/pre>\n<blockquote><p>          222\/7, 222\/8, 222\/9, 222\/10, 222\/11,<br \/>\n          222\/12, 238\/2 and 282\/2 of Venmony<br \/>\n          village in Chengannur Taluk is not<br \/>\n          used for burial of dead-bodies unless<br \/>\n          permission has been granted in this<br \/>\n          behalf     by   the     District Collector<br \/>\n          under the provisions of the Kerala<br \/>\n          Panchayath (Burning &amp; Burial Grounds)<br \/>\n          Rules,       1998    framed    under   the<br \/>\n          Panchayath Raj Act. Copy of the order<br \/>\n          shall      be    communicated     by   the<br \/>\n          petitioner     to    R1   to  R5  and  the<br \/>\n          contesting respondents.&#8221;\n<\/p><\/blockquote>\n<p>4.WP(C).22799\/2009 is filed seeking a direction to<\/p>\n<p> the    competent      statutory     authorities  to  take<\/p>\n<p> appropriate action on the application for licence<\/p>\n<p> to conduct a burial ground. It needs to be<\/p>\n<p> mentioned      that    such    applications  have  to be<\/p>\n<p> considered and orders issued on a time bound<\/p>\n<p><span class=\"hidden_text\">WP(C)31234\/08 &amp;22799\/09    -: 3 :-<\/span><\/p>\n<p> manner, having regard to the provisions of the<\/p>\n<p> Rules, as they stand as of now.\n<\/p>\n<\/p>\n<p>5.Taking into consideration that the petitioner in<\/p>\n<p> WP(C).22799\/2009 is yet to obtain licence for a<\/p>\n<p> burial ground and because it is shown that no<\/p>\n<p> licence has been obtained in relation to the land<\/p>\n<p> in relation to which WP(C).31234\/2008 is filed,<\/p>\n<p> it is ordered that the official respondents in<\/p>\n<p> WP(C).22799\/2009 will consider the application of<\/p>\n<p> the petitioner therein for licence to conduct the<\/p>\n<p> burial ground as expeditiously as possible and<\/p>\n<p> issue final orders, either way, within the limit<\/p>\n<p> stipulated as per the Rules. The District Medical<\/p>\n<p> Officer      is     hereby    directed  to  place  his<\/p>\n<p> recommendations, either way, within a period of<\/p>\n<p> three weeks from the date of receipt of a copy of<\/p>\n<p> this    judgment.
