SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/04\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tThe<br \/>\npresent Official Liquidator&#8217;s Report has been submitted by the<br \/>\nOfficial Liquidator of M\/s. Kwality Roler &amp; Ball Bearing Pvt.<br \/>\nLtd. (in liquidation) for an appropriate direction on purchaser,<br \/>\nbeing respondent no. 2, to   pay   an    amount of Rs. 10,21,492\/-<br \/>\ntogether with interest thereon at the rate of 15% per annum till<br \/>\nactual realisation to the Official Liquidator towards damage\/loss<br \/>\ncaused by them to the property of the Company due to unauthorised<br \/>\ndismantling and removal of the building structure of the Company,<br \/>\nwhich was not sold to him.\n<\/p>\n<p>2.\tIt<br \/>\nis an admitted position that respondent no. 2 was sold only the<br \/>\nmovables i.e. plant and machinery and the land and building was not<br \/>\nsold to respondent no. 2, still respondent no. 2 has dismantled the<br \/>\nentire property of the Company in liquidation and has removed the<br \/>\nbuilding structure of the Company, which  was not sold to him.  As<br \/>\nper the valuers report, value of  the building structure etc.  other<br \/>\nthan the land was Rs. 10,21,492\/- and, therefore, respondent no. 2 is<br \/>\nliable to compensate\/pay the aforesaid amount of Rs. 10,21,492\/-<br \/>\nalongwith interest and penalty to the Official Liquidator as<br \/>\nrespondent no. 2 has dismantled  and removed the building structure<br \/>\nof the Company in liquidation unauthorisedly.\n<\/p>\n<p>3.\tShri<br \/>\nHarmish Shah, learned advocate appearing on behalf of respondent no.<br \/>\n2 has submitted that even the security agency can also be held liable<br \/>\nfor penalty.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, respondent no. 2 is hereby directed to pay an<br \/>\namount of Rs. 10,60,000\/-,  in all, (inclusive of the amount of<br \/>\ninterest, penalty etc.), for causing damage\/loss to the property to<br \/>\nthe Company and\/or loss to the property of the Company due to<br \/>\nunauthorised dismantling and removal of  the building structure of<br \/>\nCompany, which was not sold to him.  Respondent no. 2 to make the<br \/>\naforesaid payment to the office of the Official Liquidator within<br \/>\nthree weeks from today.\n<\/p>\n<p>5.\tShri<br \/>\nHarmish K. Shah, learned advocate appearing on behalf of respondent<br \/>\nno. 2 has submitted that respondent no. 2 is interested in purchasing<br \/>\nthe land also.\n<\/p>\n<p>6.\tOfficial<br \/>\nLiquidator to get fresh valuation of the land in question within a<br \/>\nperiod of four weeks from today and submit an appropriate report<br \/>\nbefore this Court for fixing upset price  and inviting fresh offers<br \/>\nwith respect to the land in question.
