Singh,J.\n<\/pre>\n<p>Heard learned counsel for the petitioner and learned A. G. A. who has<br \/>\nput in appearance on behalf of the State.\n<\/p>\n<p>At this stage there is no need to issue notice to opposite party No. 2,<br \/>\nhence it is dispensed with.\n<\/p>\n<p>This application under Section 482 Cr.P.C. has been filed for quashing<br \/>\nof the charge sheet no. 47 of 2009, dated 20.06.2009, filed in Case<br \/>\nCrime No. 239 of 2009, under Sections 498-A, 323, 506 I.P.C. and<br \/>\nSection 3\/4 D.P.Act Police Station Dhammaur, District Sultanpur,<br \/>\npending in the Court of Judicial Magistrate Court No. 38, Sultanpur as<br \/>\nCriminal Case No. 4386 of 2009 and the order issuing bailable<br \/>\nwarrant against the petitioner.\n<\/p>\n<p>The allegations are factual in nature and at this stage, there does not<br \/>\nappear to be any good ground for quashing of the charge sheet, which<br \/>\nhas been filed on the basis of the accusations made in the F.I.R.,<br \/>\nstatement recorded under Section 161 Cr.P.C. and the material collected<br \/>\nduring the investigation.\n<\/p>\n<p>It is contended on behalf of the applicant\/petitioner that the offences<br \/>\nare no so grave and it is the outcome of the normal wear and tear of<br \/>\nmarried life. It is also submitted taht the offences are triable by<br \/>\nmagistrate. Nevertheless, the applicant being law abiding citizen intends<br \/>\nto appear before the court below to obtain the bail.<br \/>\nWithout entering into the merit of the case, in view of the fact that the<br \/>\napplicant\/petitioner being a law abiding citizen intends to appear before<br \/>\nthe court below, it is hereby directed that if the applicant appears before<br \/>\nthe court below and applies for bail within four weeks from today, the<br \/>\ncourt(s) below shall dispose of the application expeditiously preferably<br \/>\non the same day, if possible, in accordance with the observations made<br \/>\nin the case of Smt. Amrawati and another Vs. State of U.P. 2004 CBC<br \/>\npage 705. Thereafter, the trial court may permit the applicant to appear<br \/>\nthrough counsel and raise his objection, if any, against the initiation of<br \/>\ntrial proceedings against him at the stage of framing of charges. This<br \/>\nrelief is being granted up to the stage of framing of charges only<br \/>\nprovided the applicant after securing bail (1) furnish an undertaking to<br \/>\nthe satisfaction of the trial court that his counsel will remain present on<br \/>\nhis behalf and will represent him on each and every date, (2) he will not<br \/>\nraise any objection as to the actual presence of the person who is facing<br \/>\n trial, (3) an undertaking will also be given to the effect that he will be<br \/>\npresent before the court whenever called upon to do so at any stage.<br \/>\nThese directions are being accorded in the light of the observations<br \/>\nmade by Hon&#8217;ble Apex Court in the case of M\/s Bhaskar Industries<br \/>\nLtd. Vs.
