NO.3578 OF 2008\n\n      Dated, this the 7th day of November,2008\n\n                         ORDER\n<\/pre>\n<p>    Petitioner is the accused and first respondent<\/p>\n<p>the  complainant  in   S.T.297\/2006on       the  file  of<\/p>\n<p>Judicial       First            Class         Magistrate,<\/p>\n<p>Thiruvananthapuram.   Case of the first respondent<\/p>\n<p>was  that  petitioner      borrowed      Rs.75,000\/- and<\/p>\n<p>towards its repayment issued Ext.P1 cheque dated<\/p>\n<p>6.8.2003  drawn  in  his     account       maintained in<\/p>\n<p>Vazhuthacaud  Branch of State Bank of Travancore<\/p>\n<p>and when the cheque was presented, under Ext.P2 it<\/p>\n<p>was  dishonoured  and    inspite      of  Ext.P3  notice,<\/p>\n<p>served on the petitioner under Ext.P5,demanding the<\/p>\n<p>amount covered by the dishonoured cheque it was not<\/p>\n<p>paid and petitioner thereby committed the offence<\/p>\n<p>under section 138 of Negotiable Instruments Act.<\/p>\n<p>Petitioner pleaded not guilty.           First respondent<\/p>\n<p>was examined as PW1 and Exts.P1 to P6 were marked.<\/p>\n<p>Petitioner  did  not    adduce      evidence.     Learned<\/p>\n<p><span class=\"hidden_text\">CRRP 3578\/2008              2<\/span><\/p>\n<p>Magistrate on the evidence found him guilty and<\/p>\n<p>convicted and sentenced to simple imprisonment for<\/p>\n<p>six months and a fine of Rs.75,000\/- and in default<\/p>\n<p>simple imprisonment for three months.       Petitioner<\/p>\n<p>challenged the conviction before      Sessions Court,<\/p>\n<p>Thiruvananthapuram     in  Crl.A.168\/2007.     Learned<\/p>\n<p>Sessions      Judge  on  reappreciation  of   evidence<\/p>\n<p>confirmed the conviction but modified the sentence<\/p>\n<p>to imprisonment till rising of    court and a fine of<\/p>\n<p>Rs.75,000\/- and in default simple imprisonment for<\/p>\n<p>three months.       On realization of   fine, it was<\/p>\n<p>directed      to  be  paid  to  first  respondent   as<\/p>\n<p>compensation. Conviction and sentence is challenged<\/p>\n<p>in this revision.\n<\/p>\n<p>     2. Learned counsel appearing for petitioner was<\/p>\n<p>heard.\n<\/p>\n<p>     3.    The argument of the learned counsel is that<\/p>\n<p>courts     below  did  not  properly  appreciate   the<\/p>\n<p>evidence and relying on the solitary evidence of<\/p>\n<p>PW1, petitioner should not have been convicted.     It<\/p>\n<p>is   also    submitted  that if  the  conviction   and<\/p>\n<p><span class=\"hidden_text\">CRRP 3578\/2008              3<\/span><\/p>\n<p>sentence is to be confirmed        petitioner may be<\/p>\n<p>granted time to pay the fine.\n<\/p>\n<p>     4.      Learned Magistrate and learned Sessions<\/p>\n<p>Judge considered the evidence of PW1 in the light<\/p>\n<p>of the defence taken.      What was contended by the<\/p>\n<p>petitioner was that Ext.P1 cheque was issued as a<\/p>\n<p>blank     cheque   and  that   too  as   security  of<\/p>\n<p>Rs.15,000\/- borrowed from Vijayan by the husband of<\/p>\n<p>the petitioner and it was not issued to first<\/p>\n<p>respondent towards      repayment of the loan.      On<\/p>\n<p>going through the judgments of the courts below<\/p>\n<p>apart from the suggestion that Ext.P1 cheque was<\/p>\n<p>issued as a blank cheque and that too to one<\/p>\n<p>Vijayan, from whom        husband of the petitioner<\/p>\n<p>borrowed the amount, no evidence was adduced.      The<\/p>\n<p>evidence of PW1 establishes that Ext.P1 cheque was<\/p>\n<p>issued towards      repayment of Rs.75,000\/- borrowed<\/p>\n<p>by the petitioner.     In such circumstance, I find no<\/p>\n<p>reason to interfere with the factual findings of<\/p>\n<p>the courts below that        Ext.P1 cheque was issued<\/p>\n<p>towards        repayment  of   the  amount   borrowed.<\/p>\n<p><span class=\"hidden_text\">CRRP 3578\/2008              4<\/span><\/p>\n<p>Evidence      establish  that   Ext.P1   cheque   was<\/p>\n<p>dishonoured for want of sufficient funds.       It is<\/p>\n<p>also proved that first respondent       complied with<\/p>\n<p>all    the    statutory  formalities  provided  under<\/p>\n<p>section 138 and 142 of Negotiable Instruments Act.<\/p>\n<p>Conviction of the petitioner for the offence under<\/p>\n<p>section 138 is perfectly legal.\n<\/p>\n<p>     5.     Then the only question is with regard to<\/p>\n<p>the sentence.     Learned Sessions Judge modified the<\/p>\n<p>sentence to imprisonment till rising of the court,<\/p>\n<p>in addition to fine which was only for the amount<\/p>\n<p>covered     by  the  dishonoured  cheque.    In  such<\/p>\n<p>circumstance, no interference is warranted in the<\/p>\n<p>sentence also.
