The present petition has been preferred mainly for getting pay-<br \/>\nscale of the post of Administrative Officer, which is promotional post, as<br \/>\nper the allegation levelled by the present petitioner.\n<\/p>\n<p>2.    It is vehemently submitted by counsel for the petitioner that the<br \/>\npetitioner was initially appointed as Circle Assistant thereafter, he was<br \/>\nappointed on the post of Administrative Officer dated 17th January, 1986<br \/>\n(Annexure-1 to the memo of the present petition) thereafter, he was<br \/>\nworking, since then on the said post Respondents are not paying the<br \/>\npay-scale of the post of Administrative Officer which is 1000-1820 and<br \/>\ntherefore, the present petition is instituted. Counsel for the petitioner<br \/>\nalso relied upon the decision taken by the committee dated 23rd of<br \/>\nMarch, 1988, which is Annexure-14 to the memo of the petition whereby<br \/>\nas per the paragraph-5 thereof it is submitted that the petitioner is<br \/>\nconfirmed on the post of Administrative Officer and therefore, the<br \/>\nrespondent has to pay, a pay-scale of the promotional post of<br \/>\nAdministrative Officer. Counsel for the petitioner has also taken this<br \/>\nCourt to Annexure-17 of the memo of the present petition and submitted<br \/>\nthat initially petitioner had filed a petition bearing C. W. J. C. No. 5983 of<br \/>\n2000 before the Patna High Court and ultimately the petition was<br \/>\ndisposed of with liberty to raise the claim before this Court and,<br \/>\ntherefore, present petition has been instituted.\n<\/p>\n<p>3.    I have heard counsel for the respondents who submitted in the<br \/>\ncounter affidavit filed that petitioner was never appointed on the post of<br \/>\nAdministrative Officer even as per the Annexure-1 to the memo of the<br \/>\npresent petition. Petitioner was appointed as Office Superintendent and<br \/>\nnot on the post of Administrative Officer and these two posts i.e.<br \/>\nAdministrative Officer and Office Superintendent are two distinct and<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>different posts and their pay-scales are also different and distinct.<br \/>\nPetitioner was working as Circle Assistant, thereafter, as per order dated<br \/>\n25th of June, 1986(Annexure-1), petitioner was given temporarily<br \/>\npromotion on      the post    of       Office   Superintendent as post   of<br \/>\nAdministrative Officer was vacant, but, never the post of Administrative<br \/>\nOfficer was given to the present petitioner and, therefore, there is no<br \/>\nquestion to give any pay-scale of the promotional post of Administrative<br \/>\nOfficer to the petitioner and, therefore, petitioner is not entitled for the<br \/>\npay-scale of post of Administrative Officer. Counsel for the respondents<br \/>\nalso submitted that vide order at Annexure-14 to the memo of the<br \/>\npresent petition the petitioner was never confirmed by the committee on<br \/>\nthe post of Administrative Officer. On the contrary, looking to the<br \/>\nAnnexure-14, last two lines of paragraph-5 thereof, a decision was to be<br \/>\ntaken by bureau of enterprise, for the promotion on the post of<br \/>\nAdministrative Officer. Thus, the petitioner was never promoted on post<br \/>\nof Administrative Officer and much less he was confirmed on the post of<br \/>\nAdministrative Officer and, therefore, petitioner is not entitle for pay<br \/>\nscale for the post of Administrative Officer.\n<\/p>\n<p>4.    Having heard the counsel for the both sides and looking to the<br \/>\nfacts and circumstances of the case, I see no reason to entertain this writ<br \/>\npetition, mainly, for the following facts and reasons:\n<\/p>\n<blockquote><p>       (i)          It appears that the petitioner was initially appointed<br \/>\n             as Circle Assistant. By order at Annexure-1, to the memo of<br \/>\n             the present petition, dated 25.06.1986, the petitioner was<br \/>\n             promoted on the post of Office Superintendent. It appears<br \/>\n             that because of one word used as Administrative Officer<br \/>\n             the whole confusion created in the mind of the petitioner.<br \/>\n             Infact vide order at Annexure-1 to the memo of the present<br \/>\n             petition, the respondent stated that, as the post of<br \/>\n             Administrative Officer was vacant, the petitioner was<br \/>\n             temporarily promoted to the post of Office Superintendent<br \/>\n             on the pay scale of 850-30-1270-1360. It is as simple and as<br \/>\n             plain as this: As, post &#8220;A&#8221; (Administrative Officer) was<br \/>\n             vacant, petitioner was appointed on post &#8220;B&#8221; (Office<br \/>\n             Superintendent having pay-scale of 850-30-1270-1360).<br \/>\n             Thus, never, vide Annexure -1 to the memo of the present<br \/>\n             petition, the higher post of Administrator Officer was not<br \/>\n             given to the present petitioner. Counsel for the respondent<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>        submitted that the pay-scale for Administrative Officer is<br \/>\n        1000-1820. Thus, the post of Administrative Officer, is<br \/>\n        further higher Post, to the Office Superintendent post,<br \/>\n        looking to the higher pay scale.\n<\/p><\/blockquote>\n<p>(ii)          Thus, the petitioner was never appointed on the post<br \/>\n        of Administrative Officer as per order at Annexure-1. This<br \/>\n        is further fortified by perusing Annexure-14 which is a<br \/>\n        decision taken by the committee dated 23rd March 1988. It<br \/>\n        has been mentioned, specifically in paragraph-5, thereof,<br \/>\n        that the petitioner was appointed on the post of Office<br \/>\n        Superintendent, but, not on the post of Administrative<br \/>\n        Officer. On the contrary, looking to the last two line of<br \/>\n        paragraph-5, of Annexure-14, it appears that decision for<br \/>\n        promotion on the post of Administrative Officer, will be<br \/>\n        taken by the Bureau Enterprises. Thus, if the petitioner<br \/>\n        would have been promoted, exactly on the post of<br \/>\n        Administrative Officer, there would have been no<br \/>\n        necessity, of the last two line of paragraph-5 in Annexure-\n<\/p>\n<p>        14.\n<\/p>\n<p>(iii)         It appears that the petitioner, now, reverted to the<br \/>\n        post of Circle Assistant, because he was temporarily on the<br \/>\n        post of Office Superintendent. Now petitioner has retired<br \/>\n        on February, 2007. Thus, never the petitioner was<br \/>\n        appointed, on the post of Administrative Officer, which is<br \/>\n        much higher post, even above then the post of Office<br \/>\n        Superintendent. Vide order at Annexure-1 to the memo of<br \/>\n        the present petition, petitioner was temporarily promoted<br \/>\n        on the post of Office Superintendent, which is also<br \/>\n        withdrawn, subsequently and, therefore, a writ petition<br \/>\n        bearing W. P. S. No. 6537 of 2007 was already instituted<br \/>\n        and pending before this Court, but, that matter involves a<br \/>\n        question only of withdrawal of the temporarily promotion<br \/>\n        of the present petitioner from the post of Circle Assistant to<br \/>\n        Office Superintendent. This dispute (viz. withdrawal of<br \/>\n        temporarily promotion) has nothing to do with the post of<br \/>\n        Administrative Officer. Therefore, contention of learned<br \/>\n        counsel for the petitioner that aforesaid may also be heard<br \/>\n        with this matter is not accepted by this Court as issues<br \/>\n<span class=\"hidden_text\">                                       4<\/span><\/p>\n<p>                  involved in that matter and in present writ petition, are<br \/>\n                  different and distinct.\n<\/p>\n<p>           (iv)         Thus, the petitioner was never appointed on the post<br \/>\n                  of Administrative Officer and therefore, there is no<br \/>\n                  question of granting any pay-scale to the petitioner for that<br \/>\n                  post, whatever arises.\n<\/p>\n<p>5.         As a cumulative effect of the aforesaid facts and reasons, there is<br \/>\nno substance, in this petition, hence, the same is hereby dismissed.\n<\/p>\n<p>6.         I. A. No. 1056 of 2009 stands disposed of in view of the final<br \/>\ndisposal of writ petition.\n<\/p>\n<p>                                                           (D. N. Patel.
