A.P.P. waives service<br \/>\n      on behalf of the respondent no.1. Mr. R.J.Oza waives<br \/>\n      service of rule on behalf of the respondent no.2. At the<br \/>\n      request of the learned Advocates for the parties, this<br \/>\n      Revision is heard today.\n<\/p>\n<p>      With the consent of the respondent no.2,<br \/>\n      the following order is passed:\n<\/p>\n<p>      The    respondent   no.2    will    have no<br \/>\n      objection if the Revision Application filed by the<br \/>\n      petitoner before the learned Sessions Judge, Bhavnagar is<br \/>\n      decided on merits provided the petitioner is directed to<br \/>\n      deposit the entire arrears of maintenance amount granted<br \/>\n      by the trial Court and the petitioner is further directed<br \/>\n      to go on paying the amount of maintenance at the rate<br \/>\n      Rs.300\/- per month as directed by the trial Court.        On<br \/>\n      behalf    of the petitioner, it was stated that the<br \/>\n      petitioner will have no objection provided the Revision<br \/>\n      Application is    heard    on    merits.    Considering the<br \/>\n      aforesaid statements made on behalf of the petitioner and<br \/>\n      the respondent no.1, it is directed that the impugned<br \/>\n      order passed below Misc.Criminal Application no.128 of<br \/>\n      1992 not condoning the delay is set aside.      The learned<br \/>\n      Sessions Judge, Bhavnagar, shall hear the main Revision<br \/>\n      Application on merits after hearing the parties.        Till<br \/>\n      the said application is decided, the petitioner shall pay<br \/>\n      the amount of Rs.       300\/- granted by the trial Court to<br \/>\n the respondent no.2 every month regularly and will also<br \/>\ndeposit the arrears till date before the trial Court. As<br \/>\nand when the amount is deposited, the respondent no.2<br \/>\nshall withdraw the same. The arrears to be deposited<br \/>\nwithin four weeks from today. In view of the directions<br \/>\ngiven above, this Revision is allowed.
