The<br \/>\nworkmen were continued so long as there was work and they were served<br \/>\nwith notice on 29th September 1987 wherein it was stated<br \/>\nthat as there was not enough work with the Department they were to be<br \/>\nrelieved from 31st October 1987 and were relieved in<br \/>\naccordance with the seniority of such daily wagers and  were also<br \/>\ninstructed to collect retrenchment compensation, notice pay, etc. on<br \/>\n7th November 1987 from the office of the petitioner.<br \/>\nAccording to the petitioner the respondent workmen did not accept the<br \/>\nnotice and refused to receive compensation. They thereafter raised a<br \/>\ndispute which was referred to Labour Court and numbered as Reference<br \/>\n(LCR) Nos.605 to 608 of 1988. On formation of Labour Court at<br \/>\nJunagadh the said cases were transferred to  Junagadh Court where<br \/>\nthey were registered as Reference (LCJ) Nos.1067 to 1070 of 1990.<br \/>\nAfter adjudicating the matter the Labour Court  allowed the<br \/>\nReferences and  ordered the petitioner to reinstate the workmen in<br \/>\nservice with 70% back wages. It is against said award that the<br \/>\npresent petition has been passed.\n<\/p>\n<p>3.\tLearned<br \/>\nAdvocate for the petitioner submitted that the respondents were daily<br \/>\nwagers and therefore they were not entitled invoke the provisions of<br \/>\nIndustrial Disputes Act and that disengagement of daily wagers cannot<br \/>\nbe termed as retrenchment and therefore there was no question of<br \/>\ncompliance of section 25F of the Act.\n<\/p>\n<p>4.\tAccording<br \/>\nto him, even if the Act applies, there was substantial compliance of<br \/>\nsection 25F as they were given notice and offered retrenchment<br \/>\ncompensation. He further submitted that even if it is termed as<br \/>\nretrenchment, the respondent workmen failed to prove  that they had<br \/>\ncompleted 240 days prior to their termination. He lastly submitted<br \/>\nthat in any case the respondent workmen should not have been<br \/>\nreinstated as there was prohibition imposed by State Government on<br \/>\nemployment of daily wagers. He lastly submitted that  there was no<br \/>\njustification for grant of back wages.\n<\/p>\n<p>5.\tLearned<br \/>\nAdvocate for the respondents submitted that  the Labour Court has<br \/>\nconsidered all the aspects of the matter and the petitioner has not<br \/>\npointed out any  reason to set aside the same.\n<\/p>\n<p>6.\tAs<br \/>\na result of hearing and perusal of the record certain aspects are not<br \/>\ndisputed. The respondent workmen were working under the petitioner.<br \/>\nThe petitioner has issued a notice to them and they were also offered<br \/>\nretrenchment compensation. This action on the part of the petitioner<br \/>\nitself shows that the respondent workmen had completed 240 days and<br \/>\nthere is no substance in the contention that they were daily wagers<br \/>\nand they were not entitled to resort to the provisions of Industrial<br \/>\nDisputes Act. There is a clear finding of the Labour Court that there<br \/>\nis violation of provisions of section 25-F of the Act. Learned<br \/>\nAdvocate for the petitioner is not able to controvert the findings of<br \/>\nthe  Labour Court in this regard on any count. Once the finding is<br \/>\nthat there is violation of provisions of 25F of the Act, it is not<br \/>\nopen to the petitioner to contend that there is prohibition by the<br \/>\nState Government on employment of daily wagers, especially the<br \/>\npetitioner is a Panchayat  which is a government establishment.\n<\/p>\n<p>7.\tHowever,<br \/>\nthere is substance in the contention that the Labour Court ought not<br \/>\nto have granted back wages. There was no plea nor evidence or proof<br \/>\nto show that from the alleged date of dismissal of their service till<br \/>\nthe date of the award the respondents were not in gainful employment.<br \/>\n In any case in many cases the Apex Court held that when the workman<br \/>\nactually did not work on the post, back wages should not normally be<br \/>\ngranted. I am therefore of the view that the Labour Court was not<br \/>\njustified in granting back wages to the respondents.\n<\/p>\n<p>8.\tIn<br \/>\nthe premises aforesaid, the judgement and award impugned herein is<br \/>\nquashed and set aside qua back wags. The rest of the award is<br \/>\nconfirmed. \tThe respondents shall be given benefits from the date of<br \/>\nreference i.e. 29th February 1988. The petitioner may also<br \/>\nconsider the case of respondents sympathetically as and when<br \/>\npermanent vacancy arises.
