Having considered the facts and circumstances of the case,<br \/>\nthe petitioner can approach by way of leave to appeal before the<br \/>\nTribunal. If the same is not considered by the Tribunal, it will be<br \/>\nopen for the petitioner to file appropriate proceedings. At this<br \/>\nstage, it will not be appropriate to entertain this petition. The<br \/>\npetitioner may, therefore,  approach by way of leave to appeal since<br \/>\nhe was not party in the original  proceedings.
