Agarwal.\n\n   Dated:20\/07\/2010\n\n:   Judgment\n\n\nWrit Petition under Article 226 of the Constitution of India\n\n\n                         ORAL ORDER\n             (Passed on 20th day of July, 2010)\n\n\n       Per I.M. Quddusi, J.\n<\/pre>\n<p>       Heard.\n<\/p>\n<p>  1.   The petitioner, which is a partnership firm, submitted<\/p>\n<p>       his tender for the work &#8220;Augmentation of SCRAP&#8221; for melting<\/p>\n<p>       in SMS-I &amp; SMS-II from different departments of their plaint<\/p>\n<p>       at Bhilai along with Rs. 1,50,000\/- as earnest money. In the<\/p>\n<p>       tender documents, eligibility criteria was given as under:\n<\/p>\n<p>          &#8220;3.0  Eligibility Criteria: Parties  shall  submit<br \/>\n          the    notarized    copy    of    the    following<br \/>\n          documents\/certificates\/proofs   along   with   the<br \/>\n          Techno-commercial bid:\n<\/p>\n<p>          I.   Proof of CPF registration by RPFC.\n<\/p>\n<p>          II.  Undertaking   to   deploy   minimum   of   19<br \/>\n               Trucks\/Trailers         (minimum          two<br \/>\n               trailers\/torrus), 5 Dumpers\/Tippers, 1 mobile<br \/>\n               magnetic  crane  and  2  fowlers  for   scrap<br \/>\n               augmentation work, out of which at least  50%<br \/>\n               of vehicles i.e. minimum 9 trucks\/trailers, 3<br \/>\n               dumpers\/tippers will be registered on parties<br \/>\n               name  &amp; should not be more than 10 years old.<br \/>\n               We  understand that the carrying capacity  of<br \/>\n               vehicles will be 10-16 Tones for Trucks,  12-<br \/>\n               18  Tones  for Dumpers\/Tippers &amp; 24-30  Tones<br \/>\n               for   Trailers\/Torrus.  Even  if  the   party<br \/>\n               deploys higher capacity vehicles, he is bound<br \/>\n               to  deploy minimum required vehicles.   Party<br \/>\n               shall  submit  notarized copies  of  relevant<br \/>\n               document for the same.\n<\/p>\n<p>          III. Average annual financial turnover during the last 3<br \/>\n               years, ending 31st March, 2006, should be at least Rs. 80<br \/>\n               Lakhs.  In support of this, Notarized Audited Balance Sheet<br \/>\n               and profit &amp; loss account of last three years should be<br \/>\n               enclosed.\n<\/p>\n<p>                              XXX            XXX<\/p>\n<p>          V.   The party must submit an undertaking as per enclosed<br \/>\n               Annexure-`X&#8217;.\n<\/p>\n<p>               The  parties,  registered with  BSP  for  job<br \/>\n               contracts  must  have valid  registration  in<br \/>\n               discipline &#8220;Loading\/transportation  (09)&#8221;  OR<br \/>\n               &#8220;scrap processing, cutting and handling (10)&#8221;<br \/>\n               having &#8220;Class-A&#8221;. Registered parties shall be<br \/>\n               exempted from submission of documentary proof<br \/>\n               detailed   at   (I),  (III)  &amp;  (IV)   above.\n<\/p>\n<p>               However,  registered parties  shall  have  to<br \/>\n               make compliance to point-(II) &amp; (V).&#8221;\n<\/p>\n<p>  2.   But the petitioner did not submit the required document<\/p>\n<p>       with its tender papers. Consequently, a letter was sent to<\/p>\n<p>       the petitioner on 20.10.2006 inter alia requesting him to<\/p>\n<p>       submit Annexure-X along with the offer and also to submit<\/p>\n<p>       Audited Balance Sheet and profit &amp; loss account for last<\/p>\n<p>       three years.  Annexure-X was the undertaking that they shall<\/p>\n<p>       deploy 64 nos. of HSL trust CPF labour for the stipulated<\/p>\n<p>       period of contract.  When the petitioner did not supply the<\/p>\n<p>       above required documents, his financial bid was not opened.\n<\/p>\n<p>       However, the respondent has forfeited his EMD amount of Rs.\n<\/p>\n<p>       1,50,000\/- vide impugned order dated 09.01.2007 (Annexure<\/p>\n<p>       P\/2) under clause 1.16 of the Special Conditions.\n<\/p>\n<p>  3.   Before  proceeding  further with the  matter,  it  is<\/p>\n<p>       necessary to re-produce clause 1.16 of Special Conditions,<\/p>\n<p>       which reads as under :\n<\/p>\n<blockquote><p>               &#8220;1.16.   Failure to produce the Original<br \/>\n               Certificate  in support of the  attested<br \/>\n               copies  of  relevant documents submitted<br \/>\n               earlier  before the award  of  contract,<br \/>\n               would  result  in  disqualification  and<br \/>\n               forfeiture  of EMD and also  liable  for<br \/>\n               debarring  from  participation  in   BSP<br \/>\n               tenders.&#8221;\n<\/p><\/blockquote>\n<p>  4.   In the instant case, the petitioner did not submit the<\/p>\n<p>       required documents, and when he did not submit the same even<\/p>\n<p>       on sending a letter on 20.10.2006, his financial bid was not<\/p>\n<p>       open and therefore, to our opinion, he was not eligible in<\/p>\n<p>       the absence of non submission of the required material with<\/p>\n<p>       the tender papers.\n<\/p>\n<p>5.   Clause 1.16 of Special Conditions as re-produced above<br \/>\nshows that forfeiture of EMD was only applicable if the<br \/>\ntenderer fails to produce the original certificates of which<br \/>\nattested copies of the relevant documents were submitted<br \/>\nearlier along with tender papers, meaning thereby, that if<br \/>\nthe participant submits the attested copies of the original<br \/>\ncertificates along with tender papers and later on he does<br \/>\nnot submit the original certificates to verify the same, the<br \/>\nsame would result in disqualification and forfeiture of EMD<br \/>\nand also liable for debarring from participation in BSP<br \/>\ntenders.  But in the instant case, the petitioner did not<br \/>\nsubmit the required documents with the tender papers and<br \/>\nhence clause 1.16 of Special Conditions would not be<br \/>\napplicable in the present case.\n<\/p>\n<p>6.   Learned counsel appearing for the respondent raised an<br \/>\nobjection regarding maintainability of the writ petition and<br \/>\nin this regard reliance has been placed upon the judgment of<br \/>\nSupreme Court in case of <a href=\"\/doc\/191872\/\">National Highway Authority of India<br \/>\nv. M\/s Ganga Enterprises and<\/a> another1 in which the Supreme<br \/>\nCourt held with the facts that, in terms of the tender<br \/>\ndocument the respondent gave his bid or offer which was in<br \/>\ntwo parts.  The first part being an offer that the bid would<br \/>\nnot be withdrawn during the bid validity period and\/or that<br \/>\non acceptance the performance security would be furnished<br \/>\nand the agreement signed.  The second part of the offer<br \/>\ndealt with the terms and conditions pertaining to the<br \/>\nperformance of the contract of collection of tolls, if the<br \/>\noffer was accepted.\n<\/p>\n<p>7.   The facts as mentioned in that case, the admitted<br \/>\nposition was that 120 days of the validity period of the<br \/>\ntender would have come to an end on 28th November, 1997. In<br \/>\nAugust the technical bids were opened. In September the<br \/>\nfinancial bids were opened, wherein it was found that the<br \/>\nrespondent was the highest bidder. On 20th November, 1997<br \/>\nthe respondent withdrew his bid.\n<\/p>\n<p>8.   Therefore, the facts of that case are that both the<br \/>\ntechnical and financial bids of the respondent were opened<br \/>\nand he was found to be the highest bidder and it was the<br \/>\ncondition that he would not withdraw the bid during the bid<br \/>\nvalidity period, but he withdrew his bid on 20th<br \/>\nNovember,1997 i.e. before the expiry of 120 days.\n<\/p>\n<p>9.   But, in the facts and circumstances of the present<br \/>\ncase, which is quite different to the above case, the<br \/>\npetitioner did not submit the required documents as<br \/>\nmentioned in clause II, III &amp; V of Special Conditions No. 3<br \/>\nwith his tender papers and despite opportunity afforded to<br \/>\nhim, he did not submit the same and hence he was not<br \/>\neligible to participate in the tender as his tender itself<br \/>\nwas defective and not supported with relevant documents, his<br \/>\nfinancial bid was not open, therefore, clause 1.16 of the<br \/>\nSpecial Conditions was not at all applicable under which the<br \/>\nEMD amount could be forfeited.\n<\/p>\n<p>10.  For the reasons mentioned hereinabove, we are of the<br \/>\nopinion that the forfeiture of the EMD amount is without any<br \/>\nbasis and also not inconsonance with the tender conditions.\n<\/p>\n<p>11.  In view of above discussions, we allow this writ<br \/>\npetition.  Accordingly, the impugned order dated 09.01.2007,<br \/>\nforfeiting the EMD amount is hereby quashed.  The<br \/>\nrespondents are directed to refund the EMD amount i.e. Rs.<br \/>\n1,50,000\/- to the petitioner within a period of three months<br \/>\nfrom the date of receipt of a copy of this order.
