Justice THOTTATHIL B.RADHAKRISHNAN\n\n Dated :14\/08\/2007\n\n O R D E R\n            THOTTATHIL B.RADHAKRISHNAN, J.\n                  -------------------------------------------\n                    W.P(C).No.18790 OF 2006\n                  -------------------------------------------\n             Dated this the 14th day of August, 2007\n\n\n                              JUDGMENT\n<\/pre>\n<p>      Having heard learned counsel for the petitioner and the<\/p>\n<p>counsel for the contesting respondents, as also the standing<\/p>\n<p>counsel for the second respondent, this writ petition is allowed<\/p>\n<p>partly, quashing Ext.P9, which has been issued without<\/p>\n<p>adequate opportunity of being heard. Following this, the first<\/p>\n<p>respondent, District Labour Officer, will provide the petitioner<\/p>\n<p>an opportunity to cross examine the witnesses and place such<\/p>\n<p>further materials as he may deem fit. Such opportunity shall not<\/p>\n<p>extend to indefinitely drag on the proceedings since such<\/p>\n<p>proceedings under the statute are required to be finalised<\/p>\n<p>without delay.
