Respondents in\n                              the above Writ Petitions\n\n\tWrit Petitions filed under Article 226 of the Constitution of India\npraying to issue a Writ of   Mandamus to forbear the respondents from evicting\nthe petitioner from his house in Survey No.328\/1A, 1B in S.P.K.Road, Minnagar\nChinnamanoor, Theni District without following process of law and without\nproviding opportunity to the petitioners.\n\n!For Petitioners          ... Mr.D.Anbarasu\n^\t\n\n:ORDER\n<\/pre>\n<p>(Order of the Court was made by P.JYOTHIMANI, J)<br \/>\n\tEarlier, a Writ Petition was filed in W.P.(MD)No.5199 of 2010 against the<br \/>\nnotice issued on 10.4.2010 by the second respondent, which came to be dismissed<br \/>\nby a Division Bench of this Court on 23.4.2010 categorically holding that if the<br \/>\nproperty is situated in the Highways, there is no impediment for the necessary<br \/>\nproceedings to be initiated for removal of the encroachment.\n<\/p>\n<p>\t2. Further, learned counsel for the petitioners would submit that<br \/>\nproceedings issued on 10.4.2010 have been dropped and another notice has been<br \/>\nissued.\n<\/p>\n<p>\t3. Admittedly, such notice is not received.  At this stage, the relief<br \/>\ncannot be granted. When such notice is received, it is for the petitioners to<br \/>\nwork out their remedy in the manner known to law.\n<\/p>\n<p>\t4. With the above observation, the Writ Petitions are dismissed. Connected<br \/>\nMiscellaneous Petitions are closed.
