Justice V.GIRI\n\n Dated :16\/10\/2009\n\n O R D E R\n                           V.GIRI, J\n                         -------------------\n                      W.P.(C).28416\/2009\n                         --------------------\n            Dated this the 16th day of October, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>     Heard learned counsel for the petitioner Mr.M.R.Rajesh<\/p>\n<p>and Mr.M.Ajay learned Standing Counsel for respondents 2, 3,<\/p>\n<p>4 and 6.\n<\/p>\n<\/p>\n<p>2.   Petitioner, who is employed as a binder under the 2nd<\/p>\n<p>respondent, was suspended pursuant to a complaint filed by the<\/p>\n<p>5th respondent raising several allegations including certain<\/p>\n<p>allegations of sexual harassment. The complaint was referred<\/p>\n<p>to a Committee, in terms of the dictum of the Supreme Court in<\/p>\n<p><a href=\"\/doc\/1031794\/\">Vishaka v. State of Rajasthan<\/a> (1997 (6) SCC 241).            It is<\/p>\n<p>now admitted that an enquiry by the said Committee has been<\/p>\n<p>completed and they have recommended for the registration of a<\/p>\n<p>crime against the petitioner and a complaint has been<\/p>\n<p>forwarded. They also recommended disciplinary proceedings.<\/p>\n<p>But such disciplinary proceedings has not been initiated so far.<\/p>\n<p>3.   In the meanwhile, it is alleged that the petitioner while<\/p>\n<p>under suspension, on 18.8.2009 had banged into the IPP press<\/p>\n<p>and had assaulted Mr.Manoj Kumar, the 8th respondent.<\/p>\n<p>W.P.(C).28416\/09<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>Pursuant thereto, Ext.P28 show cause notice was issued. But<\/p>\n<p>show cause notice has been issued requiring him to show cause<\/p>\n<p>why his service should not be terminated.        Petitioner   has<\/p>\n<p>submitted Ext.P30 objections refuting the allegations alleged in<\/p>\n<p>Ext.P28 and also seeking a reinstatement in service.<\/p>\n<p>4.    On instructions, learned counsel for respondents 2, 3, 4<\/p>\n<p>and 6 submits that Ext.P28 is only        a show cause notice.<\/p>\n<p>Petitioner&#8217;s explanation to Ext.P28 as Ext.P30 would be<\/p>\n<p>considered and if the explanation is not found to be satisfactory,<\/p>\n<p>then, a full fledged enquiry would be conducted and a<\/p>\n<p>punishment in the nature of termination of the service, which is<\/p>\n<p>a major punishment, would obviously be contemplated only<\/p>\n<p>after such enquiry. Submission is recorded.<\/p>\n<p>5.    Learned counsel for the petitioner submits that since the<\/p>\n<p>enquiry by the Committee constituted in terms of the directions<\/p>\n<p>in Vishaka has been completed, it is not justified to continue to<\/p>\n<p>place the petitioner under suspension. Learned counsel for the<\/p>\n<p>2nd respondent submits that the question of continuing the<\/p>\n<p>petitioner under suspension will be considered in the light of<\/p>\n<p>the allegations contained in Ext.P28 also.<\/p>\n<p>W.P.(C).28416\/09<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>6.    3rd respondent shall within one month from the date of<\/p>\n<p>receipt of a copy of this judgment, consider the question of<\/p>\n<p>revoking the petitioner&#8217;s suspension.       If a further enquiry<\/p>\n<p>pursuant to Ext.P28, in spite of Ext.P30 explanation, is found to<\/p>\n<p>be necessary, then, that may be proceeded with.              But<\/p>\n<p>nevertheless, the necessity to place the petitioner under<\/p>\n<p>suspension should be independently considered. A decision in<\/p>\n<p>the matter of revoking the suspension of the petitioner shall be<\/p>\n<p>taken within one month from the date of receipt of a copy of<\/p>\n<p>this judgment. Petitioner shall be paid subsistence allowance<\/p>\n<p>for the period during which he has been kept under suspension,<\/p>\n<p>as per Rules.
