DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 16\/11\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> Learned APP Ms. Krina Calla, waives service of rule on behalf of<br \/>\nrespondent-State.\n<\/p>\n<p>2.\tHeard<br \/>\nlearned advocate for the applicants and learned APP.\n<\/p>\n<p>3.\tThis<br \/>\napplication for anticipatory bail has been preferred by the<br \/>\napplicants apprehending their arrest in connection with C.R. No.I-174<br \/>\nof 2010 regsitered with Shehra Police Station for the alleged<br \/>\ncommission of offences under Sections 147, 148, 149, 323, 452, 504,<br \/>\n506(2), 395, 427, 336 of Indian Penal Code.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>U.M. Shastri, learned advocate for the applicants submit that the<br \/>\napplicants are workers of a political party and during election a<br \/>\nscuffle took place and allegations have been levelled against the<br \/>\napplicants are not based on correct material.  It is further<br \/>\nsubmitted that applicant No.2 is now elected member of Shehra Taluka<br \/>\nPanchayat and they are ready and willing to abide by the conditions<br \/>\nthat may be imposed by this Court.\n<\/p>\n<p>5.\tMs.\n<\/p>\n<p>Krina Calla, learned APP for the State submits that considering the<br \/>\nnature of allegations levelled against the applicants, they may not<br \/>\nbe granted anticipatory bail.\n<\/p>\n<p>6.\tHowever,<br \/>\nconsidering overall facts and circumstances of the case, nature of<br \/>\nallegations vis-a-vis role attributed to the applicants, in the event<br \/>\nof arrest of the applicants in connection with  C.R. No.I-174 of 2010<br \/>\nregsitered with Shehra Police Station, they shall be released on bail<br \/>\nin respect of the offences alleged against them in this application<br \/>\non executing a personal bond of Rs.5,000\/- each [Rs. Five Thousand<br \/>\nonly each] with one surety of the like amount, by the concerned<br \/>\npolice officer and on condition that they shall:-\n<\/p>\n<p>(a)\tremain<br \/>\npresent before the concerned police station on 19.11.2010 at 11:100<br \/>\na.m;\n<\/p>\n<p>(b)\tremain<br \/>\npresent before the trial court regularly as and when directed on the<br \/>\ndates fixed;\n<\/p>\n<p>(c)\tmake<br \/>\nthemselves available for interrogation by a police officer whenever<br \/>\nand wherever required;\n<\/p>\n<p>(d)\tnot<br \/>\ndirectly or indirectly make any inducement, threat or promise to any<br \/>\nperson acquanited with the facts of the case so as to dissuade from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>(e)\tnot<br \/>\nto obstruct or hamper the police investigation and not to play<br \/>\nmischief with the evidence collected or yet to be collected by the<br \/>\npolice;\n<\/p>\n<p>(f)\tat<br \/>\nthe time of execution of bond, furnish the residential address to the<br \/>\nI.O., and the Court concerned and shall not change their residence<br \/>\ntill the final disposal of the case or till further orders;\n<\/p>\n<p>(g)\tnot<br \/>\nleave India without the permission of the Court and if having<br \/>\npassport, shall deposit the same before the trial court within a<br \/>\nweek.\n<\/p>\n<p>7.\tIt<br \/>\nwould be open to the I.O., to file an application for remand, if he<br \/>\nconsiders it proper and just, and the concerned Magistrate would<br \/>\ndecide it on merits.\n<\/p>\n<p>8.\tThis<br \/>\norder will hold good if the applicants are arrested any time within<br \/>\n90 days from today.  This order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of their<br \/>\narrest.  Thereafter, it will be open to the applicants to make a<br \/>\nfresh application for being enlarged on bail in usual course which<br \/>\nwhen it comes before the competent court, will be disposed of in<br \/>\naccordance with law, having regard to all the attending circumstances<br \/>\nand the materials available at the relevant time unifluenced by the<br \/>\nfact that anticipatory bail was granted.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute.
