petitions viz. Civil Writ Petition No.17187 of<\/p>\n
2007     titled        `Santosh    vs.     State     of         Punjab     &<\/p>\n
Others’ and Civil Writ Petition No.17167 of<\/a> 2007<\/p>\n
titled ‘Suman Lata vs. State of Punjab & Others’<\/a><\/p>\n
as   they     involve      similar       questions    of         law   and<\/p>\n
facts.\n<\/p>\n
                   For reference, Civil Writ Petition<\/p>\n
No.17187 of 2007 is taken up.\n<\/p>\n
                   Santosh        wife    of     Surjit     Kumar        has<\/p>\n
approached this Court by way of filing this civil<\/p>\n
writ     petition        under     Article        226\/227        of      the<\/p>\n
Constitution of India praying for issuance of a<\/p>\n
writ     in    the       nature     of     certiorari            quashing<\/p>\n
selection (Annexure P-8) for the post of Cutting,<\/p>\n
Tailoring and Embroidery Instructor. Prayer has<\/p>\n
also been made for issuance of a writ in the<\/p>\n
nature of mandamus directing the respondents to<\/p>\n
consider the candidature of the petitioner for<\/p>\n
the said post while considering her experience<\/p>\n
with the Government Polytechnic College, Mohali.<\/p>\n
                   Detailed facts need not be noticed<\/p>\n
in so much as the only issue raised by learned<\/p>\n
counsel for the petitioner is that in response to<\/p>\n
the Advertisement (Annexure P-5), the petitioner
\n CWP No.17187 of 2007                                        [3]<\/p>\n
furnished all the required documents. It has not<\/p>\n
been     disputed         by      learned        counsel          for     the<\/p>\n
respondents        that     the    petitioner          is    having       the<\/p>\n
relevant qualification. The only dispute raised,<\/p>\n
as     per   the       admitted      case,       is    in     regard       to<\/p>\n
experience         of     the     petitioner           which        was        a<\/p>\n
condition given out in the Advertisement itself.<\/p>\n
So as to cut short the issue, relevant portion of<\/p>\n
Advertisement (Annexure P-5) reads as under:-<\/p>\n
                    “iii) Should possess atleast two years practical
\n                    experience in an organization registered under the
\n                    Factories Act 1948 or atleast two years teaching
\n                    experience in the line in a Government Institution or an
\n                    Institution recognized by the Government.”<\/p><\/blockquote>\n
                    The case of the petitioner is that<\/p>\n
in view of the latter part of the above extracted<\/p>\n
portion,      the       petitioner        furnished         Certificate<\/p>\n
dated 24.11.2006 (Annexure P-4) which completely<\/p>\n
satisfies the condition of eligibility for the<\/p>\n
said post.\n<\/p>\n
                    The case of the respondents to the<\/p>\n
contrary is that the certificate (Annexure P-4)<\/p>\n
is wholly inadequate as it does not disclose the<\/p>\n
number of days served in a week by the petitioner<\/p>\n
or number of hours served by the petitioner in a<\/p>\n
day.    In   this       view    of    the     matter,        it    is     the<\/p>\n
contention of learned counsel for the respondent-<\/p>\n
State that stand of the respondents in rejecting<\/p>\n
the    candidature         of     the     petitioner          cannot       be
\n CWP No.17187 of 2007                                          [4]<\/p>\n
faulted with.\n<\/p>\n
                   I have considered the contentions<\/p>\n
of learned counsel.\n<\/p>\n
                   Other        than     the     extracted           portion<\/p>\n
above,     Para      10    of    the     Advertisement              is    also<\/p>\n
relevant to be considered which reads as under:-<\/p>\n
                   “10. Pay must be mentioned in the experience certificate,
\n                   without pay experience will not be accounted for.
\n                   Experience certificate issued by any private firm\/concern
\n                   must be verified by the shop\/labour Inspector of the area
\n                   concerned. Experience Certificate issued by private or
\n                   recognized\/affiliated educational institutions must be
\n                   verified by the concerned District level officer.”<\/p><\/blockquote>\n
                   It transpires that the respondents<\/p>\n
had made it clear that pay must be mentioned in<\/p>\n
the    experience          certificate           and      without         pay,<\/p>\n
experience would not be accounted for.<\/p>\n
                   Certificate                  (Annexure                 P-4)\n\nfurnished       by        the     petitioner           disclosed            the\n\nfollowing:-\n\n<\/pre>\n
                          “This is to certify that Ms.Santosh W\/o Surjit Kumar
\n                   resident of House No.376, Ward No.10, Near Khera,
\n                   Morinda, Distt. Ropar is working as Instructor (Cutting
\n                   and Tailouring) in Community Polytechnic Wing of this
\n                   Institution from 13.7.2000 to 26.4.2001 and 1.9.01 to till
\n                   date on hourly basis (Rs.15\/- per hour).”<\/p>\n
                   The          Certificate            only         mentions<\/p>\n
remuneration paid to the petitioner per hour. It<\/p>\n
does not disclose as to how many hours a day the<\/p>\n
petitioner worked and the exact remuneration paid<\/p>\n
to the petitioner, per month.\n<\/p>\n
                   The condition imposed in regard to<\/p>\n
the    practical          experience         requires          two       years
\n CWP No.17187 of 2007                                          [5]<\/p>\n
teaching experience in the line in a Government<\/p>\n
Institution or an Institution recognised by the<\/p>\n
Government. The Certificate, Annexure P-4, might<\/p>\n
disclose that petitioner served for two years but<\/p>\n
it does not disclose as for how many days in a<\/p>\n
week the petitioner worked or for how many hours<\/p>\n
each day the petitioner served. If the petitioner<\/p>\n
had    been      working          only     2-3    hours      a      day     and<\/p>\n
infrequently,          surely       she     did    not       fulfil        the<\/p>\n
required experience criteria. The Certificate is<\/p>\n
inadequate       in     relevant         contents.        It        does   not<\/p>\n
disclose       the       practical           experience              of    the<\/p>\n
petitioner. Practical experience is a relevant<\/p>\n
criteria      for      giving       employment          on     the        post.<\/p>\n
Certificate (Annexure                    P-4) does not detail the<\/p>\n
work    experience           as    required.       In     view        of   the<\/p>\n
above,     the    argument          addressed       by       the      learned<\/p>\n
counsel     for        the    petitioner          that       Certificate,<\/p>\n
Annexure P-4, satisfies the conditions laid in<\/p>\n
the Advertisement, cannot be accepted.<\/p>\n
                    In Civil Writ Petition No.17167 of<\/p>\n
2007, the certificate furnished by the petitioner<\/p>\n
has been placed on record as Annexure P-5. The<\/p>\n
certificate          does         not      even     give            out    the<\/p>\n
remuneration        paid      to     the    petitioner           on   hourly<\/p>\n
basis and therefore, is even more sketchy. In my<\/p>\n
considered       opinion,          it     does    not     satisfy           the
\n CWP No.17187 of 2007                          [6]<\/p>\n
condition        contained   in   Para   10         of   the<\/p>\n
Advertisement read in conjunction with sub-para<\/p>\n
iii) that has been extracted above in earlier<\/p>\n
part of the order.\n<\/p>\n
                   In view of the above, I do not find<\/p>\n
any ground to interfere with the action of the<\/p>\n
respondents.\n<\/p>\n
                   The petitions are dismissed.<\/p>\n
