We have considered the<br \/>\njudgment and the reasons recorded by the learned Sessions Judge. We<br \/>\nhave considered the record and proceedings.\n<\/p>\n<p>\tIt<br \/>\nappears from the evidence on record that there are no injury marks on<br \/>\nthe body of the victim nor any injury marks on the private parts of<br \/>\nthe victim. Further, the victim with the accused had gone to the<br \/>\ndifferent places and they have stayed together. They have also passed<br \/>\nthrough the public places. At no point of time, any resistance was<br \/>\nmade nor any complaint was made by the victim. The allegation for<br \/>\ntaking ornaments is rightly not believed by the learned Sessions<br \/>\nJudge. The aforesaid is coupled with the circumstance that love<br \/>\nletters and the photographs though were not exhibited, but for the<br \/>\npurpose of examining the conduct and to find out  the reliability of<br \/>\nthe evidence of the complainant, it cannot be ignored.\n<\/p>\n<p>\tUnder<br \/>\nthese circumstances, if the learned Sessions Judge has found that the<br \/>\nprosecution has not been able to prove the case beyond reasonable<br \/>\ndoubt, the same cannot be said to be erroneous. Hence, leave  does<br \/>\nnot deserve to be granted, therefore, not granted.
