Civil Application (Stamp Number) No. 2744 of 2003 in<br \/>\nSpecial Civil Application No.  218 of 1989.\n<\/p>\n<p>2.0\tThe<br \/>\nMisc. Civil Application was filed for revival of the Special Civil<br \/>\nApplication No. 218 of 1989 which was disposed of on 23.03.2000.<br \/>\nAccording to the applicants, certain directions were issued by this<br \/>\nCourt in the aforesaid order and liberty was granted to the<br \/>\napplicants for revival of the petition in the case of difficulty. It<br \/>\nis alleged that the respondent-Corporation has not complied with the<br \/>\ndirections and, therefore, the applicants have filed a note for<br \/>\nrevival of the petition but since it was not circulated the above<br \/>\napplication has been filed and, therefore, there is delay of 1343<br \/>\ndays.\n<\/p>\n<p>3.0\tThe<br \/>\nentire application of the applicants consists of two paragraphs which<br \/>\nreads as under:\n<\/p>\n<p>\t1.0\tThe<br \/>\napplicants are original petitioners in the\tSpecial Civil Application<br \/>\nNo. 218 of 1989. The applicants\tsubmit that the Hon&#8217;ble Court decided<br \/>\nthe matter on\t23.03.2000 and directed the respondent to consider<br \/>\nthe\tclaim of the petitioners for conveyance allowance, HRA\tand for<br \/>\nselection grade from 01.07.1988 to 31.05.1993.\tThe Hon&#8217;ble Court<br \/>\nfurther directed the respondent to\tconsider claim of the petitioners<br \/>\nand pass a reasoned\torder. This exercise has to be undertaken and<br \/>\ncompleted \twithin a period of two months from the date of receipt<br \/>\nof\twrit of the order or certified copy thereof whichever is\tearlier.<br \/>\nThe applicants submit that while disposing of the \tpetition, the<br \/>\nHon&#8217;ble Court granted liberty to revive the\tpetition in case of<br \/>\ndifficulty to the petitioner. The\tapplicants after judgement of this<br \/>\nHon&#8217;ble Court waited\tfor the order of the respondent-Municipality as<br \/>\nper the\tdirection given by the Hon&#8217;ble Court and it was\trequested the<br \/>\nauthority to decide the matter but it was\tnot elicited any response<br \/>\nfrom the respondent-\tMunicipality.\n<\/p>\n<p>\t2.\tThe<br \/>\napplicants state and submit that as the \trespondent authority not<br \/>\nresponding and not deciding\tthe claim of the applicants and not<br \/>\nacting according to\tthe direction of the Hon;ble High Court, the<br \/>\napplicants\tfiled a note as per the prevalent practice of the Court<br \/>\nat\tthe relevant time for revival of the petition. The\tapplicants,<br \/>\ntherefore, filed a note through advocate on\t29.09.2000 for the<br \/>\nrevival of the petition, but it was not\tcirculated by the Department<br \/>\nand, therefore, the\tapplicants filed the above mentioned application<br \/>\nfor\trevival of the petition. In view of the above<br \/>\nmentioned\tapplication for revival of the petition. In view of<br \/>\nthe\tabove mentioned facts there is sufficient reason for\treason for<br \/>\nthe condonation of delay.\n<\/p>\n<p>3.0\tAdmittedly,<br \/>\nthe order of this Court is dated 23.03.2000. If the directions issued<br \/>\nby this Court were not complied with, the applicants had appropriate<br \/>\nremedy apart from reviving the petition. A note was filed for revival<br \/>\nof the petition on 29.09.2000. After filing the note the applicant<br \/>\nhas not made any effort to bring the matter on Board. In fact,<br \/>\nthereafter the applicant has not done anything in the matter till<br \/>\n11.12.2003 when the aforesaid Misc. Civil Application was filed. It<br \/>\nis required to be noted that even after filing the aforesaid MCA in<br \/>\nthe year 2003, the applicants have not made any efforts to get the<br \/>\nmatter heard. There was office objection with regard to delay.<br \/>\nHowever, the present application was filed only in August 2010<br \/>\npraying for condonation of delay, that too without explaining delay.\n<\/p>\n<p>4.0\tA<br \/>\nperusal of the application itself shows that there is no explanation<br \/>\nmuch less reasonable explanation for the delay in question. The<br \/>\napplicants were totally negligent and ignorant and did not pursue the<br \/>\nmatter diligently. There is absolutely no explanation with regard to<br \/>\nthe delay. The fact that the present application has been filed in<br \/>\nthe year 2010 shows gross lethargy on the part of the applicants. I,<br \/>\nam, therefore, of the view that this application deserves to be<br \/>\nrejected. Accordingly this application is rejected. Consequently,<br \/>\nMisc.
