Justice ANTONY DOMINIC\n\n Dated :24\/03\/2009\n\n O R D E R\n                     ANTONY DOMINIC,J.\n                 ---------------------\n                 W.P.(C).No.9416 OF 2009\n               ------------------------\n            Dated this the 24th day of March, 2009.\n\n                          JUDGMENT\n<\/pre>\n<p>      Petitioner management contends that respondents 3<\/p>\n<p>to 18 have filed Ext.P3 complaint before the 2nd respondent.<\/p>\n<p>According     to  them,    though    the    complaint  is  not<\/p>\n<p>maintainable, the Committee is enquiring into the merits<\/p>\n<p>of the grievance. Therefore the submission made is that<\/p>\n<p>this court should issue a writ of prohibition restraining the<\/p>\n<p>Committee from proceeding with the enquiry pursuant to<\/p>\n<p>Ext.P3, as it lacks jurisdiction to entertain the same.<\/p>\n<p>      2. In my view, this writ petition is premature for the<\/p>\n<p>reason that if the petitioner has a case that the Committee<\/p>\n<p>lacks jurisdiction to entertain Ext.P3 complaint, it is for the<\/p>\n<p>petitioner to raise the issue of jurisdiction       before the<\/p>\n<p>Committee itself and request the Committee to decide the<\/p>\n<p>issue as a preliminary one and I have no reason to think<\/p>\n<p>Wp(c).No.9416\/09              \/2\/<\/p>\n<p>that if such a request is made, the Committee will decline to<\/p>\n<p>entertain the same.\n<\/p>\n<p>      3.
