filed under Article 226\/227 of the Constitution<\/p>\n
of India praying for issuance of a writ in the<\/p>\n
nature of mandamus directing the respondents to<\/p>\n
regularise     services         of    the     petitioners        with<\/p>\n
effect from the date they have completed four<\/p>\n
years of service.\n<\/p>\n
                It     has        been       argued     that      the\n\npetitioners     were    appointed            on   the    posts    of\n\n<\/pre>\n
Medical Officer on short term basis in the State
\n CWP No.17451 of 2008                                      [2]<\/p>\n
of Punjab after selection. So as to consider the<\/p>\n
issue of regularisation of services of doctors, a<\/p>\n
Committee was constituted under the Chairmanship<\/p>\n
of Justice S.S. Sandhawalia (Retd.) to consider<\/p>\n
whether the doctors working on adhoc basis should<\/p>\n
be allowed to continue or whether their services<\/p>\n
should       be   regularised.           Sandhawalia            Committee<\/p>\n
recommended       that        services    of   doctors          on   adhoc<\/p>\n
basis be regularised with effect from the date<\/p>\n
they     complete        four      years       of     service.         The<\/p>\n
recommendations          of     Sandhawalia         Committee         were<\/p>\n
accepted by the State of Punjab.\n<\/p>\n
                   Learned counsel for the petitioners<\/p>\n
has argued that having taken a conscious decision<\/p>\n
to     accept     the        recommendations        of   Sandhawalia<\/p>\n
Committee, the respondents cannot pick and choose<\/p>\n
from amongst doctors. It has been further stated<\/p>\n
that cases of persons similarly situated, have<\/p>\n
been allowed by this Court, while referring to<\/p>\n
judgment      dated      26.10.1999       rendered       in      Civil Writ<\/p>\n
Petition No.11014 of 1998 titled `Dr. Manmohan Singh vs. State of<\/p>\n
Punjab & Others’.\n<\/p>\n
                   Learned counsel for the respondents<\/p>\n
has not been able to dispute the facts as stated<\/p>\n
by     the   learned         counsel     for    the      petitioners.<\/p>\n
Learned counsel, further, has not been able to<\/p>\n
distinguish            the     judgment        dated       26.10.1999
\n CWP No.17451 of 2008                                          [3]<\/p>\n
rendered in Civil Writ Petition No.11014 of 1998 titled `Dr.<\/p>\n
Manmohan Singh vs. State of Punjab & Others’.<\/p>\n
                   I have considered the issue.\n<\/p>\n
                   In Dr. Manmohan Singh’s case (supra), the<\/p>\n
following has been considered:-\n<\/p>\n
                          “On a consideration of the matter, it is noticed that
\n                   in their reply, respondents No.1 and 2 have virtually
\n                   admitted that the petitioner’s plea for regularisation after
\n                   four years in service. They have only stated that the matter
\n                   is under consideration. It is also noticed that the State
\n                   Government, in pursuance of this Court’s order dated
\n                   April 5, 1995 in the cases of Dr. Lokesh Gupta and Dr.
\n                   Sunil Kumar, passed an order so as to regularise the
\n                   services of those two doctors from the date on which they
\n                   completed four years in service. It has further been seen
\n                   that the State Government regularised the services of 34
\n                   doctors with effect from June 26, 1992 vide order dated
\n                   January 31, 1995. Thus, the benefit of regularisation from
\n                   an earlier date has been given to many doctors. Why has it
\n                   been denied to the petitioner. The respondents have not
\n                   been able to give any good reason. It is further undisputed
\n                   that respondent No.4 though a regular candidate, had
\n                   joined service on January 13, 1993. The petitioner though
\n                   appointed on an adhoc basis, joined the service in
\n                   February, 1988. He is thus senior to respondent No.4. The
\n                   question of regularisation in favour of the petitioner has
\n                   been kept pending by the State Government without any
\n                   justification. The State Government cannot be allowed to
\n                   adopt two different yardsticks on the same question. When
\n                   other doctors, who are similarly situated, have been given
\n                   the benefit of regularisation of their services from a
\n                   retrospective date, the same could not and should not be
\n                   declined to the petitioner.”<\/p><\/blockquote>\n
                   On a consideration of the facts, it<\/p>\n
becomes evident that the respondents have adopted<\/p>\n
the   recommendations            of     Sandhawalia            Report       and<\/p>\n
have taken a decision to regularise services of<\/p>\n
doctors on their completing 4 years in service.<\/p>\n
The      decision         however            is       being          applied<\/p>\n
discriminately. Some doctors have been given the<\/p>\n
benefit and some have been denied the benefit.\n<\/p>\n

The persons who approached this Court, have been<\/p>\n
allowed the relief. Despite such being the facts,<\/p>\n
although        the    petitioners       completed      4      years   in<\/p>\n
service as doctors, their services have not been<\/p>\n
regularised from that date. This action of the<\/p>\n
respondents is unreasonable and arbitrary.<\/p>\n
                      In view of the above, this petition<\/p>\n
is allowed.\n<\/p>\n
                      The    respondents        are    directed        to<\/p>\n
consider the case of the petitioners and pass<\/p>\n
orders regarding regularisation of services of<\/p>\n
the     petitioners         with   effect     from     the      date   on<\/p>\n
which       they      completed     four     years     in       service.<\/p>\n
Necessary decision be taken within a period of<\/p>\n
two months from the date of receipt of certified<\/p>\n
copy of this order.<\/p>\n
