No.100 of 2009 (O&amp;M)\n                                  Date of Decision: 12.1.2009.\nSunil Kumar and another                    ....Petitioners\n\n            Versus\n\nSheela Devi and others                        ...Respondents\nCORAM : Hon'ble Mr. Justice Rajesh Bindal\nPresent:- Mr.I.D.Singla, Advocate\n          for the petitioners.\n\nRAJESH BINDAL, J.\n<\/pre>\n<p>                   ****<br \/>\n            The challenge in the present petition is to the order<br \/>\npassed by the learned Courts below in an application filed by the<br \/>\npetitioner\/plaintiffs under Order 39 Rules 1 and 2 CPC.\n<\/p>\n<p>            The challenge in the suit is to the mutation being entered<br \/>\nin favour of respondent No1. and further for implementation of the<br \/>\njudgment and decree in favour of petitioners. Both the courts below<br \/>\nrejected the prayer for interim injunction on the ground that there was<br \/>\na judgment and decree passed in favour of respondent No.1 by the<br \/>\nlearned Lower Appellate Court which was upheld upto the Hon&#8217;ble<br \/>\nthe Supreme court, the mutation was entered in favour of respondent<br \/>\nNo.1. The contention of learned counsel for the petitioners that they<br \/>\nwere not party to the suit filed, has no legs to stand as their<br \/>\npredecessor in interest were party in that suit.
