Justice ANTONY DOMINIC\n\n Dated :20\/02\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n              -----------------------\n                 W.P.(C).No.5246 OF 2009\n              ------------------------\n          Dated this the 20th day of February, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>      Grievance of the petitioner is regarding Ext.P14, a<\/p>\n<p>prohibitory order issued by the 3rd respondent.<\/p>\n<p>      2. According to the petitioner he has all necessary<\/p>\n<p>licenses for carrying on the brick manufacturing activity. It<\/p>\n<p>is also stated that, in terms of Ext.P12 judgment, the<\/p>\n<p>petitioner is only liquidating the existing stock of clay and<\/p>\n<p>that he will not manufacture once the available stock is<\/p>\n<p>exhausted. It is stated that despite all this by Ext.P14, the<\/p>\n<p>Village Officer has issued a prohibitory order requiring the<\/p>\n<p>petitioner to discontinue the activities.<\/p>\n<p>      3. Government Pleader on instruction submits that the<\/p>\n<p>petitioner is continuing manufacturing activities without<\/p>\n<p>obtaining consent from the Pollution Control Board. Yet<\/p>\n<p>another contention    now raised by the Government Pleader<\/p>\n<p><span class=\"hidden_text\">WP(c).No.5246\/09                 2<\/span><\/p>\n<p>is that, whatever be the activities that are being carried on,<\/p>\n<p>since the place of work of the petitioner is a paddy field, such<\/p>\n<p>activity without obtaining necessary permit under the Kerala<\/p>\n<p>Land Utilisation order is illegal.\n<\/p>\n<p>      4. On the other hand, counsel for the petitioner asserts<\/p>\n<p>that the petitioner    has necessary consent issued by the<\/p>\n<p>Pollution Control Board. He reiterates his plea that he has<\/p>\n<p>already got a stock of clay and and that he only wants to<\/p>\n<p>liquidate the stock by using the same for brick manufacturing.<\/p>\n<p>It is stated that for liquidating the stock he need continue<\/p>\n<p>manufacturing only      for another   three weeks and       that<\/p>\n<p>thereafter he will stop his brick manufacturing.<\/p>\n<p>      5. Taking into account the aforesaid submissions made<\/p>\n<p>by    both the parties, I feel that if the petitioner has an<\/p>\n<p>available stock of clay which is already stored in the place of<\/p>\n<p>manufacturing, he should be allowed to liquidate the stock.<\/p>\n<p>Taking into account of the request of the petitioner that he<\/p>\n<p>needs only 3 weeks to liquidate the existing stock of clay, the<\/p>\n<p><span class=\"hidden_text\">WP(c).No.5246\/09                3<\/span><\/p>\n<p>writ petition disposed of as follows;\n<\/p>\n<p>      6. Petitioner shall produce before the 3rd respondent the<\/p>\n<p>consent of the Pollution Control Board that he has.
