Justice M.SASIDHARAN NAMBIAR\n\n Dated :10\/12\/2010\n\n O R D E R\n          M.SASIDHARAN NAMBIAR,J.\n\n           ---------------------------------------------\n           CRL.M.C.NO.4602 OF 2010\n           ---------------------------------------------\n           Dated 10th December, 2010\n\n\n                          O R D E R\n<\/pre>\n<p>            Petitioner               was       originally     the<\/p>\n<p>second accused in C.P.5\/2002 on the file of<\/p>\n<p>Judicial First Class Magistrate&#8217;s Court-I,<\/p>\n<p>Hosdurg. As he was absconding, the case<\/p>\n<p>against him was split up and case against<\/p>\n<p>the  remaining           three           accused,         namely,<\/p>\n<p>accused 1,3 and 4, was committed. It was<\/p>\n<p>taken  on     file          as        S.C.254\/2002             by<\/p>\n<p>Additional    Sessions                    Judge         (Adhoc-I),<\/p>\n<p>Kasaragod. Those accused were tried for the<\/p>\n<p>offences under Sections 143, 147, 148, 448<\/p>\n<p>and 436 read with Section 149 of Indian<\/p>\n<p>Penal  Code.      By        Annexure-AIII                judgment,<\/p>\n<p>those  accused       were         acquitted.            The   case<\/p>\n<p>against  the     petitioner                was        subsequently<\/p>\n<p>Crmc 4602\/10<br \/>\n<span class=\"hidden_text\">                           2<\/span><\/p>\n<p>transferred to the register of long pending<\/p>\n<p>cases.      It  is   now  pending  as   L.P.53\/2003.<\/p>\n<p>Petition is filed under Section 482 of Code of<\/p>\n<p>Criminal      Procedure  to  quash  the  proceedings<\/p>\n<p>contending that in view of the acquittal of the<\/p>\n<p>co-accused      and  settlement  arrived  at    with<\/p>\n<p>second respondent, the de facto complainant, it<\/p>\n<p>is not in the interest of justice to continue<\/p>\n<p>the prosecution.\n<\/p>\n<p>            2. Second respondent appeared through a<\/p>\n<p>counsel and filed an affidavit stating that<\/p>\n<p>entire      disputes  were   settled  amicably   and<\/p>\n<p>consequent      to  the   settlement,  he   has  no<\/p>\n<p>grievance against the petitioner and therefore,<\/p>\n<p>he     has     no   objection   for   quashing   the<\/p>\n<p>proceedings.\n<\/p>\n<p>            3.   Learned  counsel appearing for the<\/p>\n<p>petitioner,      second   respondent   and  learned<\/p>\n<p>Crmc 4602\/10<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>Public Prosecutor     were heard.<\/p>\n<p>            4. Prosecution   case   is   that   the<\/p>\n<p>petitioner along with accused 1,3, 4 and others<\/p>\n<p>formed themselves into an unlawful assembly on<\/p>\n<p>2\/6\/2001 at about      11 a.m and in furtherance of<\/p>\n<p>the common object, to set fire to the furniture<\/p>\n<p>shop of second respondent in C.P.VIII\/158 of<\/p>\n<p>Cheruvathur       Panchayat,    after    committing<\/p>\n<p>trespass      set fire  to  the  shop  and  thereby<\/p>\n<p>caused a loss to the tune      of Rs.1,50,000\/- and<\/p>\n<p>committed the offences. Annexure-AIII judgment<\/p>\n<p>shows that after evidence, accused 1,3 and 4<\/p>\n<p>were      acquitted as Pws.1 to 3    including the<\/p>\n<p>second       respondent  did   not   support    the<\/p>\n<p>prosecution case. Therefore, examination of the<\/p>\n<p>witnesses was dispensed       with.     Annexure-AV<\/p>\n<p>agreement executed by second respondent as well<\/p>\n<p>as the affidavit of the second respondent filed<\/p>\n<p>Crmc 4602\/10<br \/>\n<span class=\"hidden_text\">                           4<\/span><\/p>\n<p>before      this  Court establishes  that    second<\/p>\n<p>respondent has settled all the dispute with the<\/p>\n<p>petitioner.      In  such  circumstances,  even  if<\/p>\n<p>petitioner      is  to  be   tried,  there  is  no<\/p>\n<p>likelihood of a successful prosecution. In such<\/p>\n<p>circumstances, it is not in the interest of<\/p>\n<p>justice to continue the prosecution.<\/p>\n<p>            Petition is allowed.
