            Identical contentions have been raised in these<\/p>\n
writ petitions. Therefore, they have been heard together<\/p>\n
and are being disposed of by this common judgment. I<\/p>\n
will refer to the facts in W.P.(C) No.12122 of 2009, which<\/p>\n
will govern the other writ petition also.<\/p>\n
            2. The petitioner, while functioning as Deputy<\/p>\n
Tahsildar in Survey and Land Records Department, was<\/p>\n
served with Ext.P1 memo of charges to which, he<\/p>\n
submitted Ext.P2 explanation. The department decided to<\/p>\n
conduct    an   enquiry    against   the  petitioner.  The<\/p>\n
proceedings were delayed and the petitioner had<\/p>\n
approached this court in W.P.(C) No.37565 of 2007,<\/p>\n
which was disposed of directing an expeditious<\/p>\n
finalisation of the disciplinary proceedings. The Deputy<\/p>\n
Collector(LR), Thiruvananthapuram was appointed as the<\/p>\n
Enquiry Officer as per Ext.P6 and by Ext.P7, the Enquiry<\/p>\n
Officer concluded that the petitioner had not committed<\/p>\n
W.P.(C)Nos.12122 & 12144 of 2009<\/p>\n
                           :: 2 ::\n<\/p>\n
any misconduct, nor had done any act warranting any<\/p>\n
punishment as such.         But, by Ext.P8 an order of<\/p>\n
punishment of barring of three increments with<\/p>\n
cumulative effect, a major punishment was imposed by<\/p>\n
the 2nd respondent, the disciplinary authority. It seems<\/p>\n
that Ext.P8 was not preceded by any notice, intimating<\/p>\n
the petitioner that the disciplinary authority proposes to<\/p>\n
disagree with the Enquiry Officer.<\/p>\n
            3.   Apparently, aggrieved by Ext.P8 order,<\/p>\n
Ext.P9 appeal dated 8.8.2008 was preferred before the<\/p>\n
appellate authority, the 1st respondent. By Ext.P11, the<\/p>\n
appellate authority set aside the order passed by the<\/p>\n
original authority and required the District Collector to<\/p>\n
hear the matter afresh and pass fresh orders. It was<\/p>\n
found that the requisite procedure had not been followed<\/p>\n
by the District Collector.\n<\/p>\n
            4.   Pursuant to Ext.P11, the disciplinary<\/p>\n
authority proceeded to pass a fresh order, Ext.P12. The<\/p>\n
operative portion of the same reads as follows:<\/p>\n

                           :: 3 ::\n<\/p>\n
           “While considering the Appeal petition,<\/p>\n
       the Commissioner of Land Revenue has<\/p>\n
       observed that the Enquiry Officer had<\/p>\n
       recommended to acquit the delinquent<\/p>\n
       officer from the charges levelled against<\/p>\n
       him. Even though the District Collector has<\/p>\n
       imposed major penalty without adhering<\/p>\n
       the formal enquiry report and considering<\/p>\n
       the statement of defense filed by the<\/p>\n
       delinquent officer.\n<\/p>\n
           In the circumstances, Sri.K.Biju, Sub<\/p>\n
       Collector, Thiruvananthapuram is hereby<\/p>\n
       appointed as Enquiry Officer under Rule 15<\/p>\n
       of K.C.S. (CC&A) Rules, 1960 to conduct a<\/p>\n
       detailed    in   this    case. Since,   the<\/p>\n
       Commissioner      of   Land   Revenue   has<\/p>\n
       remanded the case for fresh disposal, you<\/p>\n
       are   strictly   directed  to  adhere   the<\/p>\n
       provisions contained in Rule 15 of K.C.S.<\/p>\n
       (CC&A) Rules, 1960. The Enquiry Officer<\/p>\n
       will submit the report within one month<\/p>\n
       without     fail.    The    connected   file<\/p>\n
       S5\/63433\/2006 (1 to 236 pages) is also<\/p>\n
       enclosed herewith for further necessary<\/p>\n
       action. The receipt of the records may<\/p>\n
       please be acknowledged.”\n<\/p>\n
            5.   The disciplinary authority has, in the<\/p>\n
course of passing fresh orders, on remand, proceeded to<\/p>\n
W.P.(C)Nos.12122 & 12144 of 2009<\/p>\n
                           :: 4 ::\n<\/p>\n
direct a fresh enquiry to be conducted. This has been<\/p>\n
challenged in the writ petition.\n<\/p>\n
            6.   Similar facts are involved in W.P.(C)<\/p>\n
No.12144 of 2009 and Ext.P11 is the order passed in the<\/p>\n
said case by the disciplinary authority, subsequent to the<\/p>\n
remand made by the Commissioner for Land Revenue.<\/p>\n
            7.   I heard Mr.Pirappancode V.S.Sudheer,<\/p>\n
learned counsel for the petitioner and the learned<\/p>\n
Government Pleader Sri.Antony Mukkath.<\/p>\n
            8.   Though the order of remand by the<\/p>\n
Commissioner of Land Revenue, in these cases, have also<\/p>\n
been challenged, learned counsel for the petitioner, at<\/p>\n
this stage, limited the challenge to the orders passed by<\/p>\n
the District Collector, directing a fresh enquiry to be<\/p>\n
conducted, which alone need be considered and I have<\/p>\n
considered the same.\n<\/p>\n
            9. By Ext.P7 in W.P.(C)No.12122 of 2009,<\/p>\n
the enquiring authority had submitted a report,<\/p>\n
exonerating the petitioner. This was then forwarded to<\/p>\n
W.P.(C)Nos.12122 & 12144 of 2009<\/p>\n
                           :: 5 ::\n<\/p>\n
the disciplinary authority. No doubt, as per the K.C.S.<\/p>\n
(CC&A) Rules, 1960, it might be open to the disciplinary<\/p>\n
authority to take a different view from that of the Enquiry<\/p>\n
Officer. In such a case, the delinquent officer must be<\/p>\n
given an opportunity to show cause against the proposal.<\/p>\n
He must also be put on notice, the basis on which the<\/p>\n
disagreement was arrived at. That was not done in this<\/p>\n
case, prior to the passing of Ext.P8 order. This, among<\/p>\n
others, was taken note of by the 1st respondent-appellate<\/p>\n
authority when he directed the disciplinary authority to<\/p>\n
pass fresh orders. At no point of time did the appellate<\/p>\n
authority contemplate or provide for any fresh enquiry,<\/p>\n
nor is there any finding anywhere by the appellate<\/p>\n
authority that the enquiry report is not acceptable. The<\/p>\n
enquiry report has also not been set aside.<\/p>\n
            10. All that the appellate authority did was to<\/p>\n
remand the matter to the District Collector, requiring the<\/p>\n
latter to pass fresh orders, in accordance with law. It is<\/p>\n
necessary for the disciplinary authority to consider the<\/p>\n

                           :: 6 ::\n<\/p>\n
enquiry report, though the disciplinary authority need<\/p>\n
not follow or accept the enquiry report. But, as stated<\/p>\n
above, there are circumstances where he may disagree<\/p>\n
with the enquiry report. Such disagreement obviously<\/p>\n
cannot be capricious. It must be based on materials<\/p>\n
available and the proposal to disagree with the findings of<\/p>\n
the enquiring authority must be communicated by the<\/p>\n
disciplinary authority to the delinquent officer. This is<\/p>\n
not only part of the prescribed procedure, but it is<\/p>\n
required for complying with the principles of natural<\/p>\n
justice.\n<\/p>\n
            11. Apart from that, it is not open to the 2nd<\/p>\n
respondent, after the remand effected under Ext.P11, to<\/p>\n
direct a fresh enquiry to be conducted. This has been<\/p>\n
done without there being even a stray observation<\/p>\n
regarding the acceptability or otherwise of the Enquiry<\/p>\n
Report, let alone reference to any materials, on the basis<\/p>\n
of which the disciplinary authority can legitimately<\/p>\n
propose to disagree with the conclusions and findings in<\/p>\n
W.P.(C)Nos.12122 & 12144 of 2009<\/p>\n
                           :: 7 ::\n<\/p>\n
the Enquiry Report. But, what has been done by the<\/p>\n
disciplinary authority, in the present case, is not only to<\/p>\n
proceed to disagree with the Enquiring Authority, but to<\/p>\n
direct a fresh enquiry to be conducted. This is clearly<\/p>\n
impermissible, for more than one reason. Firstly, the<\/p>\n
disciplinary authority has not set aside the original<\/p>\n
Enquiry Report. There cannot be any second enquiry,<\/p>\n
unless the first report is set aside. Secondly, as stated<\/p>\n
above, the grounds of disagreement have not been<\/p>\n
referred to by the disciplinary authority, let alone<\/p>\n
communicated to the delinquent officer. Thirdly, the<\/p>\n
powers of the disciplinary authority, in the instant case,<\/p>\n
are circumscribed by the terms contained in the order of<\/p>\n
remand, which is only to pass a fresh order and does not,<\/p>\n
as such, contemplate a fresh enquiry.<\/p>\n
            For all these reasons, I am of the view that the<\/p>\n
petitioner is entitled to succeed.    Ext.P12 in W.P.(C)<\/p>\n
No.12122 of 2009 and Ext.P11 in W.P.(C)No.12144 of<\/p>\n
2009 are quashed. The 2nd respondent shall proceed to<\/p>\n
W.P.(C)Nos.12122 & 12144 of 2009<\/p>\n
                            :: 8 ::\n<\/p>\n
pass fresh orders, as directed by the appellate authority,<\/p>\n
within three months from the date of receipt of a copy of<\/p>\n
this judgment.\n<\/p>\n
             Writ petitions are disposed of as above.<\/p>\n
