Sinha, C.J. <\/p>\n<p> 1. This writ petition is directed against an order dated<br \/>\n29.11.2001 passed by the Central Administrative Tribunal,<br \/>\nPrincipal Bench, New Delhi (hereinafter for the sake of<br \/>\nbrevity referred to as, &#8216;the Tribunal&#8217;) in O.A. No. 342 of<br \/>\n2001 whereby and whereunder the Original Application<br \/>\nfiled by the respondent No. 1 herein was allowed.\n<\/p>\n<p> 2. The basic fact of the matter is not in dispute.\n<\/p>\n<p> On a charge that during surprise checking of buses<br \/>\nconducted by the PRG staff on 01.05.1997 at &#8216;T&#8217; point<br \/>\nNoida in Kalyanpuri Circle, bus No. DL-1P-0191, DEP-4192, DEP-6218 and DL-1P-1457 were found plying<br \/>\nwithout valid permits, the respondent No. 1 herein was<br \/>\nawarded the punishment of Censure vide order dated<br \/>\n10.11.1997. The respondent No. 1 preferred an appeal<br \/>\nthereagainst wherein the aforementioned order of<br \/>\npunishment was set aside vide order dated 13.04.1998.<br \/>\nThe Commissioner of Police, however, in exercise of his<br \/>\npowers conferred upon him under Rule 25B of the Delhi<br \/>\nPolice (Punishment &amp; Appeal) Rules, 1980 (in short, &#8216;the<br \/>\nsaid Rules&#8217;) suo moto set aside the order of the appellate<br \/>\nauthority and confirmed the punishment of Censure vide<br \/>\norder dated 29.12.1998.\n<\/p>\n<p> Challenging the said order dated 29.12.1998 passed by the<br \/>\nCommissioner of Police, the respondent No. 1 filed the<br \/>\naforesaid Original Application before the Tribunal.\n<\/p>\n<p> 3. The leaned Tribunal on the ground that the provisions of<br \/>\nRule 25B of the said Rules have been struck down as ultra<br \/>\nvires by a Full Bench of the Tribunal allowed the said<br \/>\nOriginal Application.\n<\/p>\n<p> 4. The question as to whether Rule 25B of the said Rules is<br \/>\nultra vires the Delhi Police Act, 1978 (in short, &#8216;the said<br \/>\nAct&#8217;) or not had also been considered by this Bench in<br \/>\nC.W.P. No. 2866 of 1999 and other connected matters<br \/>\ndecided on today itself, i.e., 17.09.2002 wherein the<br \/>\njudgment of the Full Bench of the Tribunal has been<br \/>\nupheld.\n<\/p>\n<p> Furthermore, the Administration itself has issued a<br \/>\ncircular on or about 28.05.2001, which is to the following<br \/>\neffect:-\n<\/p>\n<p>&#8220;CIRCULAR   <\/p>\n<p> As per prevailing practice, a number of<br \/>\nrevision petitions addressed to the<br \/>\nCommissioner of Police, Delhi are being<br \/>\nreceived in PHQ for consideration and<br \/>\ndecision. Recently a full bench of Hon&#8217;ble<br \/>\nC.A.T. have made a decision vide its judgment<br \/>\ndated 14.9.2000 in six difference O.A. Nos.<br \/>\n77\/97, 2283\/97, 1988\/99, 2800\/99,<br \/>\n532\/2000 and 537\/2000, that Rule 25-B of<br \/>\nDelhi Police (Punishment and Appeal)<br \/>\nAmendment Rules, 1983 is ultra vires of the<br \/>\nprovisions of the Delhi Police Act, and has<br \/>\nbeen set aside, following the judgment of the<br \/>\nHon&#8217;ble Supreme Court of India in the case of<br \/>\n<a href=\"\/doc\/93875\/\">State of Mysore v. H.D. Kolkar AIR<\/a> 1974 SC\n<\/p>\n<p>90. <\/p>\n<p> On receipt of C.A.T.&#8217;s judgment dated<br \/>\n14.9.2000, with L.A. to C.P. Delhi and it was<br \/>\ndecided that Rule 25-A &#8216;Revision&#8217; has also no<br \/>\nlegal force, in view of C.A.T.&#8217;s decision dated<br \/>\n14.9.2000. Hence, no revision petition can lie<br \/>\nto the Commissioner of Police, Delhi. Since,<br \/>\nthe Commissioner of Police, Delhi has no<br \/>\nlonger revisionary powers, the petitioners in<br \/>\nfuture will be at liberty to move the court after<br \/>\nhaving his\/her first appeal considered and<br \/>\nrejected by the appellate authority against the<br \/>\norder of disciplinary authority. So far as<br \/>\nappeals to the C.P. Delhi against the<br \/>\npunishment orders of Addl. Cs. P.\/Jt.<br \/>\nCs.P.\/Spl. Cs.P., are concerned, the same will<br \/>\ncontinue to be entertained in PHQ as per the<br \/>\nexisting Rule 23 of Delhi Police (Punishment &amp;<br \/>\nAppeal) Rules, 1980.\n<\/p>\n<p>Sd\/-\n<\/p>\n<p>(R.S. Ghumman) DCP\/HQ <\/p>\n<p>for Commissioner of Police: Delhi&#8221;\n<\/p>\n<p> It is, therefore, evident that the petitioner has accepted the<br \/>\nfact that Rule 25B of the said Rules is ultra vires the<br \/>\nprovisions of the said Act.\n<\/p>\n<p> 5. The question has also been considered at some length in<br \/>\n <a href=\"\/doc\/24214\/\">Union of India and Ors. v. Ex. Constable\/Driver Dalbir Singh CWP No.<\/a> 2731 of 2002 decided on today itself, i.e.,<br \/>\n17.09.2002.\n<\/p>\n<p> 6. Following the aforesaid decisions and keeping in view the<br \/>\ncircular dated 28.05.2001 issued by the petitioner herein,<br \/>\nwe find no merit in this writ petition, which is dismissed<br \/>\naccordingly.
