The<br \/>\n\tdelay is sufficiently explained in the application, and the contents<br \/>\n\tof the application are supported by the affidavit of Under Secretary<br \/>\n\tof the Legal Department of the State. Ms.Shah further submitted that<br \/>\n\tconsidering the fact that the trial Court recorded conviction of the<br \/>\n\trespondent &#8211; accused for the serious offence punishable<br \/>\n\tu\/s.307 of the IPC, yet, the sentence awarded by the trial Court is<br \/>\n\tunduly lenient and disproportionate to the seriousness of the crime<br \/>\n\tcommitted by the accused. It is, therefore, submitted that the<br \/>\n\tapplicant &#8211; appellant has good case and if the delay is not<br \/>\n\tcondoned, the meritorious case of the applicant &#8211; appellant<br \/>\n\tshall be adversely affected, which shall cause great prejudice to<br \/>\n\tthe appellant.\n<\/p>\n<p>Since<br \/>\n\tMs.Shah, learned APP, for the applicant &#8211; appellant &#8211;<br \/>\n\tState has submitted that the applicant &#8211; appellant &#8211;<br \/>\n\tState has meritorious case and if the delay is not condoned, the<br \/>\n\tappellant &#8211; State shall suffer great prejudice, we deem it<br \/>\n\texpedient to examine impugned judgment and order rendered by the<br \/>\n\ttrial Court and especially the reasons assigned by the trial Court<br \/>\n\twhile determining the quantum of sentence. There is no dispute that<br \/>\n\tthe injured and the respondent &#8211; accused belong to the same<br \/>\n\tfamily. On account of the incident, FIR was filed against the<br \/>\n\taccused and, ultimately, there is no dispute the trial Court<br \/>\n\trecorded his conviction for the offence punishable u\/s.307 of the<br \/>\n\tIPC. After recording the conviction of the accused, both the sides,<br \/>\n\tnamely, the prosecution as well as the accused were heard on the<br \/>\n\tcount of sentence by the trial Court. While exercising the<br \/>\n\tdiscretion in determining the quantum of sentence, the trial Court<br \/>\n\ttook into consideration not only the fact that the accused and the<br \/>\n\tinjured belong to the same family and they are family members, but<br \/>\n\talso observed that to see that in future the family relationship is<br \/>\n\tnot ruined, lenient view while fixing the sentence was required to<br \/>\n\tbe taken. At the same time the trial Court also took into<br \/>\n\tconsideration the nature of the offence proved against the accused.<br \/>\n\tIt is further clear that there was no adverse criminal antecedence<br \/>\n\tagainst the respondent &#8211; accused. Taking into consideration<br \/>\n\tall these aspects, the trial Court exercised its discretion while<br \/>\n\tdetermining the quantum of sentence. We do not find any infirmity or<br \/>\n\tany illegality committed by the trial Court while fixing the quantum<br \/>\n\tof sentence. There does not appear that the trial Court exercised<br \/>\n\tits discretion either arbitrarily or perversely. Thus, we do not<br \/>\n\tfind any merits in the appeal.
