DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/09\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>At<br \/>\n\tthe outset, learned counsel for the applicant, on instructions,<br \/>\n\tsubmits that without prejudice to the rights and contentions of the<br \/>\n\tapplicant, he would like to pay Rs.1,00,000\/- within two weeks from<br \/>\n\tthe date of his release with the concerned court and would make his<br \/>\n\tbest possible efforts to see that part of the amount is paid.<br \/>\n\tLearned counsel appearing for the applicant submitted that<br \/>\n\tinvestigation is over and charge<br \/>\n\tsheet is filed.  It is further submitted that wife of the<br \/>\n\tapplicant is suffering from Tuberculosis and other serious deceases,<br \/>\n\tby imposing suitable conditions,  the applicant may be<br \/>\n\tenlarged on bail.\n<\/p>\n<p>Heard<br \/>\n\tlearned APP  for the respondent &#8211; State.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel for the parties and perusing the record of the<br \/>\n\tcase and taking into consideration the facts of the case, nature of<br \/>\n\tallegations, role attributed to the accused and punishment<br \/>\n\tprescribed for the alleged offences coupled with the fact<br \/>\n\tthat charge sheet is filed,<br \/>\n\twithout discussing the evidence in detail, at this stage, I am<br \/>\n\tinclined to enlarge the applicant on bail  in connection with<br \/>\n\tC.R.No.I-149\/2010 of Himatnagar Town Police Station  for the<br \/>\n\toffences punishable under sections 467, 468, 420, 406 &amp; 114 of<br \/>\n\tthe Indian Penal Code, on furnishing   bond of Rs.10,000\/- (Rupees<br \/>\n\tten thousand only) with one surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and on conditions that the applicant<br \/>\n\tshall :\n<\/p>\n<p>[a]\tnot take<br \/>\nundue advantage of liberty or abuse liberty;\n<\/p>\n<p>[b]\tnot act in<br \/>\na manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tmaintain<br \/>\nlaw and order;\n<\/p>\n<p>[d]\tmark<br \/>\npresence before the concerned  Police Station on every 1st<br \/>\nand 15th day of English Calender month between  11.00 a.m.<br \/>\nand 2 p.m for three months;\n<\/p>\n<p>[e]\tnot leave<br \/>\nthe State of Gujarat without prior permission of the Sessions \tJudge<br \/>\nconcerned;\n<\/p>\n<p>[f]\tfurnish the<br \/>\naddress of residence at the time of execution of the \tbond and shall<br \/>\nnot change the residence without prior permission of  this Court;\n<\/p>\n<p>[g]\tsurrender<br \/>\npassport, if any, to the Lower Court immediately.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed,  the Sessions<br \/>\n\tJudge concerned will be free  to take appropriate action in the<br \/>\n\tmatter.\n<\/p>\n<p>At<br \/>\n\tthe trial, the trial court shall not be influenced by the prima<br \/>\n\tfacie observations made by this Court while enlarging the applicant<br \/>\n\ton bail.\n<\/p>\n<p>Bail<br \/>\n\tbefore the Lower Court having jurisdiction to try the case.\n<\/p>\n<p>\tHowever,<br \/>\nfor compliance of the order, S.O. to 23.12.2011.\n<\/p>\n<p>[Anant<br \/>\nS.
