JOSEPH, JJ.\n                         --------------------------------------\n                       W.P.(C)No.4530 of 2008 and\n         R.P.No.557 of 2008 in I.A.Nos.4167 &amp; 4747 of 2008 in\n                         W.P.(C)No.4530 of 2008\n                         -------------------------------------\n                        Dated 25th November, 2008\n\n                                  JUDGMENT\n<\/pre>\n<p>Koshy,J.\n<\/p>\n<p>           This writ petition is filed in public interest contending that<\/p>\n<p>the National Emblem exhibited on the High Court building is not in<\/p>\n<p>accordance with the statutory specifications and to ensure that it is<\/p>\n<p>exhibited in accordance with the law. Even though there was a prayer to<\/p>\n<p>punish the persons concerned, that prayer was deleted subsequently.<\/p>\n<p>Petitioner himself appeared before this court and argued the case<\/p>\n<p>personally. He stated that his only intention is that if there is a mistake,<\/p>\n<p>that should be corrected. The High Court, being a model institution<\/p>\n<p>should exhibit the National Emblem only in the proper manner.           The<\/p>\n<p>major contention is that as per the specification pertaining to the<\/p>\n<p>National Emblem, &#8220;Satyameva Jayate&#8221; should be written in Devanagari<\/p>\n<p>script below the profile of the Lion Capital and that is conspicuously<\/p>\n<p>absent in the emblem exhibited on the High Court building.<\/p>\n<p>           2. Now, we will consider the statutory provisions regarding<\/p>\n<p>the above. The statutory provisions are now codified under the State<\/p>\n<p>Emblem of India (Prohibition of Improper Use) Act, 2005. Section 3 of<\/p>\n<p>the Act provides as follows:\n<\/p>\n<p>W.P.(C)4530\/2008 &amp; R.P.557\/2008     5<\/p>\n<p>                &#8220;3. Prohibition of improper use of<br \/>\n         emblem.- Notwithstanding anything contained in<br \/>\n         any other law for the time being in force, no<br \/>\n         person shall use the emblem or any colourable<br \/>\n         imitation thereof in any manner which tends to<br \/>\n         create an impression that it relates to the<br \/>\n         Government or that it is an official document of<br \/>\n         the Central Government or, as the case may be,<br \/>\n         the State Government, without the previous<br \/>\n         permission of the Central Government or of such<br \/>\n         officer of that Government as may be authorised<br \/>\n         by it in this behalf.&#8221;\n<\/p>\n<p>The section authorises general powers of Central Government to<\/p>\n<p>regulate use of emblem. It also authorises the Central Government to<\/p>\n<p>provide for guidelines for display of the emblem on public buildings in<\/p>\n<p>India, diplomatic missions and on the buildings occupied by India&#8217;s<\/p>\n<p>consulates abroad and also to specify the design of the official seal<\/p>\n<p>consisting of the emblem. Orders relating to State Emblem of India<\/p>\n<p>passed by the Central Government Ministry of         Home Affairs is<\/p>\n<p>produced as Annexure E.        It states that State Emblem has been<\/p>\n<p>adopted by various States including Kerala State.      Paragraph VII<\/p>\n<p>deals with display of the State Emblem on public buildings. Clause<\/p>\n<p>(1) of paragraph VII reads as follows:<\/p>\n<blockquote><p>                 &#8220;(1) The State Emblem may be displayed<br \/>\n           only on very important public buildings like the<br \/>\n           Rashtrapati Bhavan, Raj Bhavans, Raj Niwases,<br \/>\n           Supreme Court, High Courts, Central Secretariat,<br \/>\n           Parliament       House,    State\/Union   Territory<br \/>\n           Secretariats and Legislatures.&#8221;<\/p>\n<blockquote><p>W.P.(C)4530\/2008 &amp; R.P.557\/2008     5<\/p>\n<p>There is a prescription at paragraph XI that the State Emblem shall<\/p>\n<p>not be used for any trade or business. Various directions are given as<\/p>\n<p>to how State Emblem can be depicted on vehicles, stationery etc. by<\/p>\n<p>the constitutional functionaries. With regard to the emblem, Clause<\/p>\n<p>(1), paragraph I of Annexure E order         states how State Emblem<\/p>\n<p>should be depicted. It reads as follows:\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>           &#8220;I-STATE EMBLEM OF INDIA &#8211; DESCRIPTION<br \/>\n                                                AND DESIGN<\/p>\n<p>           (1) The State Emblem of India is an adaptation<br \/>\n           from the Sarnath Museum. The Lion Capital has<br \/>\n           four lions mounted back to back on a circular<br \/>\n           abacus. The frieze of the abacus is adorned with<br \/>\n           sculptures in high relief of an elephant, a<br \/>\n           galloping horse, a bull and a lion separated by<br \/>\n           intervening Dharma Chakras. The abacus rests<br \/>\n           on a bell-shaped lotus.\n<\/p><\/blockquote>\n<blockquote><p>                 The profile of the Lion Capital showing three<br \/>\n           lions mounted on the abacus with a Dharma<br \/>\n           Chakra in the centre, a bull on the right and a<br \/>\n           galloping horse on the left, and outlines of<br \/>\n           Dharma Chakras on the extreme right and left has<br \/>\n           been adopted as the State Emblem of India. The<br \/>\n           bell-shaped lotus has been omitted.\n<\/p><\/blockquote>\n<blockquote><p>                 The motto &#8220;Satyameva Jayate&#8221; &#8211; Truth alone<br \/>\n           triumphs &#8211; written in Devanagari script below the<br \/>\n           profile of the Lion Capital is part of the State<br \/>\n           Emblem of India. The motto is taken from the<br \/>\n           Mundaka Upanishad, an ancient scripture.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>Similarly, in the Schedule to the State Emblem of India (Prohibition<\/p>\n<p>of Improper Use) Act, 2005 also two models are given as Appendix I<\/p>\n<p>and II as follows:\n<\/p><\/blockquote>\n<blockquote><p>W.P.(C)4530\/2008 &amp; R.P.557\/2008     5<\/p>\n<p>In view of section 3 of the Act, even a colourable imitation of the<\/p>\n<p>National Emblem cannot be depicted. In the emblem exhibited on<\/p>\n<p>the High Court building the motto &#8220;Satyameva Jayate&#8221; in Devanagari<\/p>\n<p>script is not inscribed below the profile of the Lion Capital.<\/p><\/blockquote>\n<p>             3. It is true that the emblem as now seen was exhibited<\/p>\n<p>not for any wrongful gain or with any malafide intention but by an<\/p>\n<p>oversight. Therefore, we direct the Registrar General, High Court of<\/p>\n<p>Kerala to make such alterations in the emblem and inscribe<\/p>\n<p>&#8220;Satyameva Jayate&#8221; in Devanagari script below the profile of the Lion<\/p>\n<p>Capital, as prescribed under rules, within three months from the date<\/p>\n<p>of receipt of a copy of this judgment. This court appreciates the effort<\/p>\n<p>made by the petitioner, Sri.Kalarcode Venugopalan Nair in bringing<\/p>\n<p>this matter to the notice of the court. We also appreciate the efforts<\/p>\n<p>taken by Lt.Colonel N.D.Joy (Retd.), a practising advocate of this<\/p>\n<p>court by impleading himself in the case and pointing out the statutory<\/p>\n<p>provisions regarding the matter.     It is submitted that on an interim<\/p>\n<p>application, cost of Rs.10,000\/= was ordered and R.P.No.557 of 2008<\/p>\n<p>was    filed.  Since the petitioner      has pointed out the defects<\/p>\n<p>only in public interest without any malafide intention and has<\/p>\n<p>also deleted     the prayer to prosecute       the officers concerned,<\/p>\n<p>W.P.(C)4530\/2008 &amp; R.P.557\/2008    5<\/p>\n<p>the cost of Rs.10,000\/- imposed on the petitioner is also deleted.<\/p>\n<p>            The writ petition and review petition are allowed.<\/p>\n<p>                                                    J.B.KOSHY<br \/>\n                                                       JUDGE<\/p>\n<p>                                               THOMAS P. The petitioner who filed the writ petition has got<\/p>\n<p>right to apply for deletion of the prayers. The only persons who are<\/p>\n<p>entitled to oppose are the contesting respondents or the court and an<\/p>\n<p>impleaded party cannot question the same as these prayers are not<\/p>\n<p>against the impleaded party. We expressed our views and at the request<\/p>\n<p>of the petitioner the case was adjourned to 2.6.2008. On 2.6.2008<\/p>\n<p>petitioner wanted to get instructions from the client whether they<\/p>\n<p>wish to withdraw the writ petition and at his request the case was<\/p>\n<p>adjourned. Today, it is requested for an adjournment as counsel for<\/p>\n<p>the petitioner is not well. Another petition was also filed for hearing<\/p>\n<p>of R.P.No.557 of 2008. If the writ petition is not maintainable, the<\/p>\n<p>question of hearing impleaded parties also will not arise.
