While discharging his duty, on 14.10.1981, the<br \/>\ndeceased was unfortunately murdered. The legal heirs of the deceased<br \/>\ntherefore, preferred an application being Workmen&#8217;s Compensation<br \/>\nApplication No. 23 of 1986 before the Court of learned Civil Judge<br \/>\n(SD) Amreli.\n<\/p>\n<p>2.2.\t\tThe<br \/>\nlearned trial Judge, after hearing the parties and considering the<br \/>\nevidence on record, allowed the application and granted compensation<br \/>\nto the tune of Rs.21,000 with running interest @ 6% after one month<br \/>\nfrom the date of incident. Hence, this appeal.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nthe learned counsel for the parties. Having perused the record of the<br \/>\ncase, it is clear that the deceased was working as a Watchman and<br \/>\nthat while discharging his duties, he was murdered. Hence, being a<br \/>\nGovernment servant on the regular establishment and  also the fact<br \/>\nthat the deceased is covered under the definition of &#8216;Workman&#8217;, the<br \/>\nimpugned order is just and proper.  Considering the fact that the<br \/>\ndeceased had died during the course of employment, the State ought<br \/>\nnot to have preferred this appeal.  Looking to the smallness of the<br \/>\namount involved, the appeal is required to be dismissed.\n<\/p>\n<p>4.0.\t\tIn<br \/>\nview of the above, the appeal is  dismissed.
