After\nthe  amendment of 1963, the Legislature made  it  obligatory\nupon the trial court to confiscate the vehicle used, but  no\nsuch restriction was placed upon the appellate court;  Under\ns.  47,\t the  appellate court could  pass  orders  regarding\ndisposal  of  property in the same manner 'as  an  appellate\ncourt  under s. 520 Criminal Procedure\tCode,  corresponding\nto  s.\t419 of the Code of 1872. Under s. 520 of  the  Code,\npower  is  conferred upon the appellate court  to  pass\t any\nappropriate order, as may be just, regarding the disposal of\nproperty  used in the commission of any offence.  The  order\nof  the\t Sessions Court in appeal in the  present  case\t was\nessentially  a just order and was rightly confirmed  by\t the\nHigh Court. [626 B--E]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CRIMINAL APPELLATE JURISDICTION: Criminal Appeal No. 195  of<br \/>\n1966.\n<\/p>\n<p>    Appeal  from the judgment and order dated  February\t 25,<br \/>\n1966 of the Andhra Pradesh High Court in Criminal  Revision,<br \/>\nCase No. 382 of 1964.\n<\/p>\n<p>P. Ram Reddy and G.S. Rama Rao, for the appellant.<br \/>\nA.V. Rangam, Miss Sen, A. Vedavalli and Subhashini, for\t the<br \/>\nrespondent.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\n    Shah,  J. Motor Lorry No. A.P.P. 4695 belonging  to\t the<br \/>\nrespondent  Yedla  Perraya was seized by  the  Forest  Range<br \/>\nOfficer,  Gokavaram,  early  in\t the  morning  of   December<br \/>\n25,1963, when it<br \/>\n<span class=\"hidden_text\">624<\/span><br \/>\nwas  being used without a license for carrying,eight  Yegisi<br \/>\nlogs on Rajahmundry-Gokavaram Road.  The driver of the motor<br \/>\nlorry\tand  another  person  were  tried  before  the\t 2nd<br \/>\nAdditional, 2nd Class Magistrate, Rajahmundry on a complaint<br \/>\n&#8216;by the\t Forest\t Range Officer for offences under ss. 35 and<br \/>\n36  of\tthe Andhra Pradesh Forest Act and the  rules  framed<br \/>\nthereunder.    The  two\t accused  admitted  that  they\t had<br \/>\ncommitted  the offence of illicit transportation of  timber,<br \/>\nand  on\t their\tplea  of guilty\t they  were  convicted.\t The<br \/>\nrespondent  applied  to the Trial Magistrate  for  an  order<br \/>\nreleasing  the motor lorry on the plea that the\t offence  of<br \/>\ntransportation of timber was committed without his knowledge<br \/>\nand  that the value of the timber seized was not  more\tthan<br \/>\nRs.  50\/-  at  the relevant time.   The\t learned  Magistrate<br \/>\nobserved:\n<\/p>\n<blockquote><p>\t\t    &#8220;After careful perusal of the deposition<br \/>\n\t      of R.W. 1, I find that there is nothing in  it<br \/>\n\t      to indicate that the petitioner knowingly lent<br \/>\n\t      his lorry for the illicit transport of  timber<br \/>\n\t      on  the  night  of 24-12-63.   There  is\talso<br \/>\n\t      nothing  in the case records to show that\t the<br \/>\n\t      petitioner  allowed  the\tlorry  to  illicitly<br \/>\n\t      transport\t the  timber on the above  date.   1<br \/>\n\t      accordingly hold that the petitioner cannot be<br \/>\n\t      said  to have knowingly allowed his  lorry  to<br \/>\n\t      illicitly transport the timber.&#8221;\n<\/p><\/blockquote>\n<p>But the learned Magistrate was of the view that by s. 43  of<br \/>\nthe Andhra Pradesh Forest Act, where it was proved that\t the<br \/>\nvalue  of the timber transported exceeded Rs. 50\/-,  he\t was<br \/>\nenjoined to direct confiscation of the vehicle in which\t the<br \/>\nforest\tproduce was being transported without a license.  In<br \/>\nhis  view the value of eight logs of timber seized from\t the<br \/>\nlorry was Rs. 311\/- at the market rate in Rajahmundry.<br \/>\n    In\tappeal by the respondent to the Court of Session  at<br \/>\nRajahmundry the order of confiscation was set aside and\t the<br \/>\nHigh  Court  of Andhra Pradesh confirmed the  order  of\t the<br \/>\nCourt  of Session. The State of Andhra Pradesh has  appealed<br \/>\nto this Court with certificate. granted under Art. 134( 1  )\n<\/p>\n<p>(c) of the Constitution.\n<\/p>\n<p>    The\t Andhra Pradesh (Andhra Area) Forest Act 5  of\t1882<br \/>\nprovides by s. 41 that when there is reason to believe\tthat<br \/>\na  forest  offence  has been committed\tin  respect  of\t any<br \/>\ntimber\tor forest produce, such timber or produce,  together<br \/>\nwith  all tools, ropes, chains, boats, vehicles\t and  cattle<br \/>\nused  in  committing any such offence may be seized  by\t any<br \/>\nForest\tofficer or Police officer. Section 43 as amended  by<br \/>\nAct 11 of 1963 provides:\n<\/p>\n<blockquote><p>\t\t     &#8220;Where  a\tperson is convicted  of\t any<br \/>\n\t      forest offence, the Court sentencing him shall<br \/>\n\t      order ,confiscation. to the Government of, the<br \/>\n\t      timber  or the&#8217; forest produce in\t respect  of<br \/>\n\t      which  such &#8216;offence was committed,  and\talso<br \/>\n\t      any<br \/>\n<span class=\"hidden_text\">\t\t    625<\/span><br \/>\n\t      tool,  boat, cattle and vehicle and any  other<br \/>\n\t      article used in committing such offence:<br \/>\n\t\t     Provided that it shall be open to\tsuch<br \/>\n\t      Court  not to order confiscation of any  tool,<br \/>\n\t      boat,  cattle,  vehicle or any  other  article<br \/>\n\t      used in committing such offence when the value<br \/>\n\t      of the timber or the forest produce in respect<br \/>\n\t      of  which such offence was committed does\t not<br \/>\n\t      exceed fifty rupees.&#8221;\n<\/p><\/blockquote>\n<p>It may be observed that before the Forest Act was amended by<br \/>\nAct  11\t of 1963, the Magistrate was not obliged  to  direct<br \/>\nconfiscation  of the articles, vehicles, cattle,  tools\t  or<br \/>\nboats used for committing a forest offence.<br \/>\n    The\t Trial\tMagistrate was of the view  that  after\t the<br \/>\namendment  of  the Forest Act by Act 11 of 1963\t he  had  no<br \/>\noption\tand  he was bound on conviction of the\toffender  in<br \/>\nrespect of  any forest offence to direct confiscation of the<br \/>\nvehicle used in the commission of such offence.\t Counsel for<br \/>\nthe  respondent contended that if the interpretation put  by<br \/>\nthe  Trial Magistrate upon s. 43 as amended is correct,\t the<br \/>\nenactment  imposes  an\tunreasonable  restriction  upon\t the<br \/>\nfundamental  right&#8217; of the owner of the vehicle declared  by<br \/>\nArt.  19(1)(e) of the Constitution, and is on  that  account<br \/>\nvoid.\tCounsel\t urged that a statute which imposes  upon  a<br \/>\nperson\twho  has  himself  not\tcommitted  any\toffence\t  or<br \/>\ninfraction  of\tthe law liability to  forfeit  his  valuable<br \/>\nproperty  must\tbe regarded as unreasonable.  It  was  urged<br \/>\nthat if a vehicle is stolen and then used for commission  of<br \/>\na  forest  offence,  or is borrowed by\tsome  person  for  a<br \/>\nlegitimate  purpose  and then used without  the\t consent  or<br \/>\nknowledge  of the owner for committing an offence under\t the<br \/>\nForest Act, or where with a view to involve the owner of the<br \/>\nvehicle\t  into\t a  forest  offence,   forest\tproduce\t  is<br \/>\nsurreptitiously\t introduced  into  the\t vehicle,  and\t the<br \/>\nvehicle\t is liable to be forfeited, the provision making  it<br \/>\nobligatory  to\timpose\tthe penalty  of\t forfeiture  of\t the<br \/>\nvehicle\t  must\tbe  deemed  to\timpose\t  an\tunreasonable<br \/>\nrestriction  on the owner of the vehicle and is ultra  rites<br \/>\non  that  account.  It is not necessary for the\t purpose  of<br \/>\nthis  case to express any opinion on that part of the  case.<br \/>\nAssuming  that the statute which enjoins the  Magistrate  to<br \/>\nconfiscate the vehicle used in the commission of the  forest<br \/>\noffence,  even\twhen  it is used without  the  knowledge  or<br \/>\nconsent\t of the owner, is valid, in our judgment, s.  47  of<br \/>\nthe  Act enables the Court of Session and the High Court  to<br \/>\nmake an appropriate order with regard  to  the vehicle which<br \/>\nis just.  That section provides:\n<\/p>\n<blockquote><p>\t\t    &#8220;Any person claiming to be interested in<br \/>\n\t      property seized under section 41, may,  within<br \/>\n\t      one  month from the date of any  order  passed<br \/>\n\t      under section 43, 44 or<br \/>\n<span class=\"hidden_text\">\t      626<\/span><br \/>\n\t      45,  present an appeal therefrom which may  be<br \/>\n\t      disposed of in the manner provided by  section<br \/>\n\t      419  Code\t of Criminal Procedure.&#8221;\n<\/p><\/blockquote>\n<p>The reference to s. 419 is to the Code of Criminal Procedure<br \/>\nof  1872  in force when the Andhra Pradesh Forest Act  5  of<br \/>\n1882  was enacted.  Section 419 of the Code of 1872  is\t now<br \/>\nsubstituted  by\t s. 520 of the Code of\tCriminal  Procedure,<br \/>\n1898, and by s. 520 power is conferred, inter alia, upon the<br \/>\ncourt  of appeal to direct that any order passed  under\t ss.<br \/>\n517,  518  or 519 by a Court subordinate thereto  be  stayed<br \/>\npending consideration by the Court of appeal, and that Court<br \/>\nmay  modify, alter or annul such order and make any  further<br \/>\norder that may be just\tSection 43   of\t the Andhra  Pradesh<br \/>\nForest\tAct does not restrict the power\t of   the  appellate<br \/>\ncourt  to  pass\t any appropriate order\tas  may\t   be\tjust<br \/>\nregarding disposal of the property.  The Court of Session in<br \/>\nthe  present  case  has\t on  the  finding  recorded  by\t the<br \/>\nMagistrate  and\t confirmed by it passed an  order  which  is<br \/>\nessentially a just order and that has been confirmed by\t the<br \/>\nHigh Court.\n<\/p>\n<p>The Legislature had originally conferred a  discretion\tboth<br \/>\nupon  the  Magistrate  and  the\t Court\tof  Appeal  to\tpass<br \/>\nappropriate  order with regard to the disposal\tof  property<br \/>\nused  in the commission of the offence as may be just.\t The<br \/>\nLegislature  has thereafter amended s. 43 by Act 11 of\t1963<br \/>\nand made it obligatory upon the Magistrate to confiscate the<br \/>\nproperty  or  the  vehicle used in the\tcommission  of\tSuch<br \/>\noffence.  No such restriction has, however, been placed upon<br \/>\nthe  power  of\tthe  appellate court  and  we  will  not  be<br \/>\njustified,  having  regard to the clear\t expression  of\t the<br \/>\nlegislative  intent, that the power is to be limited in\t the<br \/>\nmanner provided by s. 43.  There is no warrant for  implying<br \/>\nthat  the  power  conferred by s. 47 of\t the  Act  upon\t the<br \/>\nappellate court is subject to some unexpressed limitation.<br \/>\n    The\t High Court was, therefore, right in  holding\tthat<br \/>\nthe motor lorry belonging to the respondent, on the  finding<br \/>\nrecorded by the Magistrate was not liable to be confiscated.<br \/>\nThe appeal therefore fails and is dismissed.\n<\/p>\n<pre>V.P.S,\t\t\t\t\t   Appeal dismissed.\n<span class=\"hidden_text\">627<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India State Of Andhra Pradesh vs Yedla Perraya on 4 November, 1968 Equivalent citations: 1970 AIR 718, 1969 SCR (2) 623 Author: S C.
