Reliancei  decision of the Madras\nHigh C_0u_rt e of 'SR1 SRINIVASMURTHY\n\nMANDIRAML *uVs.V\" _1l'\/IRS;:'d\"'\\.\u00bbt.'GlVANASOUNDARI' AIR 2004\n\n  the plaintiff had filed a suit for\n\ndeciaration'\u00abthat the defendants were trespassers. The\n\n filed the suit more or less admitting\n\n{the titleylof the plaintiff but claiming leasehold rights over\n\n \"..fthe'tisite.\" After filing of the written statement, the first\n\ndefendant had sought to file an additional written\n\n statement and the same was allowed. The plaintiff had\n\n3:\n\n \n\n\n\n10\n\nthen draw attention to the provisions of Order VIII Rule 9\nof CPC itself to demonstrate that it does not contemplate\n\nany pleadings being \ufb01led subsequent to \n\nstatement and it is only the court which   \n\npower to call for any additional writt\u00bben'staten1en:t;-- _  \n\n13. It was however open for \"petitioner\"'lto' have sought\n\nfor amendment of pleadnags   court in\nthe case of *MoHAMMi3:l0   vs. SMT.\nKHUYEJATUL    2001 KAR 4580\nwherein   'partition and separate\npossessionlfl if \ufb01led their written\nstatement They had taken the\n\ncontention that the sale in favour of the plaintiffs by the\n\n vwas not valid and legal and it does not\n\nhindthe\"V4other':;'d'efendants. Secondly they claimed a pre-\n\nf if _emptive to purchase one-fourth share from the first\n\nif and when the plaintiffs purchased the one-\n\n.l_Ai\u00e9'fo\"urthfflshare in contravention of the preemptive right, no\n\n passed to them. Further, the sale transaction in\n\nl favour of the plaintiffs is collusive and a sham transaction\n\n3\n\n\n\n11\n\nand that title did not pass. There is a total prohibition for pleading\nnew claims and inconsistent statements by any\"-.other\n\nmode except by way of amendment to the \n\nstatement. Though subsequent pleadings   \n\nunder Order VIII Rule 9 of CPC,  \n\nuse for raising pleas which are'..paltog\u20act}\\1\u20acr'p' \"nevyj \n\ninconsistent with the engin:a1.l:'l'jpieadtnge \" written\nstatement. Order VI  'with a departure\nfrom the previotis :v'Vl'3tule 17 of CPC\ndeals with    and Order VIII\nRule 9  deiais   pleadings. VVhen\nthese  'together, the distinction\n\nbecomes  is clear by way of subsequent\n\n galea\ufb01ngsilwiunderiiOrtier'VIII Rule 9 of CPC new claims and\n\nV'=ir1consis'te_r1t.\"pleas cannot be raised and for raising such\n\n  resort to Order V1 Rule 1'?' of CPC.\n\n  above contentions, the plea sought to be\n[by way of additionai Written statement is certainly\n\" --\u00ab:VVlii1consistent with the pleadings in the written statement\n\n4' \ufb01led by the second respondent herein, on the face of it.<\/pre>\n

adopt the View of this court in <\/p>\n

pleas being taken in terms of Order   of <\/p>\n
