P918 is the Inves\ufb01gsiiin\ufb01 registered the<br \/>\ncase and went to the_:sp__ot  and rough<br \/>\nsketch and eondoeted&#8217;   Motor Vehicle<\/p>\n<p>Inspector.  &#8221; .i N <\/p>\n<p>6.  evide:ieeiVof to 4 it is clear that, they<br \/>\nwere travelling  the   e-fibers states that, the lony was<br \/>\nmov\ufb01ig  speed}  had prepared the mahazar and<\/p>\n<p>a1so&#8211;..theire1igh__Vs1&lt;eteh.._The rough sketch is marked as Ex.P11.<\/p>\n<p> F0111  ioudh  it appears that, the lorry was moving<br \/>\nVV&#039;uf__&quot;I&#039;(:VvI11V Mangalore and the accident had taken<br \/>\n  side. The accident spot is about 18 ft. from the<\/p>\n<p> {he  and it shows that. the scooter was coming from<\/p>\n<p>  e  I V _  towards Bangalore and it was on its left s\ufb02e. The<\/p>\n<p> had gone to the right side and toppled on the ex\ufb01eme right<\/p>\n<p>side and rider of the bike had fallen on the extreme right side of<\/p>\n<p>the accident spot.\n<\/p>\n<\/p>\n<p>7. Learned counsel for the petitioner submitted that, 50 ft.<\/p>\n<p>brake marks are shown which appears from rough sketch. Iftlie<\/p>\n<p>lorry was moving on the right side, there was no teasotavtef  <\/p>\n<p>brake on the left side. He also states that, the evideiiee it  _  <\/p>\n<p>to 4 do not support the ease of the pmsc:&#8217;-\ufb01itien ._ai1_d  he <\/p>\n<p>consistency in their evidence. He else   the <\/p>\n<p>was moving in a vexy moderate speeii\u00bb. the &#8216;ace used Wasllnot<\/p>\n<p>negligent in driving the vehicle&#8221;. <\/p>\n<p>8. Learned Goverement  judgments<\/p>\n<p>of both the Courts beleit\u00e9figltt &#8216;V . <\/p>\n<p>9. It is net.    4 were travelling in<br \/>\nthe Iony. No Zsgiggestieiit is they were not travelling in<br \/>\nthe lorry. They    All these Witnesses have<br \/>\nstated that,_\u00a7;theeAlon*5l(* :Ii10&#8217;E!l\ufb02g in a high speed. This is evident<\/p>\n<p>  and also sketclz-.&#8211; Ex.P1I. The<\/p>\n<p> accused &#8220;the seeeci was not able to central the<br \/>\n and had giaslcied against the scooter and toppied. if really<br \/>\ni it *s.e&#8221;c:used had seen some object and was trying to avoid the<\/p>\n<p> wouid have explained in 313 statement. Hut, 313<\/p>\n<p> is one ef total denial. PWs.1 to 4 being the<\/p>\n<p> \u00ab:..e-yewimesees and the PW8 being the Police O\ufb01eer, who has<\/p>\n<p>i piepared the mahazar and also the sketch, it clearly shows; the<\/p>\n<p>negligence of the accused.\n<\/p>\n<\/p>\n<p>10. Looking into the evidence, I do not \ufb01nd there is any<br \/>\nermr committed by both the Courts below. In slash<br \/>\ncircumstances, this being revision, when there is clear<br \/>\nof four Witnesses with regards to rash and ncgligeig\u00e9:   &#8216; 1\/<br \/>\ncoupled with mahazar am the sketc1v1,~A\u00bbI&#8230;d&#8217;o<br \/>\njusti\ufb01cation to interfem with the judgm\u00e9nt 7-:<br \/>\nbelow.
