SATHASIVAM\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>CRIMINAL APPEAL NO.              OF 2008<br \/>\n(Arising out of SLP (Crl.) No.2892 of 2007)<\/p>\n<p>Dr. ARIJIT PASAYAT, J.\n<\/p>\n<p>1.\tLeave granted.\n<\/p>\n<p>2.\tChallenge in this appeal is to the order passed by a<br \/>\nlearned Single Judge of the Patna High Court quashing the<br \/>\norder passed by learned Additional District Judge, Fast Track<br \/>\nCourt Vth, Shekhpura. By the said order the learned<br \/>\nAdditional Sessions Judge held that respondent No.2-Munna<br \/>\nKumar was not juvenile and, therefore, there was no need to<br \/>\nrefer his case to the Juvenile Justice Board for ascertaining of<br \/>\nhis age and, then for trial. It was observed by the High Court<br \/>\nthat the prayer was rejected only on the ground that two or<br \/>\nthree witnesses were examined and though the accused was in<br \/>\npossession of School Leaving Certificate, mark sheet etc. to<br \/>\nshow that he was a juvenile, the prayer could not have been<br \/>\nrejected.  The High Court in a very cryptic manner observed<br \/>\nthat the application of the accused deserved to be allowed and<br \/>\ndirected the court below to consider the accused as a juvenile<br \/>\nand to proceed accordingly.\n<\/p>\n<p>3.\tLearned counsel for the informant submitted that the<br \/>\ndocuments produced had been analysed by the trial Court and<br \/>\nit was categorically held that at the time of framing charge on<br \/>\nobservation it was noticed that he was major without any<br \/>\ndoubt. In the certificate filed his name was disclosed to be<br \/>\nPriyatam Bihari though all through his name was stated to be<br \/>\nMunna Kumar. Learned Single Judge of the High Court did<br \/>\nnot even consider as to how the conclusions of the trial Court<br \/>\nsuffered from any infirmity. Merely referring to the stand of the<br \/>\naccused and even without analyzing the correctness or<br \/>\notherwise of the observations and conclusions made by the<br \/>\ntrial Court he came to hold that the accused was a juvenile.<br \/>\nAdditionally, the complainant was a party before the High<br \/>\nCourt but no notice was issued. There is no appearance on<br \/>\nbehalf of respondent No.2-accused.\n<\/p>\n<p>4.\tLearned counsel for the State supported the stand of the<br \/>\ninformant.\n<\/p>\n<p>5.\tThe High Court has failed to notice several relevant<br \/>\nfactors.  Firstly, at the time of framing charges, the age of the<br \/>\naccused was recorded as major.  Similarly, the difference in<br \/>\nnames in the documents has not been explained by the<br \/>\naccused.\n<\/p>\n<p>6.\tFurther, as rightly contended by learned counsel for<br \/>\nappellant, no discussion has been made as to how the<br \/>\nconclusions of the trial Court suffered from any infirmity.\n<\/p>\n<p>7.\tFinally, no notice was issued to the appellant before the<br \/>\nmater was disposed of.\n<\/p>\n<p>8.\tAbove being the position, the impugned order of the High<br \/>\nCourt is set aside and the matter is remitted to it to consider<br \/>\nthe matter afresh and pass a reasoned order in accordance<br \/>\nwith law.\n<\/p>\n<p>9.\tThe appeal is allowed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Arun Kumar vs The State Of Bihar And Anr on 19 February, 2008 Author: .
