The petitioner is the<\/p>\n<p>President of a co-operative society. He is challenging Ext.P4 award<\/p>\n<p>passed by the Tribunal in that I.D.\n<\/p>\n<p>     2.    The issue referred for adjudication was:\n<\/p>\n<p>           &#8220;Whether    the   following nine  employees   are eligible for<br \/>\n     reinstatement in service.\n<\/p>\n<p>           (1)   T.Rajendrakumar, Santhinilayam,<br \/>\n                 Maruthenkuzhy, Thiruvananthapuram.\n<\/p>\n<p>           (2)   P.K.Shajan, Raheela Manzhil, Kumarapuram,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (3)   S.Mohandas, T.C.10\/556, Peroorkada P.O.,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (4)   Mohanakumar, Thazhathuvila Veedu,<br \/>\n                 Chengal, Thiruvananthapuram.\n<\/p>\n<p>           (5)   S.Pradeepan, Plavila Veedu, Venniyoor,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (6)   Sunilkumar, Sunil Nivas, Goureesapattom,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (7)   Radhikakumari, Ponnu Nivas, Mettukada,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (8)   Sreekala, K.P.No.8\/38, Kudappanakkunnu,<br \/>\n                 Thiruvananthapuram.\n<\/p>\n<p>           (9)   Deepa.S.Nair, Sukumara Bhavan, Pottayil,<br \/>\n                 Thiruvananthapuram.&#8221;\n<\/p>\n<p><span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>      3.    Out of the nine employees involved, only two employees<\/p>\n<p>actively participated in the dispute. Therefore, the Tribunal considered<\/p>\n<p>their case only in the dispute. The Tribunal came to the conclusion that<\/p>\n<p>those two employees were illegally terminated from service. On that<\/p>\n<p>finding, the Tribunal, by the impugned award, directed the petitioner-<\/p>\n<p>management to reinstate the two workers with continuity of service<\/p>\n<p>within three months from the notification of the award without<\/p>\n<p>backwages. That award is under challenge in this writ petition.<\/p>\n<p>      4.    The petitioner raises three contentions. The first is that the<\/p>\n<p>employees were not regularly appointed and, therefore, they have no<\/p>\n<p>right to be reinstated in service. The second is that as is evidenced by<\/p>\n<p>Exts.M1 and W1 marked in the Industrial Dispute, the workers were<\/p>\n<p>engaged as temporary workers and by the award, the workers have<\/p>\n<p>been directed to be regualarised in service, which is patently illegal.<\/p>\n<p>The third is that the workers have not sufficiently proved that they<\/p>\n<p>have completed 240 days in an year so as to become entitled to the<\/p>\n<p>benefits under the Industrial Disputes Act.<\/p>\n<p>      5.    I have considered the contentions of the petitioner.<\/p>\n<p>      6.    Regarding the first contention of the management, the<\/p>\n<p>management witnesses themselves admitted before the Tribunal that<\/p>\n<p>the appointments were made from among the names forwarded by the<\/p>\n<p>State Co-operative Union, which is the mode prescribed by the<\/p>\n<p><span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>Government for filling up temporary vacancies. Therefore,             the<\/p>\n<p>petitioner cannot be heard to contend that the workers were not<\/p>\n<p>appointed legally. Regarding the second contention to the effect that<\/p>\n<p>temporary employees are not entitled to the benefits of the Industrial<\/p>\n<p>Disputes Act, the benefits of the Industrial Disputes Act are applicale to<\/p>\n<p>&#8216;workmen&#8217; as defined under the Act whether temporary or on daily<\/p>\n<p>wages or permanent. That being so, because the workers are<\/p>\n<p>temporary workers, they cannot be denied the benefits of the<\/p>\n<p>Industrial Disputes Act provided the conditions in the Act are satisfied.<\/p>\n<p>Further, the management witnesses themselves admitted before the<\/p>\n<p>Tribunal that the workers were doing the day to day work of the<\/p>\n<p>society and since the permanent workers are not sufficient, at least 4<\/p>\n<p>more employees are necessary to do the day to day work of the<\/p>\n<p>society. That being so, I am not inclined to countenance the contention<\/p>\n<p>of the petitioner that the work done by the workmen in question is<\/p>\n<p>temporary in nature. Regarding the last contention, the workmen have<\/p>\n<p>gone to the box and deposed that they have completed 240 days work<\/p>\n<p>in an year. They had sought production of the records kept by the<\/p>\n<p>society for five years to further prove their contention. However, the<\/p>\n<p>management produced records only for two months viz., May, 1998<\/p>\n<p>and June 1998 instead of five years, for which the reason given by the<\/p>\n<p>management is that remaining books are with the Vigilance<\/p>\n<p><span class=\"hidden_text\">                                         4<\/span><\/p>\n<p>Department in connection with the case of WW2. The very same<\/p>\n<p>witness admitted before the Tribunal in the cross examination that in<\/p>\n<p>respect of the two workers involved, there were absolutely no<\/p>\n<p>allegations whatsoever. It is also admitted that the society has no<\/p>\n<p>complaints against them. Apart from that, the question as to whether<\/p>\n<p>the workers completed 240 days in an year is a question of fact, which<\/p>\n<p>has been decided in favour of the workmen by the Tribunal. This Court<\/p>\n<p>cannot overturn that finding unless the same is perverse. I do not find<\/p>\n<p>anything perverse in the finding of the Tribunal. Lastly, the petitioner<\/p>\n<p>would contend that the Tribunal has directed regularisation of the<\/p>\n<p>services of the two workmen, which is not permissible in law. I do not<\/p>\n<p>find even the word &#8220;regularisation&#8221; in the award. What has been stated<\/p>\n<p>in the award is as follows:\n<\/p>\n<blockquote><p>            &#8220;In the result I hold that Sri.Sunil Kumar and Smt.Deepa.S.Nair<br \/>\n      are entitled to reinstatement in the establishment of management with<br \/>\n      continuity of service.
