This review petition is barred by limitation,\nso applicant has filed an application I.A.No.6986\/11 seeking\ncondonation of delay in filing this review petition. On notice,\nrespondent though served but has not appeared though a counsel<\/pre>\n<p>has been engaged by him.\n<\/p>\n<p>      After hearing the learned counsel for applicants, we allow<br \/>\nI.A.NO.6986\/11 and condone the delay in filing this review<br \/>\npetition. I.A.NO.6986\/11 is disposed of.\n<\/p>\n<p>      Heard on admission.\n<\/p>\n<p>      The contentions of the applicants are two fold, first, that an<br \/>\napplication was moved by the applicants for compliance of third<br \/>\nproviso of Section 30 of the Act and without considering the<br \/>\napplication, appeal of applicants was dismissed and second, that<br \/>\nthe respondent was not an employee of the applicants and in fact<br \/>\nhe was the employee of Inder Singh and Raghunath who had<br \/>\ntaken contract to reap and thresh the crop.\n<\/p>\n<p>      From the perusal of the award dated 12.4.2010, it is<br \/>\napparent that the respondent suffered injury and his right hand<br \/>\nnear elbow was chopped at the time of threshing the crop. The<br \/>\nLabour Court allowed a compensation of Rs.2,66,855\/- alongwith<br \/>\ninterest to him. So far as plea of the applicants that respondent<br \/>\nwas an employee of Raghunath and Inder Singh is concerned, it<br \/>\nwas considered by the Labour Court while deciding the matter and<br \/>\nfound that their statements were not of credence. The Labour<br \/>\n<span class=\"hidden_text\">                                                                          2<\/span><\/p>\n<p>                       R.P.No.281\/11<\/p>\n<p>     Ummed Singh &amp; another                                   Pannalal<\/p>\n<p>     23.9.2011<br \/>\n     Court on the contrary recorded a finding that respondent was<br \/>\n     engaged by the applicants.\n<\/p>\n<p>            Though aforesaid persons appeared before the Labour<br \/>\n     Court and deposed in favour of the applicants, but the Labour<br \/>\n     Court found that earlier they submitted affidavit on behalf of<br \/>\n     respondent, but subsequently they had not appeared and were<br \/>\n     examined by the applicants. Apart from this, appeal was<br \/>\n     dismissed on the ground of non-compliance of third proviso to<br \/>\n     section 30 of the Act. Even if such application was filed by the<br \/>\n     applicants to grant time to deposit the statutory amount, even then<br \/>\n     it was duty of the applicants to press the application at the time of<br \/>\n     hearing. From the perusal of the order dated 23.8.2010, it is<br \/>\n     apparent that such application was not pressed at the time of<br \/>\n     hearing. In the review jurisdiction, we cannot examine the fact<br \/>\n     which was not raised and pressed before the learned Single<br \/>\n     Judge.
