Respondent is the plaintiff.  Respondent<\/p>\n<p>instituted   the   suit   seeking   a   decree   for   permanent   prohibitory<\/p>\n<p>injunction   contending   that   plaint   schedule   property   is   in   her<\/p>\n<p>possession   and   respondent   is   attempting   to   trespass   into   the<\/p>\n<p>property   and   he   has   no   right   to   do   so.   The   case   of   respondent<\/p>\n<p>was  that   she   obtained   possession   of   the   property   under   Ext.A2<\/p>\n<p>gift   deed   and   thereafter   she   obtained   purchase   certificate   in<\/p>\n<p>respect   of   the   property   as   per   order   in   O.A.13107   of   1976   of<\/p>\n<p>Land   Tribunal,   Ottapalam   and     appellant   has   no   right   or<\/p>\n<p>possession over the same.  Appellant resisted the suit contending<\/p>\n<p>that Ext.A2 gift deed was not acted upon and respondent did not<\/p>\n<p>obtain   possession   of   the   property   and   the   purchase   certificate<\/p>\n<p>obtained   on   the   strength   of   the   gift   deed   is   invalid   and<\/p>\n<p>respondent is not in possession of the property and therefore she<\/p>\n<p>is not entitled to the decree for injunction sought for.<\/p>\n<p>      2.    Learned   Munsiff   framed   three   issues.   Firstly,   whether<\/p>\n<p>respondent   is   in   possession   of   the   plaint   schedule   property,<\/p>\n<p><span class=\"hidden_text\">RSA 334\/2007                           2<\/span><\/p>\n<p>secondly   whether   respondent   is   entitled   to   the   decree   for<\/p>\n<p>permanent   prohibitory   injunction   sought   for   and   thirdly,   reliefs<\/p>\n<p>and costs.  On the evidence of PWs 1 to 3, Dws 1 to 3, and Ext.A1<\/p>\n<p>to A5, it was that respondent  has established  her  possession  of<\/p>\n<p>plaint   schedule  property.    A   decree   for   injunction  was  granted.<\/p>\n<p>Appellant   challenged   the   decree   and   judgment   before   District<\/p>\n<p>Court,   Palakkad   in   A.S.9   of   2003.     Learned   Additional   District<\/p>\n<p>Judge,  on   reappreciation   of  evidence,  confirmed  the   findings   of<\/p>\n<p>learned Munsiff and dismissed the appeal. It is challenged in the<\/p>\n<p>second appeal.\n<\/p>\n<\/p>\n<p>      3. Learned counsel appearing for appellant was heard.  The<\/p>\n<p>argument   of   the   learned   counsel   is   that   courts   below   did   not<\/p>\n<p>properly   appreciate   the   evidence   and   appreciation   of   evidence<\/p>\n<p>was perverse.  It was argued that Ext.A2 gift deed was not acted<\/p>\n<p>upon and pursuant to Ext.A2, possession of the property covered<\/p>\n<p>by   Ext.A2   was   not   obtained   by   respondent   and   in   such<\/p>\n<p>circumstances, courts below should not have granted the decree<\/p>\n<p>sought   for.     Learned   counsel   also   argued   that   the   fact   that<\/p>\n<p>respondent has filed an application for appointment of Receiver<\/p>\n<p>before   the   trial   court   establish   that   respondent   is   not   in<\/p>\n<p>possession of the property and in such circumstances, the decree<\/p>\n<p><span class=\"hidden_text\">RSA 334\/2007                             3<\/span><\/p>\n<p>granted is unsustainable.\n<\/p>\n<\/p>\n<p>      4.     On   hearing   the   learned   counsel,   I   do   not   find   any<\/p>\n<p>substantial   question   of  law  involved   in   the   appeal.  Being   a  suit<\/p>\n<p>for injunction, the only question is with regard to the possession.<\/p>\n<p>The   question   of   title   was   not   decided   by   the   courts   below.<\/p>\n<p>Learned   Munsiff,   who   had   the   advantage   of   seeing   and<\/p>\n<p>appreciating the demeanour of witnesses, accepted the evidence<\/p>\n<p>of respondent with regard to factum of possession and found that<\/p>\n<p>respondent   has   been   in   possession   of   the   property.     First<\/p>\n<p>appellate court, on reappreciation of evidence accepted the same<\/p>\n<p>and   found   that   respondent   has   been   in   possession   of   the<\/p>\n<p>property. The argument of learned counsel is that as respondent<\/p>\n<p>was not examined and instead her son was examined and courts<\/p>\n<p>below should not have accepted that evidence as that of plaintiff.<\/p>\n<p>Reliance was placed on the decision of the Apex Court in  <a href=\"\/doc\/888686\/\">Janki<\/p>\n<p>Vashdeo V. Indusind Bank<\/a> (2005(2)KLT 265).\n<\/p>\n<\/p>\n<p>      5.     Being   a   suit   for   injunction,   what   is   to   be   proved   by<\/p>\n<p>respondent is only factum of possession.  That possession can be<\/p>\n<p>proved by the son of respondent, who was examined on behalf of<\/p>\n<p>the   respondent.     What   was   considered   by   Apex   court   in  Janki<\/p>\n<p>Vashdeo&#8217;s  case(supra)  was  only  the   competency   of   a  Power   of<\/p>\n<p><span class=\"hidden_text\">RSA 334\/2007                            4<\/span><\/p>\n<p>Attorney   to   give   evidence   for   plaintiff.     That   decision   does   not<\/p>\n<p>hold that son of a plaintiff who has knowledge about  the factum<\/p>\n<p>of   possession   is   incompetent   to   give   evidence   on   that   fact.   On<\/p>\n<p>going   through   the   judgments   of   courts   below,   I   cannot   accept<\/p>\n<p>the submission of learned counsel that appreciation of evidence<\/p>\n<p>was   perverse   warranting   reappreciation   of   evidence   and<\/p>\n<p>substituting   the  findings  of this  court  to  the  concurrent  finding<\/p>\n<p>of courts below.\n<\/p>\n<\/p>\n<p>         Appeal is dismissed in limine.\n<\/p>\n<\/p>\n<p>                                  M.SASIDHARAN NAMBIAR, JUDGE<\/p>\n<p>lgk\/-\n<\/p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court K.T.Mohanan vs Damyanthi on 24 October, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM RSA No. 334 of 2007() 1.
