S.J. MUKHOPADHAYA)<\/p>\n<p>\tThis<br \/>\nwrit petition has been preferred by the petitioner, a student of<br \/>\nM.Sc. (Botany)  against the order dated 31.8.2010 passed by the<br \/>\nrespondent &#8211; Saurashtra University whereby the petitioner is<br \/>\ndebarred from appearing in the present examination and also one<br \/>\nfuture examination.  It will be evident from the impugned order dated<br \/>\n31.8.2010 that a large number of students were debarred from the<br \/>\npresent examination and future examination.  In some other case, one<br \/>\nsuch student moved challenging the similar order and a Division Bench<br \/>\nof this Court noticed that the chits recovered from the students on<br \/>\nthe date of the examination were not related to the subject<br \/>\nconcerned.  In most of the cases, chits were lying beneath the bench<br \/>\nand were recovered in presence of the students from the bench or<br \/>\nbeneath the bench.  Taking into consideration the aforesaid facts,<br \/>\nthe Division Bench by common judgment dated 11.10.2010 passed in<br \/>\nSpecial Civil Application No. 11288 of 2010 and analogous case, set<br \/>\naside that part of the impugned order dated 31.8.2010 so far as those<br \/>\nstudents were concerned as the chits do not relate to the examination<br \/>\nin question.\n<\/p>\n<p>2.\tas<br \/>\nthe same order was also under challenge and the petitioner alleged<br \/>\nthe action on the part of the respondents illegal, this Court<br \/>\ndirected the University to produce the chits alleged to have been<br \/>\nobtained from the petitioner.  On 11.1.2011, the Court noticed that<br \/>\nthere was no answer written in the said chit except some of the<br \/>\nprobable questions which read as follows :-\n<\/p>\n<p>&#8220;1.\tDescribe<br \/>\nallosteric regoration.  What is the difference between allosteric<br \/>\ninhibitor &amp; activator.\n<\/p>\n<p>2.\tWhat<br \/>\nare major functioning of carbonitrate metabolism.\n<\/p>\n<p>3.\tWhat<br \/>\nis feed back inhibition.  Describe with suitable example.\n<\/p>\n<p>4.\tWhat<br \/>\nis genconeogenesis.  add a note on it&#8217;s importance&#8221;\n<\/p>\n<p>3.\tTaking<br \/>\ninto consideration the aforesaid fact that no question-answer was<br \/>\nrecovered from the person of the petitioner, and it is also not clear<br \/>\nthat the probable questions were related to the subject or not, the<br \/>\ncounsel for the University was allowed time to obtain instructions.\n<\/p>\n<p>4.\tOn<br \/>\ninstructions, the counsel for the University would contend that the<br \/>\nchit having recovered, as per the Rules, it was open to the Committee<br \/>\nto pass penal order which was passed in the case of the petitioner<br \/>\nand others, but we are not inclined to accept such submission, as the<br \/>\nimpugned order shows non-application of mind on the part of the<br \/>\nrespondent which has not taken into consideration whether the chit<br \/>\ncontained any answer to the subject concerned or any relationship<br \/>\nwith the subject matter of which the student could have taken undue<br \/>\nadvantage.  Even if it is presumed that a chit has been recovered,<br \/>\nthe students were asked not to come out with any other material<br \/>\nexcept pen, pencil, etc.  In that case also, we find that the quantum<br \/>\nof punishment is disproportionate to the gravity of the allegation,<br \/>\nno answer sheet having recovered from the petitioner.  For the<br \/>\nreasons aforesaid, while we set aside the impugned order dated<br \/>\n31.8.2010 so far as it relates to the petitioner, direct the<br \/>\nrespondents to allow the petitioner to appear in both the 3rd<br \/>\nand 4th semester examinations scheduled to be held in near<br \/>\nfuture and publish the results of the same.  So far as the earlier<br \/>\nexamination is concerned as the chit alleged to have been found from<br \/>\nthe person of the petitioner, the same shall stand cancelled.\n<\/p>\n<p>5.\tThe<br \/>\nwrit petition stands disposed of with the aforesaid observations and<br \/>\ndirections.
