TRIPATHI, INSPECTOR, OF POLICE CUM OFFICER-IN-\n               CHARGE      BRAHMPURA,        P.S.-    BRAHMPURA, DISTT-\n               MUZAFFARPUR.\n                                          -----------\n<\/pre>\n<p>3   01.10.2010               Heard both sides.\n<\/p>\n<p>                             Petitioner is aggrieved by the order dated 10.5.2004<\/p>\n<p>                  passed by learned Judicial Magistrate, 1st Class, Muzaffarpur in<\/p>\n<p>                  G.R. case no. 2211\/2001 (Tr. No. 580 of 2001) whereby his<\/p>\n<p>                  application seeking release of the silver coins\/ornaments and<\/p>\n<p>                  cash has been rejected. He is also aggrieved by order dated<\/p>\n<p>                  24.4.2007 passed on his Cr. Rev. no. 117 of 2004 whereby the<\/p>\n<p>                  order of learned Judicial Magistrate, 1st Class, has not been<\/p>\n<p>                  interfered with.\n<\/p>\n<p>                             The     petitioner   claims    the    aforesaid     silver<\/p>\n<p>                  coins\/ornaments as also the cash which allegedly was\/were<\/p>\n<p>                  found in his possession while riding a jeep. At the time of seeking<\/p>\n<p>                  bail, the petitioner led his claim over those seized silver<\/p>\n<p>                  coins\/ornaments and cash. Initially provisional bail was granted to<\/p>\n<p>                  him and a report about the verification of his claim was directed to<\/p>\n<p>                  be submitted by the Investigating Officer. On submission of the<\/p>\n<p>                  report, his provisional bail was confirmed by order dated<\/p>\n<p>                  15.1.2002 which reads as follows:\n<\/p>\n<blockquote><p>                             &#8220;Accused Mukesh Kumar, Raj Kishore Singh<br \/>\n                          and Pramod Kumar surrendered before the court<br \/>\n                          and a petition has been filed on their behalf with<br \/>\n                          a prayer to confirm the bail of the petitioner which<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>       was granted to him.\n<\/p><\/blockquote>\n<p>          Heard Sri N.K. Verma the learned Advocate<br \/>\n       appearing for the petitioner and the A.P.P. and<br \/>\n       perused the record as well as report of the I.O.<br \/>\n       on the point of verification of the receipts as<br \/>\n       ordered on 23.11.2001 by which the petitioner<br \/>\n       were granted bail. It has been submitted on<br \/>\n       behalf of the petitioners that it has been found by<br \/>\n       the police that the receipts are genuine and<br \/>\n       property belong to the petitioners and therefore it<br \/>\n       has been prayed that the provisional bail granted<br \/>\n       to the petitioner be confirmed.\n<\/p>\n<p>          On the other hand, the learned A.P.P.\n<\/p>\n<p>       concedes the prayer made on behalf of the<br \/>\n       petitioner and hence the provisional bail granted<br \/>\n       on 23.11.2001 is hereby confirmed. &#8221;\n<\/p>\n<p>          This Court by order dated 15.2.2010 called for a report<\/p>\n<p>from the court below. The said report has been submitted and is<\/p>\n<p>placed at Flag-A. Relevant      part of the report is quoted<\/p>\n<p>hereinbelow:\n<\/p>\n<blockquote><p>           &#8220;On the perusal of the record, it further transpires<br \/>\n          that the report dt. 19.1.2002 of Sub Inspector<br \/>\n          Brahampura P.S. is there on the record where in it<br \/>\n          has been reported that the receipt dt. 3.11.01<br \/>\n          granted by A.K. Brothers Bakarganj, Patna, The<br \/>\n          receipt dt. 9.11.2001 granted by Raj Lakshmi<br \/>\n          Jwellers, Sahu Complex, Bakarganj Patna and the<br \/>\n          receipt   dt.    8.11.2001   granted       by   Shiv<br \/>\n          Ornament\/house Sahebganj Chapra are seemed<br \/>\n          to be genuine. So far as the other receipt are<br \/>\n          concerned, there is no report about their<br \/>\n          genuineness in the said report dt. 9.1.2002. And<br \/>\n          therefore direction has been given to the Officer-<br \/>\n          in-charge to the concerned police station to be<br \/>\n          report about their genuineness by the order dated<br \/>\n          09.03.10 as soon as the said report about the<br \/>\n          genuineness of the rest receipt is received a<br \/>\n          further report will be send to the Hon&#8217;ble Court<br \/>\n          immediately.&#8221;<\/p><\/blockquote>\n<p>           Learned counsel for the petitioner states that Manish<\/p>\n<p>Abhushan Bhandar is the shop owned by the petitioner.<\/p>\n<p>           In my view, the petitioner has made out a case for<\/p>\n<p>release of the aforesaid silver coins\/ornaments and cash subject<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>      to furnishing appropriate bond\/indemnity bond\/sureties. A stand<\/p>\n<p>      has fairly been taken by the petitioner that no issue shall be<\/p>\n<p>      raised at the trial with regard to non-production of the material<\/p>\n<p>      exhibits relating to those articles.\n<\/p>\n<p>                    This Court is thus satisfied that petitioner has made<\/p>\n<p>      out a case for release of silver coins\/ornaments and cash seized<\/p>\n<p>      from him. The court below is at liberty to take appropriate<\/p>\n<p>      bond\/indemnity bond\/security and impose conditions as it may<\/p>\n<p>      deem fit for release of the aforesaid articles. Aforesaid articles,<\/p>\n<p>      however, must be released within two weeks from the date of<\/p>\n<p>      production of a copy of the order.\n<\/p>\n<p>                    The application is disposed of with the aforesaid<\/p>\n<p>      directions.\n<\/p>\n<\/p>\n<p>                                ( Kishore K.
