Application No.771 of 2010 being Leave to prefer<br \/>\nAppeal bearing Criminal Appeal No.149 of 2010 against recording<br \/>\nacquittal of the respondent accused of the offence punishable under<br \/>\nSection 302 of Indian Penal Code by judgment and order dated 2.7.2009<br \/>\nrendered in Sessions Case No.98 of 2008 by learned Additional<br \/>\nSessions Judge, Panchmahal at Godhra.\n<\/p>\n<p>2.\t\tHeard<br \/>\nMr.L.B.Dabhi, learned APP for the Applicant   State. The<br \/>\nrespondent, though served with the notice of Rule, yet he has chosen<br \/>\nnot to remain present.  Mr.Dabhi, learned APP submitted that the<br \/>\ndelay occurred on account of inter-department and intra-department<br \/>\nprocedure for obtaining required permission for the purpose of<br \/>\npreferring acquittal appeal.  The reasons as to why the appeal could<br \/>\nnot be preferred in time have been setforth in paragraphs 3, 4 and 5<br \/>\nin the memo of the application. The contents of these paragraphs<br \/>\nremained uncontroverted.  The reasons setforth in the application are<br \/>\nsupported by the affidavit of Mr.G.P.Rathod, Under Secretary, Legal<br \/>\nDepartment, Sachivalaya, Gandhinagar.\n<\/p>\n<p>3.\t\tConsidering<br \/>\nthe facts and circumstances of the case, so also explanation for<br \/>\ndelay setforth in the application and celebrated principles regarding<br \/>\ncondonation of delay under Section 5 of the Limitation Act and<br \/>\npronouncement of the Honourable Apex Court construing the provisions<br \/>\ncontained in Section 5 of the Limitation Act liberally, we are of the<br \/>\nconsidered opinion that the delay is required to be condoned.\n<\/p>\n<p>4.\t\tFor<br \/>\nthe foregoing reasons, the application is allowed.  The delay of 84<br \/>\ndays in preferring Leave to Appeal being Criminal Misc. Application<br \/>\nNo.771 of 2010 in preferring Criminal Appeal No.149 of 2010 is<br \/>\ncondoned.
