                  Vijay Anand for the respondents. Respondent no.1 of CWJC<\/p>\n
                  No. 8251 of 2009 (Brajesh Kumar vs. Food Corporation of<\/p>\n
                  India & Ors.),<\/a> has preferred this appeal under clause 10 of<\/p>\n
                  the Letters Patent of the High Court of Judicature of Patna,<\/p>\n
                  and is aggrieved by the order dated 1.12.2009, whereby the<\/p>\n
                  sealed cover with respect to promotion of the respondent<\/p>\n
                  herein (the writ petitioner) has been directed to be opened<\/p>\n
                  subject to the punishment of censure to him.<\/p>\n
                             2.     A brief statement of facts essential for the<\/p>\n
                  disposal of the appeal may be indicated. The respondent<\/p>\n
                  herein is a Manager in the services of the Corporation.
\n                   2<\/span><\/p>\n
Show-cause notice was issued to him with a view to award<\/p>\n
minor penalty against him. He was ultimately awarded the<\/p>\n
punishment of censure. It is relevant to state that the<\/p>\n
respondent (the writ petitioner) took the stand in the writ<\/p>\n
proceeding that the order of censure had not been served on<\/p>\n
him and he could not, therefore, prefer departmental appeal<\/p>\n
against the same. In the meanwhile, the question of<\/p>\n
promotion arose, the respondent’s case was considered, and<\/p>\n
it was kept in a sealed cover. The respondent preferred the<\/p>\n
present writ petition for a direction that,         in the<\/p>\n
circumstances of the case, there is no justification for the<\/p>\n
sealed cover procedure which may be set at naught and he<\/p>\n
may be directed to be promoted to the next higher post with<\/p>\n
effect from the date his junior has been promoted. The writ<\/p>\n
petition has been allowed and it has been held that there is<\/p>\n
no justification of sealed cover in the present case which<\/p>\n
may be opened and his case for promotion may be<\/p>\n
considered in accordance with the recommendation of the<\/p>\n
D.P.C., as contained in the sealed cover subject to the<\/p>\n
punishment of censure.\n<\/p>\n
          3. We have perused the materials on record and<\/p>\n
considered the submissions of the learned counsel for the
\n                         3<\/span><\/p>\n
      parties. It appears to us that no departmental proceeding, nor<\/p>\n
      criminal case, was pending on 8.10.2007, the date on which<\/p>\n
      the D.P.C. met and sealed-.cover procedure was followed.<\/p>\n
      In such a situation, there cannot be justification for sealed<\/p>\n
      cover procedure. The learned counsel for the respondent has<\/p>\n
      rightly relied on the judgment of Supreme Court in Union<\/p>\n
      of India v. K V Jankiraman (AIR<\/a> 1991 SC 2010). In that<\/p>\n
      view of the matter, we agree with the order of the learned<\/p>\n
      Single Judge directing the Corporation to open the sealed<\/p>\n
      cover and take the case of the respondent’s promotion in<\/p>\n
      accordance with law subject of course to the punishment of<\/p>\n
      censure or such other materials on record against the<\/p>\n
      respondent. We agree with the order of the learned Single<\/p>\n
      Judge.\n<\/p>\n
                4.   The appeal is dismissed.\n<\/p>\n<\/p>\n
