For unauthorised use of<br \/>\n\telectricity, provisional assessment of Rs.62,034.81ps was made by<br \/>\n\tthe company. Final bill was issued on 2.9.2005. Petitioner preferred<br \/>\n\tappeal against the said notice. Before preferring such appeal, it<br \/>\n\tmay be noted that, petitioner had approached the District Consumer<br \/>\n\tDispute Redressal Forum. His application came to be dismissed on<br \/>\n\t18.1.2007 holding that complaint is not maintainable. Thereupon the<br \/>\n\tpetitioner preferred appeal before the Appellate Authority. The<br \/>\n\tAppellate Authority however, by impugned communication dated<br \/>\n\t17.2.2007 dismissed the appeal on the ground that same was not<br \/>\n\tpreferred within 39 days in terms of Section 127 of the Electricity<br \/>\n\tAct, 2003.\n<\/p>\n<p>Counsel<br \/>\n\tfor the petitioner submitted that petitioner was agitating issue<br \/>\n\tbefore the Consumer forum under bona fide belief that said forum<br \/>\n\thaving jurisdiction. As soon as his complaint came to be dismissed<br \/>\n\tas not maintainable, he preferred appeal which came to be dismissed.<br \/>\n\tSame ought to have been entertained on merits.\n<\/p>\n<p>On<br \/>\n\tthe other hand, learned counsel for the Electricity board contended<br \/>\n\tthat no application for condonation of delay was filed. Appellate<br \/>\n\tAuthority therefore, rightly dismissed the appeal as being time<br \/>\n\tbarred.\n<\/p>\n<p>In<br \/>\n\tfacts of the case, I am of the opinion that petitioner should be<br \/>\n\tgiven an opportunity to explain delay, particularly, when it is his<br \/>\n\tcase that he was under bona fide belief agitating the issue before<br \/>\n\tthe District Consumer Forum which eventually dismissed the complaint<br \/>\n\t as not maintainable.\n<\/p>\n<p>In<br \/>\n\tthe result, impugned communication dated 17.2.2007 is quashed. The<br \/>\n\tpetitioner shall file application for condonation of delay in the<br \/>\n\tappeal which is already presented before the Appellate Authority. If<br \/>\n\tsuch application is filed within two weeks from today, same shall be<br \/>\n\tconsidered by the Appellate Authority in accordance with law.\n<\/p>\n<p>Disposed<br \/>\n\tof accordingly.
