Justice R.BASANT\n\n Dated :26\/05\/2008\n\n O R D E R\n                               R.BASANT, J\n                        ------------------------------------\n                       Crl.M.C No.2013 of 2008\n                       -------------------------------------\n                 Dated this the 26th day of May, 2008\n\n                                    ORDER\n<\/pre>\n<p>      Petitioners face indictment in a prosecution for offences<\/p>\n<p>punishable, inter alia, under Section 307 I.P.C. They are arrayed<\/p>\n<p>as accused 4 and 5, it is submitted. As the petitioners have not<\/p>\n<p>so far entered appearance, coercive processes have been issued<\/p>\n<p>against the petitioners. They apprehend imminent arrest.<\/p>\n<p>      2.    According to the petitioners, they are absolutely<\/p>\n<p>innocent. Their absence earlier was not wilful or deliberate. They<\/p>\n<p>are willing to surrender before the learned Magistrate and apply<\/p>\n<p>for bail. But they apprehend that their application for regular bail<\/p>\n<p>may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously. It is therefore prayed that<\/p>\n<p>directions under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioners.\n<\/p>\n<p>      3.    It is for the petitioners to appear before the learned<\/p>\n<p>Magistrate    and    explain        to     the       learned  Magistrate the<\/p>\n<p>circumstances under which they could not earlier appear before<\/p>\n<p>the learned Magistrate.        I have no reason to assume that the<\/p>\n<p><span class=\"hidden_text\">Crl.M.C No.2013 of 2008          2<\/span><\/p>\n<p>learned Magistrate would not consider such application on merits,<\/p>\n<p>in accordance with law and expeditiously. Every court must do<\/p>\n<p>the same.     No special or specific direction appears to be<\/p>\n<p>necessary. Sufficient general directions have already been issued<\/p>\n<p>in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy Superintendent of Police<\/a><\/p>\n<p>[2003(1) KLT 339].\n<\/p>\n<p>     4.    This Crl.M.C is, in these circumstances, dismissed, but<\/p>\n<p>with the specific observation that if the petitioners appear before<\/p>\n<p>the learned Magistrate and apply for bail after giving sufficient<\/p>\n<p>prior notice to the Prosecutor in charge of the case, the learned<\/p>\n<p>Magistrate must proceed to pass appropriate orders on merits<\/p>\n<p>and expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>     Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioners.\n<\/p>\n<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\nrtr\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court A.M.
