No.2795 of 2006\n\n\n\n\n11.11.2010\n\n\n      Shri Nishant Namdeo, for the applicant.\n      Shri Mohan Sausarkar, Counsel for respondent Nos. 1 and<\/pre>\n<p>5.<br \/>\n      Shri Vivek Agrawal, G.A. for the respondents No.2 and 3.<br \/>\n      Shri Anshuman Singh, Counsel for the respondent No.4.<br \/>\n      Shri Agrawal, learned counsel for the State submitted that<br \/>\nthough a compliance report has been filed but all the directions<br \/>\npassed by this Court in W.P.561\/01 have not been complied<br \/>\nwith. Shri Agrawal prays further a months time to file<br \/>\ncompliance report in the matter.\n<\/p>\n<p>      From the perusal of the record we find that on 22.6.1997<br \/>\nJabalpur and the surrounding areas were rocked by an<br \/>\nearthquack. A public interest litigation was filed in which this<br \/>\nCourt on 16.9.2002 issued various directions to the State<br \/>\nGovernment to make the provisions in respect of any future<br \/>\nunseen event. It appears that certain plans were made by the<br \/>\nState Govt. but have not been implemented till date. Only<br \/>\nplanning cannot help the public in case of any such eventuality<br \/>\nin future.   A concrete work with infrastructure is required to<br \/>\nmeet out any such exigency but such efforts have not been<br \/>\nmade till date.\n<\/p>\n<p>      In view of the aforesaid, we are not satisfied with the<br \/>\ncontention of the respondent that any serious efforts have been<br \/>\nmade by the State for the compliance of the direction. It is also<br \/>\nbrought to our notice that all the roads connecting city of<br \/>\nJabalpur are in a bad condition and in case of any mis<br \/>\nhappenings, the public of this township cannot get the help\n<\/p>\n<p>                                                                  2&#8230;..\n<\/p>\n<p>                    M.C.C. No.2795 of 2006<\/p>\n<p>11.11.2010<\/p>\n<p>quickly as the road conditions are very bad. It is stated by the<br \/>\npetitioner that to meet out such exigency, roads connecting to<br \/>\nthis city with the other cities should be also made motorable.<br \/>\nThe aforesaid contention of the petitioner is not opposed by the<br \/>\nState. Present condition of the roads are very bad which should<br \/>\nbe motorable so that in case of any emergency the city may get<br \/>\nhelp from other adjoining cities. In view of this we direct the<br \/>\nSecretary P.W.D. and the Principal Secretary, Housing and<br \/>\nEnvironment to remain present before this Court to assist this<br \/>\nCourt to sort out the aforesaid situation.           The aforesaid<br \/>\nauthorities are also directed to file status report in respect of the<br \/>\ncompliance of the order passed by this Court (supra) and also in<br \/>\nrespect of the conditions of the roads connecting this city with<br \/>\nthe other cities.\n<\/p>\n<p>      At this stage, it is submitted by the petitioner that<br \/>\nJabalpur is on the National Highway No.7 and 7-A and these<br \/>\nNational Highways are maintained by the Central Government<br \/>\nand are also in a very bad condition.\n<\/p>\n<p>      Shri Mohan Sausarkar, learned counsel appearing for the<br \/>\nUnion of India is also directed that some officer not below the<br \/>\nrank of the Additional Secretary, Ministry of Surface Transport<br \/>\nand the highest officer posted in the State of Madhya Pradesh<br \/>\ntaking care of the National Highways, shall remain personally<br \/>\npresent before this Court.\n<\/p>\n<p>      Learned counsel appearing for the State is also directed to<br \/>\nsubmit a copy of plan prepared by the State for the compliance<br \/>\nof the orders passed by this Court to Shri Sausarkar who shall\n<\/p>\n<p>                                                          3&#8230;..\n<\/p>\n<p>                  M.C.C. No.2795 of 2006<\/p>\n<p>11.11.2010<\/p>\n<p>sent the aforesaid plans to the concerned department of the<br \/>\nCentral Government to examine whether the aforesaid plans<br \/>\nfulfill all the requirements to meet out any eventuality like<br \/>\nearthquake etc.<br \/>\n      A typed copy of this order be supplied to the counsels<br \/>\nappearing for the respondents for its transmission and<br \/>\ncompliance by the concerned authorities.\n<\/p>\n<p>      Be listed for hearing on 8.12.2010.<\/p>\n<pre>\n\n\n (Krishn Kumar Lahoti)             (Smt.
