DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 09\/09\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p>Ms. Krina Calla, learned APP waives service of rule on behalf of the<br \/>\nrespondent &#8211; State.\n<\/p>\n<p>2.\tThis<br \/>\napplication is filed under section 439 of the Code of Criminal<br \/>\nProcedure by the applicants who   have been arrested in connection<br \/>\nwith C.R. No. I &#8211; 298 of 2010  registered with  Makarpura Police<br \/>\nStation, Vadodara for the offence punishable under sections 147, 148,<br \/>\n149, 307, 323, 325, 504, 406(2) and 427 of the Indian Penal Code and<br \/>\n135 of the Bombay Police Act.\n<\/p>\n<p>3.\tMr.B.\n<\/p>\n<p>S. Patel, learned advocate for the applicant submitted that the<br \/>\napplicant is innocent person and a false case is foisted on him. He<br \/>\nsubmitted that considering the role attributed to the applicant and<br \/>\nreflected in the FIR at Annexure &#8216;A&#8217; to the application, this is a<br \/>\nfit case to enlarge the applicant on regular bail.\n<\/p>\n<p>4.\tAs<br \/>\nagainst the aforesaid, learned APP Ms. Krina Calla submitted that<br \/>\nconsidering the role played by the applicant, no discretionary relief<br \/>\ncan be granted to the applicant, and the application deserves to be<br \/>\ndismissed.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the rival submissions of learned advocates and having<br \/>\nconsidered the role attributed to the applicant and reflected in the<br \/>\nFIR at Annexure A,  the quantum of punishment etc. and gravity and<br \/>\nco-accused being enlarged on bail, I am of the view that the<br \/>\napplicant is required to be enlarged on regular bail at this stage on<br \/>\nstringent conditions, without entering into the merits of the case<br \/>\nand  without discussing the evidence in detail.\n<\/p>\n<p>6.\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>7.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be enlarged on bail in connection<br \/>\nwith  C.R. No. I &#8211; 298 of 2010  registered with  Makarpura Police<br \/>\nStation, Vadodara,  on executing a bond of Rs.10,000\/- [Rupees Ten<br \/>\nthousand only] each with one surety of the like amount to the<br \/>\nsatisfaction of the trial court and subject to the conditions that<br \/>\nthey shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b].\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c].\tsurrender<br \/>\nhis passports, if any, to the lower court within a week;\n<\/p>\n<p>[d].\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e].\tmark<br \/>\nhis presence at the concerned Police Station on 15th day<br \/>\nof each English calendar month between 9.00 AM and 2.00 PM. till the<br \/>\ntrial is over;\n<\/p>\n<p>[f].\tfurnish<br \/>\nthe present addresses of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g].\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.
