Justice ANTONY DOMINIC\n\n Dated :25\/02\/2008\n\n O R D E R\n                         ANTONY DOMINIC, J.\n\n                = =W.P.(C) = =2305=OF= = = = =\n                     = = =No. = =      =\n                                          2008 Y\n                = = = = = = = = = = = = = = = =\n\n                Dated this the 25th February, 2008\n\n                           J U D G M E N T\n<\/pre>\n<p>      The challenge in this writ petition is against taking over of<\/p>\n<p>Sree Narayana Guru Smaraka Bhajanamadam.         Petitioner seeks a<\/p>\n<p>direction to the respondents to hand over possession of the<\/p>\n<p>Bhajanamadam to the petitioner for performing        religious rites.<\/p>\n<p>According to the petitioner, the Bhajanamadam is independent of<\/p>\n<p>SNDP and certain persons had interfered with the functioning of the<\/p>\n<p>Bhajanamadam when they approached the civil court and obtained<\/p>\n<p>Ext. P3 order of injunction.      It is stated that thereafter some<\/p>\n<p>strangers had created trouble and the police intervened in the<\/p>\n<p>matter. According to them, without any rhyme or reason the 1st<\/p>\n<p>respondent took over the Bhajanamadam by Ext. P4 dated<\/p>\n<p>8.11.2007 and it is in this background the writ petition has been<\/p>\n<p>filed praying for directions to hand over the Bhajanamadam to the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No. 2305 OF 2008             -2-<\/span><\/p>\n<p>      2.    Govt. Pleader got instructions in the matter and submits<\/p>\n<p>that since there was apprehended breach of peace on the basis of<\/p>\n<p>the report of the police, the 2nd respondent initiated proceedings<\/p>\n<p>under Section 145(1) of Cr.P.C. which is numbered as MC 61\/07.<\/p>\n<p>According to him, it is on that basis the Bhajanamadam was taken<\/p>\n<p>over. It is stated that notice has been issued to all parties and the<\/p>\n<p>District Collector will finalise the proceedings in accordance with law<\/p>\n<p>after hearing all concerned.\n<\/p>\n<p>      3. From the above facts that has been disclosed before me, it<\/p>\n<p>is evident that the taking over of the Bhajanamadam was<\/p>\n<p>necessitated on account of the apprehension regarding breach of<\/p>\n<p>peace.   If the statutory authority was satisfied that the existing<\/p>\n<p>circumstances justified initiation of proceedings under Section 145<\/p>\n<p>Cr.P.C., this Court will not be justified in interfering with the matter<\/p>\n<p>before its finalisation.\n<\/p>\n<p>      4. Therefore, I dispose of this writ petition itself directing that<\/p>\n<p>the petitioner shall appear before the 2nd respondent and show<\/p>\n<p>cause against the proceedings that are initiated by the 2nd<\/p>\n<p>respondent.
