Respondents\n\n\n\tCivil Revision Petition is filed under Article 227 of the Constitution of India against the order in I.A.No.1031 of 2008 in O.S.No.94 of 2004 dated 02.07.2008 on the file of the District Munsif's Court, Pollachi.\n\n\t\tFor Petitioner      :  Mr.C.R. Prasanan\n\t\t\n \t\t\t\t\t    \nO R D E R\n<\/pre>\n<p>\tThe Revision Petitioner herein is the plaintiff in Suit in O.S.No.94 of 2004 on the file of the learned District Munsif, Pollachi.  The petitioner\/plaintiff has filed O.S.No.94 of 2004 praying for a Judgment and Decree against the defendants to the effect that she is the absolute legatee of the suit property of the last and latest Sill  dated 18.06.1978 of Vasuvammal.\n<\/p>\n<p>\t2. The First Respondent\/First Defendant has filed written statement before the Trial Court inter alia stating that  the suit is barred under the legal principle of resjudicata and that the plaintiff is totally stranger and she cannot claim any right to the property and the suit is vexatious one and further that the point in issue was already decided and confirmed in O.S.No.282 of 1938 and O.S.No.13 of 1968 and as such the Revision Petitioner\/Plaintiff is estopped from reagitating the issue in view of her filing the suit in O.S.No.13 of 1968 and suffering a decree of dismissal.\n<\/p>\n<p>\t3. Admittedly, the said suit in O.S.No.94 of 2004 on the file of the learne District Munsif, Pollachi is pending.  It transpires that an I.A. 1031 of 2008 has been filed by the First Defendant\/Power Agent before the Trial Court stating that he is serving as Manager of the first defendant temple and that the Temple&#8217;s Managing Trustee Thiru.P. Venkataraman  on account of his illness is unable to appear before the Court and conduct the same and therefore he has been aurhtorised on his behalf to conduct the case by means of a Power document dated 07.04.2008 and therefore prays for permitting him to conduct the case on behalf of the first defendant temple.\n<\/p>\n<p>\t4. The revision petitioner\/plaintiff has filed his counter inter alia stating that the Power Agent cannot depose for the plaintiff and that the application cannot be entertained legally and that the power agent cannot substitute the plaintiff as a witness.\n<\/p>\n<p>\t5. After contest, the Trial Court has come to a conclusion among other things observed that  &#8220;the evidentiary value and evaluation is important and that evaluation of the evidence is left within the domain of the presiding officer&#8221; and resultantly allowed the application without costs.\n<\/p>\n<p>\t6. Learned counsel for the revision petitioner urges before this Court that the Order of the Trial Court in I.A.No.1031 of 2008 dated 02.07.2008 is without jurisdiction and the same suffers from material irregularity and therefore the same is unsustainable in the eye of law.  Further it is the contention of the learned counsel for the Revision Petitioner that there is no evidentiary value for the evidence of the Power of Attorney if he leads evidence in respect of the suit claim and that the Court is not followed the decision reported in (2008) 1 MLJ 354 [ <a href=\"\/doc\/1623650\/\">Sakunthala (Ms.) v. Anandarajan and Another<\/a>] whereby and whereunder it is observed that &#8216;an authorised agent cannot be permitted to give evidence where the evidence is based on personal knowledge of the principal and that the power agent appointed in the year 2003 cannot be expected to know the normal course of business which happened in 1994&#8217;.\n<\/p>\n<p>\t7. He also presses into service the decision of the Honourable Supreme Court in <a href=\"\/doc\/888686\/\">Janaki Vashdeo Bhojwani &amp; Another v. Indusind Bank Ltd., &amp; Others<\/a> reported in 2005-3-L.W. 403 wherein it is observed that &#8216;Power of Attorney holder&#8217;s right\/duty to &#8220;act&#8221; on behalf of the principal would not include deposing in court in the place of Principal\/Agency.&#8217;  He also cites another decision <a href=\"\/doc\/129820\/\">R. Arjunan vs. Arunachala Gounder and<\/a> 3 others in 2006-4-L.W.520 wherein this Court has held that &#8220;Power of Attorney cannot speak on behalf of the principal  and therefore it is not permissible to permit the Power of Attorney to represent the principal to appear and let in evidence in respect of the acts of personal knowledge.&#8221;\n<\/p>\n<p>\t8. On a careful consideration of the arguments advanced on behalf of the revision petitioner, this Court is of the considered view that it is not permissible to permit the Power of Attorney viz.,  First respondent\/First Defendant to represent the principal, to appear and let in evidence in respect of the acts of personal knowledge and in this view of the matter, this Court allows the Civil Revision Petition in the above terms since there is no evidentiary value for the evidence of the Power of Attorney if he leads evidence to represent principal in respect of the suit claim touching upon the acts of personal knowledge.  However, when the Power of Attorney holder enters the witness box in place of plaintiff and deposes only with respect to documents; such documents can be relied upon as per decision in Secretary to Government of India, Ministry of Defence v. Indira Devi reported in AIR 2003 AP 329.\n<\/p>\n<p>\t9. Before parting, this Court directs  the Trial Court to bear in mind of the observation of the Honourable Supreme Court in <a href=\"\/doc\/888686\/\">Janaki Vashdeo Bhojwani &amp; Another v. Indusind Bank Ltd., &amp; Others<\/a> reported in 2005-3-L.W. 403 in regard to the authority of Power of Attorney to speak on behalf of the principal to act accordingly based on the facts and circumstances of the case. It is open to the first defendant\/Temple to adduce evidence in the case through their Managing Trustee who is conversant with its affairs, since by this time he would have recovered from his illness.\n<\/p>\n<p>\t10. In the result, the Civil Revision Petition is partly allowed in the above terms. Resultantly the order passed by the learned District Munsif, Pollachi in I.A.No.1031 of 2008 in O.S.No.94 of 2004 stands modified.
